FINDINGS OF FACT AND DECISION
Allen Road Land Company, hereafter referred to as the applicant, is seeking after -the -fact site &
building elevation modifications, John Fay Road.

The Development Review Board held a public hearing on AprilZ, 2013. Paul O'Leary represented
the applicant.
Based on the plans and materials contained in the document file for this application, the
Development Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking final after the fact final plat plan approval for site and building
elevation modifications. Specifically, the applicant is seeking to:
2. The owner of record of the subject property is Allen Road Land Company, Inc.
3. The application was received on February 26, 2013.
4. The subject property is located in the Residential 7 Zoning District
5. The plan submitted is entitled "Allen Road Land Co., Inc 725 Hinesburg Road South
Burlington, VT", prepared by O'Leary -Burke Civil Associates, PLC, and dated February 22,
2013.
6. The previous DRB action governing this project are found in the following document:

of Fact and Decision
The Board reviewed the as -built plans for #SD-13-09 and compared them with the plan and
findings related to #SD-11-26 and have the following comments:
• The dumpster and the mailbox are in different locations from what was approved. The
Board has no concerns with this change.
The findings for #SD-11-26 "stated that they wished to have the windows removed from the
basement. The plans were revised to replace the basement window with a proposed mechanical
vent." However, staff noted that the as -built plans filed with #SD-13-09 show that:

• For the 725 Hinesburg Road building (117 John Fay Road), a small round vent has been
installed instead of the louvered vent.
• For the 87 & 107 John Fay Drive buildings, basement windows have been installed on
the west and south end of the buildings.
The applicant has relocated light fixtures and the plan shows the updated locations.
Motion by Tim Barritt, seconded by Bill Miller, to approve Final Plat Application #SD-13-09 of
Allen Road Land Company, subject to the following conditions:
1. All previous approvals and stipulations shall remain in full effect except as amended herein.
2. This project shall be completed as shown on the plat submitted by the applicant and on file
in the South Burlington Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit for the building within six (6) months of this
approval.
4. The applicant shall obtain a certificate of occupancy prior to occupancy of the buildings.
5. Any changes to the final plat plan shall require approval of the South Burlington
Development Review Board.
6. The final plat plan (sheet 1) shall be recorded in the land records within 180 days or this
approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to
recording.
