Updating landscaping at front of building and removing one dead tree alongside
the main road. Revised plan prepared by SD Deslaurier and Nedde Real Estate.
Also, installing bike rack on concrete pad at front of building.

General property maintenance:
Additional general property maintenance is billed at the above listed rate and is per request.
Billing:
S. D. Deslaurier Property Maintenance & Landscaping Inc. will provide these services as described and for the rates
set forth in this proposal. All services will be billed at the end of the month they were rendered. Invoices will be
generated and mailed out monthly. The client approves of the stated agreement and is obligated to remit payment
upon receipt of the invoice. A 1.5% service charge will be applied on all unpaid balances in excess of 30 days.
Unpaid balances over 90 days will be submitted to a collection agency and the stated client is responsible for paying
all collections fees associated with this debt. If fuel prices reach $4.75 per gallon and above, a fuel surcharge
percentage will be applied to each invoice reflecting the increase. This surcharge will be added until either fuel
prices go down or the contract is renegotiated. Severe wind and storm damage outside the scope of this contract,
such as but not limited to, downed trees and heavy limbs will be evaluated per situation and an estimate will be
provided before services are rendered for the clean-up.
Please note:
Safety equipment and lights will be used. All members and visitors of the property will always have the right of way
while services are being provided.
S. D. Deslaurier Property Maintenance & Landscaping Inc. is a registered business with the State of Vermont and is
fully insured through Turnbaugh Insurance & Financial Services Inc. A declaration of the insurance policy will be
provided within seven business days if needed. This contract can be terminated with 60 days notice by certified mail.

Ray,
It's not really clear what they are proposing. If they are planning to plant 5 Austrian pines in that location it seems the
spacing is much too tight. In any event, I would recommend a different species as Austrian Pines are very6 prone to a
number of disease problems. I'd also recommend something other than Mugho pine as they are very susceptible to a
number of insect problems.

thave reviewed your application to revise the landscaping plan and find that it is incomplete for the following reasons:
1. The application is not signed by either the applicant or the property owner.
2. Three (3) full sized plans were not submitted as required.
3. The plan does not appear to include an inventory and value of the plants to be removed including the caliper of
any trees to be removed.
4. The application does not include a budget of the cost to purchase and install the new plants.
5. The application does not include the name of the landscaping professional who prepared the revised plan.
6. This plan alters the number of parking spaces and parking layout from the plan approved on 12/3/14, is this
really your intention?
7. The plan does not show the existing dumpster enclosure.
8. The plan does not show any snow storage areas.
9. The plan does not include the new bicycle parking requirements (see attached).
Please submit plans with to include the above information and once the application is deemed complete, it will be
reviewed for approval.

I haven't had a chance to review the application yet, but you should know that the process to get to the point where you
have a permit to do the work could be at least a month from now. I have to review the application and issue a decision,
then there is a 15 day appeal period before the approval takes effect. The next step is to submit a zoning permit
application to do the work which will not take effect for 15 days. You then do the work and apply for a CO to close out
the process. I'll try and find time tomorrow to review the application for completeness.

problems(pine sawfly, pine needle scale, and European shoot moth to name a few) that may require treatment to
maintain the plants in a healthy condition. Some conifers that don't have as many problems are cultivars of Juniper,
Chamaecyparis, and Microbiota.

General property maintenance:
Additional general property maintenance is billed at the above listed rate and is per request.
Billing:
S. D. Deslaurier Property Maintenance & Landscaping Inc. will provide these services as described and for the rates
set forth in this proposal. All services will be billed at the end of the month they were rendered. Invoices will be
generated and mailed out monthly. The client approves of the stated agreement and is obligated to remit payment
upon receipt of the invoice. A 1.5% service charge will be applied on all unpaid balances in excess of 30 days.
Unpaid balances over 90 days will be submitted to a collection agency and the stated client is responsible for paying
all collections fees associated with this debt. If fuel prices reach $4.75 per gallon and above, a fuel surcharge
percentage will be applied to each invoice reflecting the increase. This surcharge will be added until either fuel
prices go down or the contract is renegotiated. Severe wind and storm damage outside the scope of this contract,
such as but not limited to, downed trees and heavy limbs will be evaluated per situation and an estimate will be
provided before services are rendered for the clean-up.
Please note:
Safety equipment and lights will be used. All members and visitors of the property will always have the right of way
while services are being provided.
S. D. Deslaurier Property Maintenance & Landscaping Inc. is a registered business with the State of Vermont and is
fully insured through Turnbaugh Insurance & Financial Services Inc. A declaration of the insurance policy will be
provided within seven business days if needed. This contract can be terminated with 60 days notice by certified mail.

