SITE PLAN APPLICATION #SP-13-50
FINDINGS OF FACT AND DECISION
Gardner & sons Development Corp., hereafter referred to as the applicant, is seeking
site plan approval to amend a previously approved residential development consisting of
eight (8) two-family dwelling units. The amendment consists of revising the landscaping
plan, Blackberry Lane.
The applicant is proposing new landscaping to replace the originally approved
landscaping plan. There are no changes proposed to the building footprints or to the site
plan other than landscaping.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking site plan approval to amend a previously approved residential
development consisting of eight (8) two-family dwelling units. The amendment consists
of revising the landscaping plan, Blackberry Lane.
2. The application was received on September 17, 2013.
3. The owner of record of the subject property is Gardner & Sons Development Corp.
4. The subject property is located in the R4 Zoning District.
5. The plan submitted is entitled "Orchards 16 A Planned Unit Development South
Burlington, Vermont Landscape Plan", prepared by Lamoureux & Dickinson Consulting
Engineers, Inc., dated October, 2006; and last revised on 8/30/13.
SITE PLAN CRITERIA
Landscaping
The minimum landscaping requirement for this project when it was originally approved
in 2007 was $39,500. The revised landscaping plan has a value of $39,950 as indicated
in a statement dated 9/15/13 from Earthscapes, Inc.
The City Arborist has reviewed the revised plan and finds it acceptable.

DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site
plan application #SP-13-50 of Gardner & Sons Development Corp. to amend a
previously approved residential development consisting of eight (8) two-family dwelling
units. The amendment consists of revising the landscaping plan, Blackberry Lane,
subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plans submitted by the applicant
and on file in the South Burlington Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
4. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.

decision by filing a Notice of Appeal with the secretary of the Development
Review Board. This Notice of Appeal must be accompanied with a $233 filing fee
and be filed within 15 days of the date of this decision.
