Mr. Crow said he would have a problem adding an access to this
area, but he didn't feel there was anything to keep the
Commission from looking at it again. Mr. O'Rourke agreed.
Mr. Burgess stressed that there is nothing to prevent the
Commission from changing what happened in 1977, but he did want
to know what the reasoning was back then.
Mr. Blair noted that this is one of the last unobstructed views
of Mount Mansfield.
8. Site plan application of HFB Realty Partnership to amend a
previously aproved plat for an 18,000 sq. ft. general office
building. The amendment consists of converting 950 sq. ft. of
general office use to medical office use, 550 Hinesburg Rd:
Mr. Vock said the owners have been approached to put a small
doctor's office in. They got conditional use approval to do
that. It would cover 5% of the building. It would also add one
trip end.
It was noted that when Hallam Co. occupied the building, there
was a major parking problem. The building is now 44% occupied,
and the parking lot is not full.
Mr. Burgess said there is no legal way to waive the standard that
requires improvement of a traffic situation in exchange for
additional trip ends. Mr. Vock noted the Commission isn't bound
to follow ITE standards.
Mr. Teeson felt there was merit to the application because of
actual counts. Ms. Barone noted that there could be more tenants
in the building and then they'd be parking on the grass again.
Members briefly discussed the issue of using other than ITE
standards. Mr. Weith said if they are not consistent, they can
get burned in Court.

2. Any new exterior lighting shall consist of�downcasting
shielded fixtures _so_as not to cast light �bevond the._rouerty

Planner prior to installation.
3. The Planning Commission approves an additional 240 d of
sewer_ allocation. The applicant shall pay. the per gallon fee_
prior __.to�permit �issuance.
4. The Planning Commission approves 69 parking spaces for this
development. This represents a waiver of-4�spaces or 5.50 of the
total required. It is the Commission's opinion that 69 spaces
will adequately serve the project since�a significant portion of
� _ square of the building d to will be devote the gross s ua _ _
stairway and �elevator space and therefore will not be devoted_ to
uses which typically generate parkin demand.
5. 5. This �property �islocated in Traffic Overlay Zone 5 which
permits this property to generate a maximum of 50 tri ends
during the peak hour. Based on I.T.E., it is estimated that a
building with 17,4050 sq. ft. of general —office use and 950 so
ft. of medical office use will generate 53.6 tri2 ends durin the
peak hour. This estimate is based on gross square footage. Based
on traffic counts submitted by the applicant for other similar
developments, it is the Commission's opinion that the building
will generate no more than 50 vte'`s�during the P.M. peak hour.
6. For purpose of calculating road impact fees under the South
Burlington Impact Fee Ordinance, the Planning_Commission
estimates that the change�in�use will generate zero additional
vehicle trip ends during the P.M._peak_hour.
7. The applicant shall obtain a zoning permit within six months_
ursuant to Section 2.7.302 of the zoning regulations or this
approval is null and void.
8. The applicant shall obtain a Certificate of Occupancy/Compli-
ance from the Administrative Officer prior to occupancy by the
medical office.
9. Any changes to the site lan shall require a roval by the
South Burlington City Planner.
Mr. O'Rourke seconded the motion which passed 5-1 with Mr.
Burgess opposing.
As there was no further business to come before the Commission,
the meeting was adjourned at 10:30 p.m.

Street office building, and 60 Farrell Street office building (parking only) for justification of

Wetlands: The wetlands shown on the plans are not identified ac-
wetlands on the City's "Wetlands Map" and are not regulated under
Article III of the zoning regulations. These wetlands would be
regulated under Section 26.151(g) of the zoning regulations (see
PRD discussion below).
PRD Criteria: The applicant has submitted a report addressing the
PRD criteria contained in Sections 6.606 and 26.151 of the zoning
regulations (see enclosed).
Sewer: The preliminary plat submittal should include the sewer
allocation request.
C.O. District: The C.O. District associated with the drainageways
on the property are shown on the plan. The only encroachment
proposed into the C.O. District is the access drive serving lots
#3-5. This encroachment is allowed under Section 3.204 of the
zoning regulations.
Impact fees: The applicant should be aware that the new houses on
lots #3-5 will be subject to school, road and recreation impact
fees.
Recreation Path: The Recreation Path Committee reviewed these
plans. They recommended that a 20 foot recreation path easement be
reserved along the property's frontage (see enclosed memo). This
is consistent with the Comprehensive Plan.
8) HFB REALTY PARTNERSHIP - MEDICAL OFFICE - SITE PLAN
This project consists of amending a plan previously approved on
4/13/93 (minutes enclosed) for a 18,000 square foot general office
building. The amendment consists of converting 950 square feet of
general office use to medical office use. The ZBA on 8/25/97 will
consider a request from the applicant for a conditional use permit
for the proposed use.
This property located at 550 Hinesburg Road lies within the R7
District. It is bounded on north, east and south by the common
land which is part of the Winding Brook residential development and
on the west by Hinesburg Road.