Numbers are in. I was a bit off. Full installation of concrete matched to the walkway with a single U - Bike rack, installed

Enclosed please find a cut sheet showing an I Series Projection Cutoff light that we
would like to install on both sides of the frontoor entrance to the Immediate Care
Health Center. This building is located at 620 Hinesburg Rd. We previously had a large
pole light there but it was hit and knocked down twice within the past six months, so we
spoke to our electrician who thought this would be a better alternative. These lights
would shine out over the parking lot.

sheet for information. We, arch requesting this change beeaLlSe lWke this year the pole
light in the center of the parking lot has been knocked down. The replia0ernent poles Lite,
very expensive (see attached), in addition to tho pole: somwno hit the concrete base and
knocked it over and is now req uestimg, payment for damage to their car.
For these reasons we feel it is safer to replace it with the wall hung projection downlight.

This project, consisting of combining the lots approved in Permits EC-4-0012 and EC-4-0013 on
which is situated the structure approved in Water Supply and Wastewater Disposal Permit WW-4-
0669 with an unimproved and unpermitted lot to create one 1.44 acre lot located off Kennedy Drive
and Hinesburg Road in the city of South Burlington, Vermont is hereby approved under the
requirements of the regulations named above, subject to the following conditions.
GENERAL
1. The project shall be completed as shown on the plans "As Built Site Plan" dated August
1988 prepared by Fitzpatrick -Llewellyn, Inc. and which have been stamped "approved" by
the Wastewater Management Division. The project shall not deviate from the approved plans
without prior written approval from the Wastewater Management Division.
2. Each prospective purchaser of the lot shall be shown a copy of the approved plot plan and this
Subdivision Permit prior to conveyance of the lot.
3. The conditions of this permit shall run with the land and will be binding upon and enforceable
against the permittee and all assigns and successors in interest. The permittee shall be
responsible for the recording of this permit and the "Notice of Permit Recording" in the city
of South Burlington Land Records within 30 days of issuance of this permit and prior to the
conveyance of any lot subject to the jurisdiction of this permit.
4. All conditions set forth in Subdivision Permits 4EC-4-0012 and EC-4-0013, Public Buildings
Permit PB-4-1458 and Water Supply & Wastewater Disposal Permit #WW-4-0669 shall
remain in effect except as modified or amended herein.

approval by the Agency, and such approval will not be granted unless the proposal conforms

Mrs. Lafleur noted that the Zoning Board had approved the conditional
use for offices in the R-7 district and also granted a variance for
front lot coverage of only 52%.
Mr. Llewellyn explained the building footprint will be on top of
.the foundation of the present Reilly Tire building, adding about
15 feet more. They will use existing services to the building,
and the overall layout will be similar to what is there today.
They will add parking to the rear and remove some from the front.
Drainage will be similar to what is there today. The entrance
will be moved about 25 feet north, increasing the turning radius
to allow easier access. They will try to leave many of the big
trees up front. The Fire Chief asked that the roadway be in-
creased to 30 ft. and this has been done. The sidewalk will be
continuous across the driveway as requested by the City Engineer.
Regarding landscaping, Mr. Jacob suggested doing something with
the bank, and Mr. Llewellyn said they will do that. Some land-
scaping will be put up front where some good sized trees will be
removed. They are requesting $6,000 credit for existing trees.
Mrs. Lafleur said she had not gotten an estimate on the value of
those trees. Mrs. Hurd asked if there will be enough screening.
Mrs. Maher suggested having them mart the trees to be taken down
and then have the Planner approve.

