HomeMy WebLinkAboutSP-17-80 - Decision - 0089 Rye Circle#SP-17-8i1 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING RYE ASSOCIATES, LLC-89 RYE CIRCLE SITE PLAN REVIEW APPLICATION #SP-17-80 FINDINGS OF FACT AND DECISION Site plan review application #SP-17-80 of Rye Associates, LLC for after -the -fact approval to amend a previously approved plan for a 6,000 sq. ft. building consisting of: 1) 3,000 sq. ft. of personal instruction use, 2) 1,500 sq. ft. of personal service use, and 3) 1,500 sq. ft. of undetermined use. The amendment consists of: 1) relocating the building & parking to the north, and 2) relocating the parking turnaround and bioswale, 89 Rye Circle. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant, Rye Associates, LLC, seeks after -the -fact approval to amend a previously approved plan for a 6,000 sq. ft. building consisting of: 1) 3,000 sq. ft. of personal instruction use, 2) 1,500 sq. ft. of personal service use, and 3) 1,500 sq. ft. of undetermined use. The amendment consists of: 1) relocating the building & parking to the north, and 2) relocating the parking turnaround and bioswale, 89 Rye Circle. 2. The owner of record of the subject property is Rye Associates, LLC. 3. The subject property is located in the Southeast Quadrant Village Commercial Zoning District. 4. The application was received on December 6, 2017. 5. The plan submitted consists of a nine page set of plans, page one (1) is labeled "Proposed Overall Site Plan," dated September 2016, last revised on 12/4/17, and prepared by Civil Engineering Associates, Inc. DIMENSIONAL REQUIREMENTS 6. Building coverage is 25.35% (maximum allowed is 26%). Overall coverage will increase to 60.7 % (maximum allowed is 63%). 7. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be #SP-17-80 met. Bicycle Parking 8. The plan complies with Section 13.14 of the LDRs to include the new type and location for bicycle racks, to accommodate six (6) short-term bicycle parking spaces. Vehicular Parking; 9. The proposed uses require a total of 18 spaces and 22 spaces are being provided. Stormwater; 10. The applicant relocated the bioswale as part of the site modifications. The Stormwater Division reviewed the modification and indicated in an email to staff on 12/21/17 that the modification is acceptable. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-17-80 of Rye Associates, LLC, subject to the following conditions: 1. All previous approvals and stipulations which are not changed by this decision, will remain in full effect. 2. This project must be completed as shown on the plans submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications must be underground. 4. The applicant will be responsible to regularly maintain all stormwater treatment and conveyance structures on -site. 5. The applicant must obtain a zoning permit within six (6) months to construct the site modifications pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 6. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 7. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use or occupancy of the structure. 8. Any change to the site plan will require approval by the South Burlington Development Review Board or Administrative Officer. #SP-17-80 X41v%ASigned this day of 2017, by PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision by filing a Notice of Appeal with the secretary of the Development Review Board.
