HomeMy WebLinkAboutSP-17-78 - Decision - 0127 Rye Circle#SP-17-78 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING RYE ASSOCIATES, LLC — 115-127 RYE CIRCLE SITE PLAN APPLICATION #SP-17-78 FINDINGS OF FACT AND DECISION Rye Associates, LLC, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a seven (7) unit single family cluster known as "The Cottages". The amendment consists of constructing a dumpster enclosure, 115-127 Rye Circle. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a seven (7) unit single family cluster known as "The Cottages". The amendment consists of constructing a dumpster enclosure, 115-127 Rye Circle. 2. The owner of record of the subject property is Rye Associates, LLC. 3. The subject property is located in the SEQ Neighborhood Residential Zoning District. 4. The application was received on November 29, 2017. 5. The plan set submitted consists of a two (2) page set of plans, page one (1) is titled, "Proposed Conditions Site Plan", sheet SK-9, prepared by Civil Engineering Associates, Inc., and dated November 2017. DIMENSIONAL REQUIREMENTS 6. Overall coverage will change only slightly as this project is a small portion of a larger PUD. All other coverages will remain unchanged. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: Only the standards below are affected by this application. All other standards will continue to be met. Landscaping/Screening - 1 - #SP-17-78 7. The applicant is proposing to install some plantings on three (3) sides of the enclosure. The City Arborist in an email to staff on 11/30/17 styed that he has no concerns with the plan. Only the standards below are affected by this application. All other standards will continue to be met. Bicycle Parking 8. This project consists of a cluster of single family dwellings so Section 13.14 of the LDRs requiring the new type and location for bicycle racks, does not apply. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves Site Plan Application #SP-17-78 of Rye Associates, LLC, subject to the following conditions: All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant must obtain a zoning permit prior to start of construction and within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