The location of the dumpster was discussed. Mr. Llewellyn said
it would be screened by a fence which will have the building sign
on it. Mrs. Lafleur said they are entitled to one free-standing
sign and one sign on the building.
Dr. Allen said the entrance to the immediate health care facility
will be on Hinesburg Rd. Other offices in the facility will in-
clude medical, dental and other professionals. There will be a
co-op condo association. About 60% of the uses will be health
related.
Mr. BElter asked what the buildng height will be. The applicant
said it would be 32 feet except at one corner where the grade
drops away. They agreed to raise the grade so the building does
not exceed the 35 foot height maximum, including rooftop aparatus.
There will be no basement.
Ms. Pugh asked if the entrance will line up with the Mobil station.
Mr. Llewellyn said it wouldn't but it would be closer than it is
now. Mrs. Lafleur said she thinks it is an improvement to have
the entrance further from the intersection than it is now.
The plan requires 92 parking spaces. 73 are shown, and the ap-
plicant requested a 21% waiver. Dr. Allen said the immediate
care facility's busy hours are opposite to those of the other uses.
Mrs. Peacock noted that if immediate care ever left, that situation
might not exist. Mr. Jacob said another tenant would know there
was not enough parking for their buisness and wouldn't want to
move there. Mrs. Peacock felt that if the doctors left, there are
very few uses that would generate more need for parking. Mrs.
Lafleur said it was very important that personal services such as
tanning salons not be at this location. Dr. Allen said they have
never had a problem at the present location with parking. Mr.
Llewellyn said the only other alternatives for parking are the
ravine and the treed area, and they didn't want to use wither one.
Mr. Belter didn't feel they would propose less than they needed
ass it would hurt their business. He felt the site was ideal for
this use and was much better than what is there now. Other
members agreed they could live with the reduced parking.
Mr. Llewellyn said they would agree to grass the slope and put
in plantings. Mr. Krassner noted that the Natural Resources Com-
mittee is very disturbed by the number of cases where more trees
are removed than plans indicated. He cited the Palmer property and
Timberlane as examples. He said they are working on a way to get
proper bonds to prevent this from happening. Mrs. Lafleur said
the city is going after people who do remove trees excessively.
Mr. Krassner said the record of development in South Burlington
is such that he wouldn't want to see any landscaping waived. A
25" diameter tree can't be replaced.
Mr. Dickinson presented the traffic study. He recalled that a
few years ago a major traffic study was done at Hinesburg Rd/
Kennedy Drive which included Butler Farms, the quarry, Lane Press,

etc. For this project, they did an updated study and included
this project and further development at Timberlane. The questions
they considered were: What will be the long-range traffic con-
ditions? and What will be conditions when this is built but before
all improvements to Kennedy Drive are in place?
In the long range, after all planned improvements, including right
turn lanes east and westbound and a third lane northbound and a
new signal configuration, there is enough capacity at the inter-
section for these 2 projects, and the intersection would remain
in the "B" or tfC" range.
The major short term consideration is that the controller has only
one timing plan which is a "compromisett plan. It works well in
the morning except for northbound traffic which is level CIE".
Itis much better in the evening with level 'IC" at all approaches.
Mr. Dickerson said he had talked with Craig Leiner who suggested
getting a second hand controller and using it for the morning
cycle. He felt this would bring it to level "C". Mr. Dickerson
did not feel this project would affect morning conditions.
Mrs. Maher asked about traffic exiting from this project. Mr.
Dickerson said the left turning cars could make the turn out at
the end of the phase. They would still have to cross traffic.
The study estimates 70 cars per peak pm hour and 33 per peak am
hour. Mrs. Lafleur noted that 24 cars per peak hour are allowed.
She said if the estimate exceeds the overlay zone, a level of
service study can be required which the applicant has done. With
improvements in 1992, it will be level "C" and with a new con-
troller now, it can be level "C". The project would thus not
make conditions worse than at present. Mr. Leiner agrees with this
analysis and added itis important to collect the impact fee.
Mrs. Maher said she is worried about pm exiting traffic as this
is a horrendous corner. Mr. Dickerson estimated that 25 cars
exiting at the pm peak would go south and 22 north. Ms. Peacock
said she had no problem with traffic if the controller is put in.

Development
Peter McCarthy explained that the original plan was to use the
existing foundation. They have found, however, that they can't
do that, so they are re -designing the building. The'footprint
will be larger, but the square footage will be the sme. Parking
has been shifted toward Hinesburg Rd, and the building shifts 2
ft. to the east. Mr. Varsames said the shift means they will be
able to save a larger number of trees. Building coverage will be
10.5% with 53.2% total coverage. Front yard coverage decreases,
and the total green space increases about 200 sq. ft. There will
be 73 parking spaces. Mrs. Lafleur noted she has not yet aproved
a revised landscaping plan and there is a question of a large
pine tree that was to be saved.

