DECISION AND FINDING OF FACT
On the 12th day of February, 1996 the South Burlington Zoning
Board of Adjustment heard testimony regarding a conditional use
application of Atlantic Orient Corporation, Peter Hughes agent at
Dyna Power Corporation, 1020 Hinesburg Road.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for
this application, the Zoning Board finds, concludes, and decides
as follows:
Findings of Fact
1) The area in question is zoned I.A. District.
2) Section 25.113 Height of structures allows for a maximum
height of 40 feet, any structure greater than 40 feet
requires approval from the Board of Adjustment.
3) The proposed structure is a meteorological tower at a height
of eight -two (82) feet.
4) Approval by the Board of Adjustment for a wind turbine
generator was granted on June 13, 1994. Structure is at a
height of 105 feet.
Conclusion
1) The proposed meteorological tower monitors wind speed and is
used in a project conducted by the U.S. Department of
Energy.
2) The study is conducted for a 24 month period commencing in
February 1996.
3) The tower will be removed upon completion of the study
(February 1998).
4) The erection of the tower should not affect the general
character of the neighborhood.
5) The location of the tower is outside of the view protection
area.
Based upon the findings and conclusion set -forth above, the
Zoning Board of Adjustment hereby grants the applicants request
to erect a meteorological tower at a height of eighty two (82)
feet at Dyna Power located at 1020 Hinesburg Road.
