SITE PLAN APPLICATION #SP-16-72
FINDINGS OF FACT AND DECISION
Rye Associates, LLC, hereinafter referred to as the applicant, is seeking site plan
approval to amend a previously approved plan for a 4,726 sq. ft. general office building
(not yet constructed). The amendment consists of relocating a handicapped space, 41
Rye Circle.
Based on the findings below, the Administrative Officer finds, concludes, and decides the
following:
FINDINGS OF FACT
1. The applicant is seeking site plan approval to amend a previously approved plan
for a previously approved plan for a 4,726 sq. ft. general office building (not yet
constructed). The amendment consists of relocating a handicapped space, 41
Rye Circle.
2. The owner of record of the subject property is Rye Associates, LLC.
3. The subject property is located in the Southeast Quadrant Village Commercial
Zoning District.
4. The application was received on October 14, 2016.
5. The plan set submitted consists of seven (7) pages, page one (1) is entitled,
"Rye Meadow Commercial Development 1075 Hinesburg Rd. South Burlington
Vermont" prepared by Civil Engineering Associates, Inc., dated February 2016,
and last revised on 9/28/16.
DIMENSIONAL REQUIREMENTS
6. All dimensional requirements will continue to be met.
SITE PLAN REVIEW STANDARDS
Only the standards below will are affected by this application. All other standards will
continue to be met.

Parking
7. One (1) handicapped space will relocated from the north side of the building to
the south side of the building. No change in the number of spaces being
provided.
Snow Storage
8. The plans do not depict the snow storage area(s) as required. Therefore, the
plans will have to be revised to show the snow storage area(s).
DECISION
Based on the above Findings of Fact, the Administrative Officer hereby approves site
plan #SP-16-72 of Rye Associates, LLC, based on the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and will be on file in the
South Burlington Department of Planning and Zoning.
3. The site plan must be revised to show the changes below and will require
approval of the Administrative Officer. Three (3) copies of the approved revised
plan must be submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to show the snow storage area(s).
3. The applicant must obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
4. The Applicant must obtain a Certificate of Occupancy from the Administrative
Officer prior to the use of the new parking layout.
5. Prior to issuance of a zoning permit, the applicant must submit to the
Administrative Officer a final set of project plans as approved in digital (PDF)
format.
6. Any change to the site plan shall require approval by the South Burlington
Administrative Officer or the Development Review Board.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision
by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
The applicant or permittee retains the obligation to identify, apply for, and obtain
