Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on May 24, 1999 by application of John Larkin,
Inc., seeking a variance from Section 25.00 Dimensional Requirements of the South Burlington Zoning Regulations. Request
is for permission to erect a 14' x 40' canopy covered walkway between two (2) elderly housing complexes to within zero (0)
feet of the rear property line located at 90 Allen Road and 16 Harbor View Road.
1) These two (2) properties located at 90 Allen Road and 16 Harbor View Road are located in the C2 District.
2) The covered walkway is necessary to provide a safe walking area for residents and staff walking between the facilities.
Meals and programs arc provided at the Allen Road facility which requires the residents to walk to this facility. The covered
walkway is needed during bad weather and especially during the winter to provide a safe walking area.
3) The proposed canopy would reduce traffic on the roads since residents could walk and not have to drive to and from each
facility.
4) The proposed canopy would not alter the character of the area.
5) The proposed canopy would be the minimum the applicant would need to make a covered connection between the two (2)
buildings.
ORDER
The variance to allow a 14' x 40' canopy covered walkway between two (2) elderly housing complexes to within zero (0)
feet of the rear property line at 90 Allen Road and 16 Harbor View Road is hereby GRANTED