Center Condominium Association hereby requests an additional sewer allocation
of 1,590 gallons per day for its building. When combined with its current alloca-
tion of 2,260 gallons per day, this additional allocation would raise its total
allocation to 3,850 gallons per day.
The additional allocation is based upon the following breakdown of current
medical staff, patients and office workers using the building, as determined by a
recent survey, together with the design flow standards of the Vermont Department
of Environmental Conservation.

Dear Mr.. Rushford:
I am writing in response to our meeting 6/8/93 regarding the
above referenced permit. In reviewing the file, it appears that
there was a typographic error in condition #3. Based on appendix
7A, the total gallons per day for the 35 medical employees, 100
patients and 56 office would be 3065. Condition 46 approved the
project for a maximum of 2260 gpd. Supporting documentation in
the file showed that this figure was based on 12 medical workers,
100 patients and 56 general office. It is my understanding that
the actual medical employees, patients and office employees may
be different than previously approved. I recommend that an
application be filed to amend the permit, and that your clients
may want to include additional allocation for future growth. I
have enclosed a water supply and wastewater disposal permit
application form. In addition to the application form we will
need an engineering breakdown of the design flows as listed in
Appendix 7-A, municipal approval letter for water and sewer for
any additional flows over 2260 gpd, and the associated fees.

According to the December 1, 1987 Planning Commission approval, the project was
allocated 2,260 gpd for sewer.
Based upon the bills received from the City of South Burlington Water Department,
the average for the 12 month period 3/16/92 - 3/15/93 was 2,141 gpd. The bills also show
that the average for the 18 month period 12/15/91 - 3/15/93 was 1,967 gpd. Therefore, the
project is in compliance with its sewer allocation.
These figures are based upon the following: take actual consumption (in 100 cubic
feet), multiply by 100, then multiply by 7.48 to provide total gallons per 90 day billing
period, then divide total gallons by 90 day billing period. The following is a breakdown of
each billing period:
1. 12/15/91 bill -- 190 x 100 = 19,000 x 7.48 = 142,120 divided by 90 days = 1,579
gallons per day.
2. 3/15/92 bill -- 200 x 100 = 20,000 x 7.48 = 149,600 divided by 90 days = 1,662
gallons per day.
3. 6/15/92 bill -- 230 x 100 = 23,000 x 7.48 = 172,040 divided by 90 days = 1,912
gallons per day.
4. 9/15/92 bill -- 250 x 100 = 250,00 x 7.48 = 187,000 divided by 90 days = 2078
gallons per day.
5. 12/15/92 -- 230 x 100 = 23,000 x 7.48 = 172,040 divided by 90 days = 1,912

Mrs .Maher asked about traffic exiting from this project. Mr.
Dickerson said the left turning cars could make the turn out at

The study estimates;70 cars per. ppeak pm hour and 33 per peak am
hour. Mrs. Lafleur noted that 24 cars per peak hour are allowed.
She said if -the estimate exceeds the overlay zone,:a level of
service study'can be required which,the.applicant has done. With
improvements in 1992,*it will be level "C" and with a new con-
troller now, it can be level "C". The project would --thus not
make conditions worse than at piesent. Mr.'Leiner agrees with this
analysis and added Jtis important to collect the impact fee.
Mrs. Maher said she. is worried about pm exiting.' traffic -as this
is a horrendous corner. Mr. Dickerson estimated that 25 cars
exiting at the pm peak would go south and 22 north. Ms..Peacock

