HomeMy WebLinkAboutSP-01-67 - Decision - 0090 Allen RoadI #SP-01-67 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, #SP-01-67 of John Larkin, Inc. to amend a previously approved site plan for an 81-unit congregate housing facility. The amendment consists of approval of minor as -built revisions to the exterior elevations of the building to: add a shed roof over a doorway on the west elevation; add two skylights in the roof of the building, visible from the west elevation; add four remote condenser units on the east elevation of the building; add one through - wall air conditioning unit on each gabled section of the fourth floor of the building, with two on the east elevation and two on the west elevation; and change five approved doors to windows, with three on the east elevation and two on the west elevation. On the 24' day of September, 2001, the Director of Planning and Zoning approved the site plan application of John Larkin, Inc. under Section 26.10(b) of the South Burlington Zoning Regulations, based on the following findings: 1. This project consists of a site plan application to amend a previously approved site plan for an 81 unit congregate living facility. The application consists of a request for approval of as -built changes: 1) adding a shed roof over a doorway on the west elevation; 2) adding two skylights in the roof of the building, visible from the west elevation; 3) adding four remote condenser units on the east elevation of the building; 4) adding one through -wall air conditioning unit on each gabled section of the fourth floor of the building, with two on the east elevation and two on the west elevation; and 5) changing five approved sliding doors on the ground floor of the building to windows, with three on the east elevation and two on the west elevation. 2. The owner of record of this property is John Larkin, Inc. 3. This property is within the Commercial Two and Bartlett Brook Watershed Protection Overlay Districts. It is bounded on the north by two (2) congregate housing facilities, on the east by a group home, on the west by a commercial building, and on the south by Allen Road. 4. Coverage/Setbacks: The lot coverage will be increased by 24 square feet (from 27,547 to 27,571 SF) with the addition of the roughly 8 foot by 3 foot shed roof over the doorway on the ground floor of the west side of the building. Total coverage remains at 24.8%, below the 30% maximum for the district. Front yard coverage remains at 16.5%, below the 30% maximum for the district. Setbacks are met. 5. Landscaping. No changes to landscaping are proposed. 6. Lighting. No changes are proposed. 7. Parking. No changes are proposed. 8. Traffic. No changes affecting traffic generation are proposed. 9. Sewer. No changes affecting sewer allocation are proposed. DECISION AND CONDITIONS Based on the Findings of Fact above, the Director of Planning and Zoning approves site plan application #SP-01-67 of John Larkin, Inc. to amend a previously approved site plan for an 81-unit congregate housing facility. The amendment consists of approval of as -built changes: 1) adding a shed roof over a doorway on the west elevation; 2) adding two skylights in the roof of the building, visible from the west elevation; 3) adding four remote condenser units on the east elevation of the building; 4) adding one through -wall air conditioning unit on each gabled section of the fourth floor of the building, with two on the east elevation and two on the west elevation; and 5) changing five approved sliding doors on the ground floor of the building to windows, with three on the east elevation and two on the west elevation, 90 Allen Road. These changes are depicted on a two -page set of plans, page one (1) entitled "West Elevations, Allenwood Phase III, S. Burlington, Vermont," prepared by Rabideau Architects and dated 8/24/2001, with the following stipulations: 1. All previous approvals and stipulations not superseded by this approval shall remain in effect. 2. This Decision grants explicit approval to the exterior building modifications described above and as specifically shown on the above - referenced plans. Deviations from the above -referenced plans and this Decision shall be deemed non -complying modifications and shall require the prior approval of the South Burlington Development Review Board. 3. Modifications to the approved site plan, as amended through the date this Decision is effective, shall require approval of the South Burlington Development Review Board and shall not be eligible for administrative review, notwithstanding the provisions of Section 26.10(a) and (b) of the South Burlington Zoning Regulations. 4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the building. a Yffector of Planning and Zoning Date Please Note: You have the right to appeal this decision to the Vermont Environmental Court, pursuant to 24 V.S.A. § 4471 and V.R.C.P. 76, in writing, within 30 days of the date this decision is issued. The fee is $150.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality).