Access/circulation: Access is provided by a 30 foot curb cut on
Hinesburg Road. No changes proposed.
Circulation on the site is adequate.
Coverage/setbacks: Building coverage is 7.4% (maximum allowed is
25%). Overall coverage is 60% (maximum allowed is 60%). Front
yard coverage is 26.7% (maximum allowed is 30%).
Landscaping: There is no minimum landscaping requirement, based on
building costs, for this project. The site is well landscaped and
no additional landscaping recommended.
Sewer: The additional sewer allocation requested is 240 gpd. The
applicant will be required to pay the per gallon fee prior to
permit issuance.
Parking: A total of 73 spaces are required and 69 spaces including
three (3) handicapped spaces are being provided. This represents
a four (4) space shortfall. The Commission as part of the 4/13/93
approval granted a four (4) space waiver. The plan should be
revised to include a bike rack as required under Section 26.253(b)
of the zoning regulations.
Traffic: This property is located in Traffic Overlay Zone 5 which
allows this property to generate a maximum of 50 vehicle trip ends
(vte's) during the P.M. peak hour. ITE estimated that the 18,000
square foot office building would generate 52.5 vte's and the
Planning Commission as part of the 4/13/93 approval determined that
the building would generate no more than 50 vte's during the peak
hour due to the unique configuration of the building in that a
large portion of the building would be devoted to stairway and
elevator use. ITE estimates that the proposed change in use would
generate 1.1 additional vte's during the P.M. peak hour. The
Planning Commission may approve peak hour traffic volumes above the
normal standards if the Commission determines that other site
improvements will produce a net benefit for traffic flow in the
vicinity. No improvements are proposed which would produce a net
benefit for traffic flow.
Lighting: No changes proposed.
Dumpster: A screened dumpster area is provided.

wetlands on the City's "Wetlands Map" and are not regulated under
Article III of the zoning regulations. These wetlands would be
regulated under Section 26.151(g) of the zoning regulations (see
PRD discussion below).
PRD Criteria: The applicant has submitted a report addressing the
PRD criteria contained in Sections 6.606 and 26.151 of the zoning
regulations (see enclosed).
Sewer: The preliminary plat submittal should include the sewer
allocation request.
C.O. District: The C.O. District associated with the drainageways
on the property are shown on the plan. The only encroachment
proposed into the C.O. District is the access drive serving lots
#3-5. This encroachment is allowed under Section 3.204 of the
zoning regulations.
Impact fees: The applicant should be aware that the new houses on
lots #3-5 will be subject to school, road and recreation impact
fees.
Recreation Path: The Recreation Path Committee reviewed these
plans. They recommended that a 20 foot recreation path easement be
reserved along the property's frontage (see enclosed memo). This
is consistent with the Comprehensive Plan.
8) HFB REALTY PARTNERSHIP - MEDICAL OFFICE - SITE PLAN
This project consists of amending a plan previously approved on
4/13/93 (minutes enclosed) for a 18,000 square foot general office
building. The amendment consists of converting 950 square feet of
general office use to medical office use. The ZBA on 8/25/97 will
consider a request from the applicant for a conditional use permit
for the proposed use.
This property located at 550 Hinesburg Road lies within the R7
District. It is bounded on north, east and south by the common
land which is part of the Winding Brook residential development and
on the west by Hinesburg Road.