This project, consisting of construction of a three story 20,152
sq. ft. medical/general office building with municipal water and
sewer services located at Hinesburg Road and Kennedy Drive in the
City of South Burlington, Vermont is hereby approved under the
requirements of the regulations named above, subject to the
following conditions.
GENERAL
(1) This Permit does not relieve you, as applicant, from
obtaining all approvals and permits as may be required from
the Act 250 District Environmental Commission, the
Department of Labor and Industry (phone 828-2106), the
Vermont Department of Health (phone 863-7220), and local
officials PRIOR to construction.
(2) The project must be completed as shown on the plans Reilly
Tire Property, Sheet 1 "Site Plan" dated Jan. 19889 last
revised 4/26/88; Sheet 2 & 3 "Typical Details Site
Facilities" dated Jan. 1988; prepared by Lance Llewellyn,
P.E. and which have been stamped APPROVED by the Division of
Protection. No changes shall be made to the approved plan
without prior written approval from the Agency of Natural
Resources.
(3) This permit specifically approves the use of this new
building for 35 medical employees, a maximum of 100 patients
per day and a maximum of 56 office employees. Increased
flows beyond those specified requires written approval by
the Division.
WATER SUPPLY
(4) The project is approved for connection to a municipal
type water system approved by the.Department of Health
provided that all construction is in accordance with the
approved plans and the Environmental Protection Rules,
Effective September 10, 1982.
SEWAGE: DISPOSAL
(5) The project is approved for connection to a municipal
sewage collection system. The work shall be done in
accordance with the Environmental Protection Rules,
Effective September 10, 1982.
(6) The project is approved for connection to the Airport Parkway
wastewater treatment facility for a maximum of 2260
gallons of sewage per day.
PLUMBING
(7) This permit authorizes construction of the exterior sewer
and water services conditioned above and for the
construction of each building provided the individual water
and sewer services to each building remains as shown on the
stamped approved plans. Alterations to the exterior sewer
or water services shall be approved by the Division of
Protection prior to installation.

(8) The applicant is hereby notified that all interior waste and
water distribution plans must now be reviewed and approved
by the Department of Labor and Industry prior to
construction. This shall hold true for new buildings

about the Spear Street Overlook issue. Once the view is gone, it's gone.
Mr. Hoehl knew of the limitations when he purchased his property in 1985 -
now he's crying because he can't have things his way. Hopefully, the
City Council will represent' the people of South Burlington and all of people
who find the view inspirational and unforgettable. Must we always sacrifice
the needs of the "little` people for the greediness of the " priviledged few"?

4) SMITH, LOT #8, 81 ETHAN ALLEN DRIVE
Mr. Smith proposes to construct a 7200 square foot building for
his contractors business on lot #8 of Rene Berard's lots. The
lot is 41,400 square feet and is zoned Industrial -Commercial.
Access: Access is shown from a 20 foot wide curb cut.
Circulation: Circulation is available along the west and south
of the building. The plans show a 24 foot wide aisle along the
western side of the building. Chief Goddette requires a 30 foot
aisle along the building. To do this and keep the setback and
the 5 foot buffer along the property line for snow storage, the
building would have to be decreased in width. However, I am
expecting new plans prior to the meeting that show parking spaces
parallel to the property line rather than perpendicular. One
parking space will be lost to do this. Evidently Chief Goddette
is willing to accept this.
Parking: The plans show 27 parking spaces. The parking require-
ment is based on 2,400 square feet of office space with 1 space
per 250 square feet = 10 spaces, plus five vehicles used for
business also 4 utility trailers. Ten non -office employees
require 2 spaces/3 persons or 7 spaces. The total required is 26
spaces. The revised plan will show only 26 spaces.
Landscaping: The $180,000 building requires $5400 in new
landscaping. The plan exceeds this amount. The maximum lot
coverage is 70%. The plans show 65% coverage.

5) H.A.M. _ B.C.D., 620 HINESBURG ROAD
The applicant proposes to construct a 20,152 square foot building
on the Reilly Tire Property. This is slightly larger than the
existing footprint. It will be 3 stories high. The property is
zoned R-7 and this is a conditional use. It will receive Zoning
Board of Adjustment review on November 30, 1987 for the
conditional use and a waiver to front yard lot coverage.
Access: Access is shown from a 35 foot wide driveway in
its present location although it is reduced in width. See Bill
Szymanski's comments regarding the access and sidewalk.
Circulation: Circulation will be available on 3 sides of the
building with a 30 foot aisle along one side and 24 foot aisles
along the other two. See Goddette's comments regarding this
nicle.

