SITE PLAN APPLICATION #SP-17-24
FINDINGS OF FACT AND DECISION
Gamal Eltabbakh, hereinafter referred to as the applicant, is seeking approval to amend
a previously approved plan for a 40,261 sq. ft. building consisting of equal parts general
office use and medical office use. The amendment consists of: 1) converting 2,451 sq.
ft. of general office use to a 40 student child care facility, non-residential use, 1060
Hinesburg Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking to amend a previously approved plan for a 40,261 sq. ft.
building consisting of equal parts general office use and medical office use. The
amendment consists of: 1) converting 2,500 sq. ft. of general office use to a 40 student
child care facility, non-residential use, 1060 Hinesburg Road.
2. The owner of record of the subject property is Gamal H. Eltabbakh.
3. The subject property is located in the Industrial & Open Space Zoning District.
4. The application was received on April 14, 2017.
5. No changes to the approved site plan proposed with the exception of adding a play
area.
DIMENSIONAL REQUIREMENTS
7. The overall coverage will increase to 49.36% (maximum allowed is 50%).
8. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Vehicular access
Only the standards below are affected by this application. All other standards will
continue to be met.

Parking
9. The change in use will not result in any additional parking spaces being required.
Traffic
10. The current approved uses are approved to generate 101 pm peak hour trip ends.
The City of South Burlington Impact Fee Ordinance was amended on May 19, 2014 to
allow a pass -by rate reduction of 30% when estimating the traffic to be generated by
child care centers for which the City has issued a zoning permit since 1/1/11. The
additional 40 students are estimated to generate 33.66 vtes and with the 30% reduction
to generate 23.56 vtes (33.66 X 0.7 = 23.56). The existing uses and the proposed child
care facility will generate a total of 120.01 which results in 19.01 additional vtes.
Other
11. The plans note that there will be a daycare and a preschool but the applicant has
indicated to staff that the word "or" should be included between these two (2) options.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-24 of Gamal H. Eltabbakh, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The site plan must be revised to show the changes below and will require approval
of the Administrative Officer. Three (3) copies of the approved revised plan must be
submitted to the Administrative Officer prior to permit issuance.
a. The site plan must be revised to include the word "or" between the two
(2) daycare options listed on sheet C1.2 of the plans.
4. For the purpose of calculating road impact fees under the South Burlington Impact
Fee Ordinance, the Administrative Officer estimates that this change in use will
generate 19.01 additional vehicle trip ends during the p.m. peak hour.
5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to the use of the newly converted space.

7. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.

by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
