HomeMy WebLinkAboutSD-00-02 SD-00-03 - Decision - 1035 1045 Hinesburg Road#SD-00-02 & #SD-00-03 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application of A & M Construction for a planned unit development that consists of 1) converting a single family dwelling to general office use at 1035 Hinesburg Road, and 2) demolition of an existing single-family dwelling and 3) construction of a 10,500 square foot general office building at 1045 Hinesburg Road. On the 15th of February, 2000, the South Burlington Development Review Board approved the final plat applications of A & M Construction under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of a planned unit development that proposes to convert a single family dwelling to general office use, demolition of an existing single-family dwelling and construction of a 10,500 square foot general office building at 1045 Hinesburg Road. 2. The owner of record of these particular properties is A & M Construction Corporation. 3. These properties located at 1035 and 1045 Hinesburg Road lie within the Industrial - Open Space District. The properties are bounded on the north, south and west by residences and undeveloped land and on the east by Hinesburg Road. 4. Access/circulation: Access is proposed to be provided by a 24 foot shared curb cut on Hinesburg Road. The two existing driveways will be eliminated. 5. Coverage/setbacks: For 1035 Hinesburg Road, building coverage is 7% (maximum allowed is 30%). Overall coverage is 19.2 % (maximum allowed is 50%). Front yard coverage is 30% (maximum allowed is 30%). The proposed front and side yard setback requirements are not met. The front yard setback is 23' (minimum 50') and the side yard setback is 23' (minimum 35'). The rear yard setback of 175' is acceptable (minimum 50'). Alterations to convert this building can not exceed 25% as provided in Section 26.002 of the zoning regulations. For 1045 Hinesburg Road, building coverage is 12.5% (maximum allowed is 30%). Overall coverage is 49.9% (maximum allowed is 50%). Front yard coverage is 30% (maximum allowed is 30%). The minimal setback requirements are met. 6. Sidewalk: A seven -foot easement along the property's frontage is delineated on the final plat. Parkina: At 1035 Hinesburg Road, a total of six (6) spaces are required and six (6) spaces including one (1) handicapped space are provided. The plan includes a bike rack. For the property at 1045 Hinesburg Road, a total of 42 spaces are required and 42 spaces including two handicapped spaces and a bike rack are provided. 8. Landscaping; The minimum landscaping requirement, based on building costs, is $300, which is being met at 1035 Hinesburg Road. For 1045 Hinesburg Road, the minimum landscaping requirement, based on building costs, is $12,300 is being met through the reuse of existing materials. The applicant is not proposing any new landscaping. The preliminary plat approval required the applicant to provide a landscape bond in an amount to be determined by staff prior to issuance of a Certificate of Occupancy for the landscaping remaining after construction. 9. Sewer: A sewer allocation of 90 gpd is being requested for 1035 Hinesburg Road. For 1045 Hinesburg Road, a sewer allocation of 660 gpd is requested for the property. The applicant will be required to pay the per gallon fee prior to permit issuance. 10. Traffic: ITE estimates that the office at 1035 Hinesburg Road will generate 1.28 additional vehicle trip ends (vte's) during the P.M. peak hour. The applicant should be made aware that the road impact fee is $0. ITE estimates that the new office building at 1045 Hinesburg Road will generate 15.2 additional vte's during the P.M. peak hour. The applicant has been made aware that the road impact fee is approximately $3,000. 11. Dumpsters: The dumpster storage area will be screened. 12. Lighting: The applicant should provide details (cut -sheets) for all exterior lights. All lights (including building mounted lights) should be downwardly shielded. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the final plat applications of A & M Construction for a planned unit development that consists of 1) converting a single family dwelling to general office use 2) demolition of an existing single-family dwelling and 3) construction of a 10,500 square foot general office building, as depicted on an eight (8) page set of plans, page one (1) entitled "A & M Construction, Inc. South Burlington, Vermont," prepared by Llewellyn — Howley, Inc. Dated 4/16/99, last revised on 1/7/00 with the following stipulations: 1. All previous approvals and stipulations that are not superseded by this approval shall remain in effect. 2 ram, ��. � . ,.;a 2. The applicant shall provide a landscape bond in an amount to be determined by staff prior to issuance of a Certificate of Occupancy for the landscaping remaining after construction. The bond shall remain in effect for three years to assure that the landscaping takes root and has a good chance of surviving. 3. All exterior lighting shall consist of down -casting shielded fixtures. Any change to approved lights shall require approval of the Director of Planning & Zoning prior to installation. The applicant shall submit cut sheets for all exterior light fixtures before permit issuance. 4. The South Burlington Development Review Board approves an additional sewer allocation of 90 g.p.d for 1035 Hinesburg Road and 660 g.p.d. for 1045 Hinesburg Road. The applicant shall pay the per gallon fee prior to permit issuance. 5. The building at 1045 Hinesburg Road shall be sprinklered and include a fire alarm. A residential sprinkler system is recommended for the office building at 1035 Hinesburg Road. 6. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the new office building at 1045 Hinesburg Road will generate 15.2 additional Vehicle trip ends (v.t.e.$) during the P.M. peak hour, and that the office use at 1035 Hinesburg Road will generate 1.3 additional v.t.e.s. 7. Prior to permit issuance, the applicant shall post a bond to cover the cost of the sidewalk. The sidewalk shall be constructed in a location approved by the Director of Public Works. 8. A copy of the plans shall be submitted to the City Water Department. 9. Prior to permit issuance, the applicant shall record an easement deed, approved by the City Attorney, for the sidewalk. 10. The final plat plans shall be recorded in the South Burlington land records within 90 days or this approval is null and void. The Development Review Board Chairman shall sign the plat plans and the final plat plans shall be submitted in digital format prior to recording.
