FINDINGS OF FACT AND DECISION

CITY OF SOUTH BURLINGTON
Re: Findings of Fact, preliminary plat application of A & M Construction to convert a 1540 sq. ft.
single family dwelling to general office use, 1035 Hinesburg Road.
On the 2 1 " of December, 1999, the South Burlington Development Review Board approved the
preliminary plat application of A & M Construction under Section 203 of the South Burlington
Subdivision Regulations based on the following findings:
1. This project consists of a planned unit development consisting of converting a single family
dwelling to general office use.
2. This property located at 1035 Hinesburg Road lies within the Industrial - Open Space District.
It is bounded on the north, south and west by residences and undeveloped land, and on the east by
Hinesburg Road.
3. Access/circulation: Access is proposed to be provided by a 24 foot shared curb cut on
Hinesburg Road. The two (2) existing driveways will be eliminated.
Circulation on the site is adequate.
4. Coverage/setbacks: 1035 Hinesburg Road: Building coverage is 7% (maximum allowed is
30%). Overall coverage is 19.2 (maximum allowed is 50%). Front yard coverage is 30%
(maximum allowed is 30%).
The front and side yard setback requirements are not met. Alterations to convert this building can
not exceed 25% as provided in Section 26.002 of the zoning regulations.
5. Parking: A total of six (6) spaces are required and six (6) spaces including one (1)
handicapped space are provided.
6. Landscaping The minimum landscaping requirement, based on building costs, is $300 which is
being met.
7. Sewer: A sewer allocation of 90 gpd is requested. The applicant will be required to pay the
per gallon fee prior to permit issuance.
8. Traffic: ITE estimates that the office at 1035 Hinesburg Road will generate 1.28 additional
vehicle trip ends (vte's) during the P.M. peak hour. The applicant was made aware that the road
impact fee is zero (0).
9. Dumpsters: The dumpster storage area will be screened.
10. Lighting_ The applicant should provide details (cut -sheets) for all exterior lights.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves
the preliminary plat application of A&M Construction to convert a 1540 square foot single family
dwelling to general office use, 1035 Hinesburg Road, as depicted on a nine (9) page set of plans,
page one (1) entitled, "A & M Construction, Inc. South Burlington Vermont," prepared by
Llewellyn - Howley, Inc., dated 4/16/99, last revised on 9/28/99, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain
in effect.
2. The plat plans shall be revised prior to final plat submittal as follows:
a)The survey plat shall be revised to show a six (6) foot easement along the property's
frontage for the sidewalk and water service line.
3. For the purpose of calculating road impact fees under the South Burlington Impact Fee
Ordinance, the Development Review Board estimates that the change is use will generate 1.28
additonal vehicle trip ends during the P.M. peak hour.
4. All exterior lighting shall consist of downcasting shielded fixtures. Any change to approved
lights shall require approval by the Director of Planning and Zoning prior to installation. Details
(cut -sheets) for the exterior lights shall be submitted with the final plat submittal.
5. Prior to issuance of a zoning permit, the applicant shall post a $300 landscape bond. The bond
shall remain in effect for three (3) years to assure that the landscaping takes root and has a good
chance of surviving.
6. The Development Review Board approves a sewer allocation of 90 gpd (includes 20%
reduction allowed by State). The applicant shall be required to pay the per gallon fee prior to
permit issuance.
7. Prior to permit issuance, the applicant shall post a bond to cover the cost of the sidewalk. The
sidewalk shall be constructed in a location approved by the Director of Public Works.
8. The sewer main shall be bedded in 3/4 inch crushed stone.
9. A copy of the plans shall be submitted to the City Water Department.
10. Prior to permit issuance, the applicant shall record an easement deed, approved by the City
Attorney for the sidewalk and water service line.
11. The final plat application shall be submitted within 12 months.
