SITE PLAN APPLICATION #SP-17-72
FINDINGS OF FACT AND DECISION
Gamal Eltabbakh, hereinafter referred to as the applicant, is seeking approval to amend
a previously approved plan for a 40,261 sq. ft. building consisting of: 1) 20,130.5 sq. ft.
of medical office use, 2) 17,679.5 sq. ft. of general office use, and 3) 2,451 sq. ft. of
child care facility, non-residential use. The amendment consists of: 1) converting 15,000
sq. ft. of general office use to no use, 1060 Hinesburg Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking to amend a previously approved plan for a 40,261 sq. ft.
building consisting of: 1) 20,130.5 sq. ft. of medical office use, 2) 17,679.5 sq. ft. of
general office use, and 3) 2,451 sq. ft. of child care facility, non-residential use. The
amendment consists of: 1) converting 15,000 sq. ft. of general office use to no use,
1060 Hinesburg Road.
2. The owner of record of the subject property is Gamal H. Eltabbakh.
3. The subject property is located in the Industrial & Open Space Zoning District.
4. The application was received on October 13, 2017.
5. No changes to the approved site plan proposed and no site plan submitted or
required to be submitted with this amendment.
DIMENSIONAL REQUIREMENTS
7. No changes to coverages.
8. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.
Parking

9. The change in use will result in the reduction of the number of parking spaces being
required from 172 spaces to 129 spaces and 172 spaces are available.
Traffic
10. The originally proposed uses are approved to generate 101 pm peak hour trip ends.
The conversion of 15,000 sq. ft. of general office use to no use results in a reduction of
estimated traffic for the remaining uses to 96.36 vtes which results in no additional vtes
being proposed. The breakdown of the 96.36 vte total is as follows:
20,130.5 sq. ft. of medical office = 68.87 vtes
2,679.5 sq. ft. of general office = 3.99 vtes
15,000 sq. ft. of space with no use = 0 vtes
2,451 sq. ft. of day care use for 40 students = 23.5 vtes
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-72 of Gamal H. Eltabbakh, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. For the purpose of calculating road impact fees under the South Burlington Impact
Fee Ordinance, the Administrative Officer estimates that this change in use will
generate zero (0) additional vehicle trip ends during the p.m. peak hour.
4. Any uses proposed for the 15,000 sq. ft. which has no use approved, will have to
obtain site plan approval prior to the issuance of a zoning permit for any new use in
this space.
5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to the use of the newly converted space.
7. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.

Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
