HomeMy WebLinkAboutSD-02-47 SD-02-51 - Decision - 1035 1045 Hinesburg Road#SD-02-47 and #SD-02-51 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Preliminary plat application #SD-02-47 and final plat application #SD-02-51 of A & M Construction Corporation, Inc. to amend a planned unit development consisting of. 1) converting a single family dwelling to general office use at 1035 Hinesburg Road, and 2) construction of a 10,500 sq ft general office building at 1045 Hinesburg Road. The amendment consists of increasing the size of the general office building at 1035 Hinesburg Road by 1,830 square foot for a total of 13,880 square feet of general office space, 1035 & 1045 Hinesburg Road. On the 200' of August 2002, the South Burlington Development Review Board approved the request of A & M Construction seeking preliminary and final plat approval under Sections 203 and 204 of the South Burlington Subdivision Regulations based on the following findings: 1) This project consists of amending a planned unit development consisting of: 1) converting a single family dwelling to general office use at 1035 Hinesburg Road, and 2) construction of a 10,500 sq ft general office building at 1045 Hinesburg Road. The amendment consists of increasing the size of the general office building at 1035 Hinesburg Road by 1,830 square foot for a total of 13,880 square feet of general office space. The sketch plan was reviewed by the Board at the May 21, 2002 DRB meeting. 2) The owner of record is A & M Construction Corporation. 3) Access/Circulation: Access is provided via a 20 foot wide cub cut on Hinesburg Road. Circulation on site is adequate. No proposed changes. 4) Coverage/Setbacks: Building coverage is 21.2% (maximum allowed is 30%). Overall coverage is 44.9% (maximum allowed is 50%). Front yard coverage along Hinesburg Road is 18.6% (maximum allowed is 30%). 5) All setbacks are met with the proposed structure. Existing structures on this lot do not meet the setback requirements, but remain unchanged. 6) Parking: The parking requirement is 55 spaces. The applicant is proposing 53 spaces including three accessible spaces. This represents a 2 space or 3.6% shortfall. Staff has no problem with the requested waiver. A bike rack is provided. 7) Landscaping: The landscaping plan should be revised to show both the previously approved landscaping for the 10,500 square foot office building, with the proposed landscaping for the current application. 8) The minimum landscaping requirement based on building cost is $1350. Proposed plantings include juniper, rhododendron, lilac, and willow. The landscaping requirement is met. 9) Traffic: ITE estimates the existing use generates 16.08 vehicle trip ends during the PM peak hour. (vte's). ITE estimates the additional office space will generate an additional 4.6 vte's, for a total of 20.68 vte's. The applicant should be prepared to pay the road impact fee for the additional trip ends. 10) Dumpsters: The proposed dumpster area will be screened from view. 11) Lighting_ Details of all exterior light fixtures should be submitted for review. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approved preliminary and final plat application #SD-02-47 and SD-02-51 of A & M Construction Corporation to amend a planned unit development consisting of. 1) converting a single family dwelling to general office use at 1035 Hinesburg Road, and 2) construction of a 10,500 sq ft general office building at 1045 Hinesburg Road. The amendment consists of increasing the size of the general office building at 1035 Hinesburg Road by 1,830 square feet for a total of 13,880 square feet of general office space, as depicted on a plan entitled "Gravelin Property South Burlington Vermont" prepared by Llewellyn -Howley, Inc., dated 3/25/02, with a last revised date of 8/16/02 with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) Pursuant to Section 26.256 (b) of the zoning regulations, the Board approves a total of 53 spaces which represents a two (2) space or 3.6% shortfall. 3) The applicant shall post a landscape bond prior to permit issuance in an amount of $1,350 for the proposed landscaping for the office expansion. This bond shall remain in effect for three (3) years to assure that the landscaping has taken root and has a good chance of surviving. 4) For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the additional office space will generate 4.6 additional vehicle trip ends during the P.M. peak hour. 2 5) The applicant shall submit cut sheets of all proposed exterior lighting prior to permit issuance. Any change to approved lights shall require approval of the Director prior to installation. 6) Any change to the final plat plan shall require approval by the South Burlington Development Review Board. 7) The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. R.C.P. 76, in writing, within 30 days of the date this decision is issued. The fee is $150.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality). 3