Parking: The 12,091 square feet of medical offices require
60 parking spaces. The 8061 square feet of general office space
require 32 parking spaces for a total of 92 spaces. The plans
show 73 spaces which is a 21% waiver for the 19 spaces.
Landscaping: The $1.05 million building requires $18,000 in
new landscaping. A number of trees will be removed to construct
this addition but some will remain for which credit is requested.
Six oak ranging in size from 2 to 16 inches caliper, a birch and
a maple will be removed for the new parking lot along Hinesburg
Road. Three maple, a pine and a large oak will be lost due to
the building construction. The plans show approximately $12,500
in new landscaping.
The total lot coverage will be 53.1% or slightly more with the
increased aisle. The ordinance allows 60% in this district. The
building coverage is 10%. The Zoning Board will also be asked to
waive front yard lot coverage which is approximately 52%. The
front yard along Route 116 will be improved with a wider grassed
and treed buffer strip.
Traffic: The 1.45 acre lot allows 24 trip ends. The proposed
facility will generate 107_trip ends during the A.M. peak and 79
trip ends during the P.M. peak according to the applicant. I
expect to receive a full traffic study prior to the meeting to
study the impact of this development on the level of service.
The applicant requests administrative review and approval of the
study rather than returning to the Commission at a later date.
Craig Leiner will not receive this study until Tuesday.
The applicant should contribute $6821. to the Hinesburg Road/Kennedy
Drive intersection improvement fund based on the 107 trip ends
generated.

Dear Ms. Lafleur,
As requested, the following presents our evaluation of the traffic
impacts of the conversion of the Reilly Tire property to an office
land -use. Because of the close proximity of the above -referenced
intersection, traffic conditions at this Project's access onto
Hinesburg Road will be primarily governed by those at the
intersection. Therefore, this evaluation updates the traffic impact
evaluation for the above -referenced intersection, dated October 21,
1986.
One other project, not anticipated in the original evaluation and
recently approved by the City, is also included in this evaluation.
That project is an expansion of the Timber Lane Medical Center. A
copy of the traffic projections for that project is included as
Appendix A.
This Project is to construct 20,152 square feet of office space at
the location of the existing Reilly Tire building. It is anticipated
that 60% of the leasable floor area will be utilized as a medical
office, and the remainder as general offices.
An estimate of the vehicular trip generation of the proposed uses was
developed from data compiled by the Institute of Transportation
Engineers. Table 1 outlines the projected additional vehicular trip
generation created by this Project.

The directional distribution of the additional traffic generated by
both of the above -referenced projects was estimated from regional
trip origin -destination data. The traffic which passed through the
Kennedy Drive/Hinesburg Road intersection was then superimposed onto
previously projected 1992 A. M. and P. M. design hour volumes.
Future level of service conditions at this intersection were analyzed
using the procedures outlined in the 19e5 Highway Capacity Manual.
Future improvements at this intersection were the same as analyzed by
the initial evaluation. Detailed results are enclosed as Appendices
B and C.
The results of the intersection capacity analyses indicate that these
two projects will not significantly impact upon previously projected
conditions. The analyses indicate that the small incremental impact
i re -timed mode to.a_fuii actuated mode. Overall, both could be mitigated, in art, b converting the signal operation from

h. M. peak hour traffic conditions will remain at Level of Service
B/C.
In conclusion, previously recommended improvements to the Kennedy
Drive/Hinesburg Road intersection will provide sufficient reserve
capacity to accomodate the additional traffic generated by this
Project. Those improvements remain unchanged except for the change
of the signal operation. Such a change will reduce delays not only
during peak periods, but during off-peak periods as well.
One note concerning the access from this property onto Hinesburg
Road. This Project includes relocating this access approximately 25

feet north of the existing access, thereby increasing the distance
between it and the nearby intersection. In addition, it has been
redesigned to better channelize turning movements and to minimize
potential vehicular conflicts immediately adjacent to Hinesburg Road.
Overall, it is our opinion that the above improvements will
effectively mitigate any potential adverse traffic impacts created by
the additional traffic generation of this Project.

proposed Timber Lane Medit:al Center expansion. The specific expansion plan chat is evaluated
here is a 23,150 square foot building with 83 new parking spaces, as shown on a site plan dated
April 2, 1987. As I had indicated to you, the available national datal are not reliable for estimating
trip generation for this type of use because of small sample sizes and unrepresentative scale of
developments represented. The counts that you provided for the existing Timber Lane Medical
Center operations are, however, directly useful and are summarized below.

put this into the context of current traffic levels, Kennedy Dr. now carries approximately 1400
vehicles/hour2. The Timber Lane Medical Center would thus represent an increase of 8% in traffic
along this section of Kennedy Dr.

