HomeMy WebLinkAboutSD-99-81 - Decision - 1045 Hinesburg Road#SD-99-81 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact and Decision, preliminary plat application of A & M Construction to: 1)raze an existing single family dwelling, and 2) construct a 10,500 sq. ft. general office building, 1045 Hinesburg Road. On the 2 Pt day of December, 1999, the South Burlington Development Review Board approved the preliminary plat application of A & M Construction under Section 203 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of a planned unit development consisting of 1) razing an existing single family dwelling, and 2) constructing a 10,500 square foot general office building. 2. This property located at 1045 Hinesburg Road lies within the Industrial - Open Space District. It is bounded on the north, south and west by residences and undeveloped land, and on the east by Hinesburg Road. 3. Access/circulation: Access is proposed to be provided by a 24 foot shared curb cut on Hinesburg Road. The two (2) existing driveways will be eliminated. Circulation on the site is adequate. 4. Coverage/Setbacks: Building coverage is 12.5% (maximum allowed is 30%). Overall coverage is 49.9% (maximum allowed is 50%). Front yard coverage is 30% (maximum allowed is 30%). The plan should be revised to show the correct overall coverage. The overall coverage is 49.9%, not 49.7% as shown on the plan. 5. Parr: A total of 42 spaces are required and 42 spaces including one handicapped space and a bike rack are provided. One additional handicapped space is required. 6. Landscaping: The minimum landscaping requirement, based on building costs, is $12,300 which is not being met. The applicant is not proposing any new landscaping. Staff recommended that the applicant provide an additional $12,300 in landscaping in accordance with the regulations. 7. Sewer: A sewer allocation of 630 gpd is requested . The per gallon fee should be paid prior to permit issuance. 8. Traffic: ITE estimates that the new office building at 1045 Hinesburg Road will generate 15.2 additional vte's during the P.M. peak hour. The applicant was made aware that the road impact fee is approximately $3000. 9. Dumpsters: The dumpster storage area will be screened. 10. Lighting The applicant should provide details (cut -sheets) for all exterior lights. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the preliminary plat application of A & M Construction to: 1) raze an existing single family dwelling, and 2) construct a 10,500 square foot general office building, 1045 Hinesburg Road, as depicted on a nine (9) page set of plans, page one (1) entitled, "A & M Construction, Inc. South Burlington Vermont," prepared by Llewellyn -Howley, Inc. dated 4/16/99, last revised on 9/28/99, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plat plans shall be revised prior to final plat submittal as follows: a. The plat plan shall be revised to note the current overall coverage information. b. The plat plans (sheets 1 of 8 and 8 of 8) shall be revised to provide one (1) additional handicapped space. c. The survey plat shall be revised to show a six (6) foot easement along the property's frontage for the sidewalk and water service line. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the general office will generate 15.2 additonal vehicle trip ends during the P.M. peak hour. 4. All exterior lighting shall consist of downcasting shielded fixtures. Any change to approved lights shall require approval by the Director of Planning and Zoning prior to installation. Details (cut -sheets) for the exterior lights shall be submitted with the final plat submittal. 5. Prior to issuance of a Certificate of Occupancy, the applicant shall post a landscape bond in an amount to be determined by staff, not to exceed $12,300. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 6. The Development Review Board approves a sewer allocation of 630 gpd (includes 20% reduction allowed by State). The applicant shall be required to pay the per gallon fee prior to permit issuance. 7. Prior to permit issuance, the applicant shall post a bond to cover the cost of the sidewalk. The sidewalk shall be constructed in a location approved by the Director of Public Works. 8. The building shall be sprinklered and include a fire alarm. 9. The sewer main shall be bedded in 3/4 inch crushed stone. 10. A copy of the plans shall be submitted to the City Water Department. 11. Prior to permit issuance, the applicant shall record an easement deed, approved by the City Attorney, for the sidewalk and water service line. 12.
