SITE PLAN APPLICATION #SP-16-77
FINDINGS OF FACT AND DECISION
O'Leary -Burke Civil Associates, hereinafter referred to as the applicant, is seeking
approval to amend a previously approved plan for a 9,622 sq. ft. building for commercial
kennel and pet day care use. The amendment consists of adding a short walkway to the
north-eastern emergency exit door, 1045 Hinesburg Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. O'Leary -Burke Civil Associates is seeking approval to amend a previously approved
plan for a 9,622 sq. ft. building for commercial kennel and pet day care use. The
amendment consists of adding a short walkway to the north-eastern emergency exit
door, 1045 Hinesburg Road.
2. The owner of record of the subject property is 4 On The Floor, LLC.
3. The subject property is located in the Industrial — Open Space Zoning District.
4. The application was received on November 15, 2016.
5. The plan set submitted consists of a four (4) page set of plans, page two (2) is
entitled "Happy Tails 1045 Hinesburg Road South Burlington Site Plan", prepared by
O'Leary — Burke Civil Associates, PLC., dated 1/26/15, and last revised on 11/16/16.
DIMENSIONAL REQUIREMENTS
6. Overall coverage will increase to 48.6% (maximum allowed is 50%). All other
coverages will remain the same.
SITE PLAN REVIEW STANDARDS
7. None of the site plan review standards will be affected by this application.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-16-77 of O'Leary -Burke Civil Associates, subject to the following
conditions:

1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
4. The applicant shall obtain a Certificate of Occupancy from the Administrative
Officer prior to occupancy of the building.
5. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.

by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