RE: Case No. PB-4-1458; Construction of three story medical
office building, Hinesburg Road, South Burlington.
Our office has completed an initial review of the above
referenced project and has determined that the additional
information listed below will be needed before approval can be
granted.
(1) Please submit a detailed engineer's breakdown of wastewater
flows as outlined in Appendix 7-A of the Environmental
Protection Rules. This estimate would be based on the
increase over what may have previously been flows for any
existing building (if it was in use within one year) and for
peak daily flows instead of average daily flows. Doctor and
dentist offices are figured separtely from office space.
(2) Submit a letter from the municipality approving the increase
in water and wastewater flows. The Planning Commission
minutes are not sufficient.
(3) Please submit one copy of a floor plan showing the interior
water and sanitary piping matching the engineer's site plan.
(4) The engineer's site plan should identify the type of water
and sewer pipe to be used.
Upon receipt of the above items, we shall continue our review.

Gentlemen;
In response to your request we have inspected the proposed site of
the new building of the Reilly Tire Company on the northeast corner
of Kennedy Drive and Hinesburg Road.
In general, we believe the architect and contractor have done a good
job of locating the building and parking facilities on this site.
We do have three comments to make concerning the site location, however.
1. We believe that there should not be an entrance onto the site from
Kennedy Drive, although there is an old curb cut in this area that
the architect has shown on the site plans. A curb cut in this
area would destroy some of the esthetic features of this site and
we believe it is not needed in order to attract business onto the
site.
2. We would suggest that the curb cut on Hinesburg Road be moved
north in order to avoid congestion from traffic at the intersection
and to save some more of the existing trees in the area. We believe
this curb cut could be 40 ft. wide if the entrance from Kennedy
Drive is not used.
3. We would suggest that the five or six large (10 to 12-inch diameter)
hemlock trees on the slope north of the proposed parking lot be
saved if possible. It will necessitate the contractor being care-
ful not to put any fill within 6 to 8 ft. of the south side of the
trees and to put no fill on the other side of these trees. If too
much fill is placed around these trees they will probably die out
within a few years.

Dear .Bill:
Dick Vard has asked me to consider a legal question raised
by fames Pizzagalli in regard to the above entitled application..
It is my understanding that the Reilly Tire Co. has applied to
the Planning Commission for site plan approval. for a proposal on
the northeast corner of the intersection of Hinesburg Road and
Kennedy Drive. The question presented is whether the westerly -
most vehicle entrance on Kennedy arrive Must be approved by the
cormis.sion in considering the site plan.
It is my understanding that the access has been previously
considered by the City in regard to other proposals submitted
by the Pizzagalli Companies. The access at one time did receive
approval by the City, and also I understand, the requisite
approval of the Vermont Department of Highways and the United
:states Bureau of Public Roads. h curbcut was constructed
after the requisite approvals were obtained.
I have considered the possibility of the above circum-
stances constituting a vested interest requiring this entrance
to remain open. I have also considered what authority the
Planning Commission has in entertaining a site plan application.
I do not believe the Planning Commission could order the entrance
closed. on the other hand, I believe the Planning Commission has
sufficient discretion pursuant to 24 V.S.R. 54407 (5) to prevent
the applicant from using the entrance. The above cited statute
reads in part,
"in reviewing site plans, the Planning Commission may
impose appropriate conditions and safeguards with
respect only to the adequacy of traffic access, circula-
tion and parking, and landscaping and screening."

Our zoning regulations by amendinent contains sip-Alar language.
if in their judgment the Planning Comnission feels access should
be permitted fror,,i other entrance ways, T feel this is an appro-
priate condition they could impose. , Perhaps a professional
planner could advise the commission concerning the best plans
for traffic access.

the purchase of a parcel of property located at the corner of Kennedy
Drive and Hinesburg Road.
We further commit to open a letter of credit in favor of the City
of South Burlington in the amount of $3, 900 to enable Reilly Tire Corp.
to obtain a building permit for the proposed construction on the above
property.

Gentlemen:
We are writing to raise a legal issue concerning the Planning Com-
mission's power to order that the westerly most vehicle entrance on Kennedy
Drive serving a lot on the northeast corner of the intersection of Hinesburg
Road and Kennedy Drive be closed. This issue was raised in connection with
the application of Reilly Tire Corporation for site plan approval of a develop-
ment at that location.
The vehicle access in question has been in existence for a number of
years and you will no doubt recall that it was built on the basis of a valid
permit and after exhaustive review by the City. Furthermore, the construction
was approved by the Vermont Department of Highways and also, I believe, by
the United States Bureau of Public Roads.
It is our contention that the rights to this vehicle entrance, which has
been in lawful existence for a number of years, are now vested and that the
Planning Commission is without authority to order same closed.
It would be appreciated if this matter could be referred to the City
Attorney for a legal opinion.

Mr, Ewing felt the developer had given 40' of buffer and should not be
required to give more. Mr. Poger agreed, saying the Commission should not re -
engineer the building.
The motion failed with Messrs. Poger, Woolery and Ewing voting no and
Messrs. Mona and Draper voting yes.
Mr. Ewing then moved to amend stipulation #2 to read that "Building #2
shall be located at least 40' west of the property line, the way it is shown in
red on the plan of record." Mr. Mona seconded the motion and it passed with
Mr. Draper voting no.
It should be noted that this amendment only applies to the first part of
the stipulation and that the second part is left as printed above..
The motion passed unanimously.
Siri&�n review for expansion of Friendly Ice Cream's
Mr.'Richard Maher represented Friendly and said that they proposed to purchase
the lot at 21 McIntosh Avenue and extend their parking lot. The lot is now zoned
commercial. He said they had talked to Mr. Bolduc, the adjoining owner, and he
did not object. There will be a 15' buffer between the two properties and a 6'
fence. A row of white pines will be planted and the present curb cut for the
McIntosh property will be closed. Lighting will be cut-off lighting.
Mr. Woolery moved that the South Burlington Planning Commission approve the
site plan proposal of Friendly's Ice Cream Corporation, to expand its present
parking lot as depicted on a plan entitled "Preliminary Plot Plan..." drawn
by T B B. dated 5 22 79. subject to the following stipulations:
1. The 2 lighting fixtures to be relocated to the east property line shall__
be screened so that the adjoining residential yard is not illuminated.
2. The curb cut on the LaJeunesse lot shall be closed.
3. An adequate bond shall be posted to insure the fence extension, new
plantings, and closing of the curb cut shown on the plan.
4. The parking lot shall be restriped as shown on the plan.
Mr. Draper seconded the motion and all were in favor.
Site plan review for expansion of, Reilly Tire parking lot
Mr. Page said the representative had left, but he showed the Commission the
plan. He said there had been a communication problem here and that the work had
already been done, because Reilly Tire said they had been told to go ahead and
do it. The city has no written confirmation of this, but Reilly feels they did
the work in good faith.
Mr. Page said that eventually the building would be extended but there are
no plans for that now and it will just be used for storage of cars. Mr. Page
said that one of the banks should be stabilized.
Mr. Woolery moved that the South Burlington Planning Commission approve the
to the
lot expansion for Reilly Tire, as depicted on the plan of record, subject_
following sti.oulations:
1. Modification of the existing fill slopes and
driveway shall be performed to the satisfaction of the
transmitted to the Planning Commission in writing.

Sketch plan review, 1 lot subdivision of Victory property, south of 9 Victory Dr.
Mr. Page showed the Commission a sketch of the, area. Mr. Poger noted that
Mr. Victory's sketch showed one undersized lot (90' frontage). If he later
applies to the Zoning Board for a variance, it should be known that he has
created his own hardship on that lot.

As you ---know, this is at accompli. Although initially inquired
about the permits necessary for expansion of its parking lot, some
confusion diet nsue about the extent of the filling involved. Reilly
proceeded to fill in the belief that no permits or approvals were
necessary. Since we (at City Hall) have no record of having approved
or denied such a request, I suggest the review focus on: 1) limits to
future filling, 2) erosion control (esp. bank stabilization), and
3) storm drainage (since the enlarged parking area will eventually
be paved.
# Friendl 's Parkin Lot Expansion
Friendly's plans toA cquire an adjoining house and lot to permit
the expansion of its parking area. The required buffer zone, which
consists of a stockade fence and white pine plantings, is being
extended northward. Since two of the existing overhead liahtkoing
fixtures are being moved closer to the residential district, I suggest
screens be attached to prevent light from spilling over onto the
adjoining residential back yard. Parking and circulation remain
excellent under the revised plan.