Access/circulation: Access is provided by a 30 foot curb cut on
Hinesburg Road. No changes proposed.
Circulation on the site is adequate.
Coverage/setbacks: Building coverage is 7.4% (maximum allowed is
25%). Overall coverage is 60% (maximum allowed is 60%). Front
yard coverage is 26.7% (maximum allowed is 30%).
Landscaping: There is no minimum landscaping requirement, based on
building costs, for this project. The site is well landscaped and
no additional landscaping recommended.
Sewer: The additional sewer allocation requested is 240 gpd. The
applicant will be required to pay the per gallon fee prior to
permit issuance.
Parking: A total of 73 spaces are required and 69 spaces including
three (3) handicapped spaces are being provided. This represents
a four (4) space shortfall. The Commission as part of the 4/13/93
approval granted a four (4) space waiver. The plan should bef�+�
revised to include a bike rack as required under Section 26.253(b)
of the zoning regulations.
Traffic: This property is located in Traffic Overlay Zone 5 which
allows this property to generate a maximum of 50 vehicle trip ends
(vte's) during the P.M. peak hour. ITE estimated that the 18,000
square foot office building would generate 52.5 vte's and the
Planning Commission as part of the 4/13/93 approval determined that
the building would generate no more than 50 vte's during the peak
hour due to the unique configuration of the building in that a
large portion of the building would be devoted to stairway and
elevator use. ITE estimates that the proposed change in use would
generate 1.1 additional vte's during the P.M. peak hour. The
Planning Commission may approve peak hour traffic volumes above the
normal standards if the Commission determines that other site
improvements will produce a net benefit for traffic flow in the
vicinity. No improvements are proposed which would produce a net
benefit for traffic flow.
Lighting: No changes proposed.
Dumpster: A screened dumpster area is provided.

Mr. Burgess stepped down due to a conflict of interest, and Mr.
Austin left due to illness.
Mr. Webster noted the site is now Ralph Goodrich's pipe yard.
They propose to use the existing curb cut. There will be an
L-shaped configuration for parking. The building will be 3
stories with a brick facade, 6,000 sq. ft. per floor. There will
be two handicapped accesses (in back and front of building).
They propose to build a sidewalk on the Hinesburg Rd. side of the
existing property line. There is a problem with slope easements,
so they would contribute to the city's fund and let the city
build it. Members want the sidewalk all the way through. Mr.
Weith suggested trying to get easements.
Mr. Webster said there are several hydrants on the site. They
will create landscaping features that would be compatible with
emergency vehicles.
72 parking spaces are required. Mr. Weith noted they will be off
by 4 spaces if they remove the 2 to comply with setbacks.
Members had no problem with this.
They are 50 over on traffic. Mr. Weith noted they can approve
more units only if there are improvements to compensate. That
is not the case here. Ms. Peacock preferred to reduce the size
of the building. Mr. Sheahan said he had no problem with the 50
but was affraidit would come back to haunt them in future appli-
cations. Mrs. Maher, and Messrs Teeson and Craig had no problem
with the 50.

Proposed streets: The City' Official Map shows a proposed street

with an extension of Mar Street which crosses the easterly portion
of the 2 Corporate Way arcel. These streets should be shown on
the preliminary plat. he Planning Commission will need to decide

public street is determined not to be necessary, staff suggests

were made without Planning Commission approval and requested that

This property located at 550 Hinesburg Road lies within the R7
District. It is bounded on the north, east and south by the common
land which is part of the Winding Brook residential development and
on the west by Hinesburg Road.

Coverage/setbacks: Building coverage is 7.4% (maximum allowed is

yard coverage is 26.7% (maximum allowed is 30%).
Setback requirements are met.
Parking: This project requires a total of 72 parking spaces and
the Planning Commission approved 68 spaces as part of the 4/13/93
approval. The parking modification requested is to eliminate one

business has grown allot in the last two years. We have no "relief" from our

asked our employees to car pool as much as possible plus we have moved about
20 people into another building. We don't want to park on the lawn area either,
but some days its the only thing to do.
Ultimately, Hallam Associates is moving out of this building and into another one that can
accommodate us. The target date for this move is November 1, 1996.

response to your letter of November 10, 1994 regarding
alleged zoning violations at 550 Hinesburg Road.
The following responses correspond with your letter, item
by item:

There are currently sixty seven (67) parking spaces on
site, which is one short of the required sixty eight (68).
We intend to add one space along the North side where
there are currently sixteen (16) spaces and 151' of
existing paved area. This will be done in accordance with
the regulations regarding front yard coverage and set
backs from proposed right of ways. Three handicapped
spaces in lieu of four were provided because the code
allows this.

Prior to permit we met with, then Fire Chief Gaudette, to
discuss any concerns the Fire Department may have had
regarding this project. At that time, the building was
not going to be sprinkled. Given this, the Chief wanted
an extra fire hydrant and the grassed fire lane in front
of the building. Post permit, we reconsidered sprinkling
the building. Before making a final decision,

we discussed this with Chief Gaudette and were told that
if we ultimately decided to sprinkle the building, we
could eliminate one fire hydrant and the grassed fire

because the value or the 2 small trees was comparable

some of the shrub beds needed more plants, and these were in our

Please be advised that based on information available to the City,
you are occupying the building at the above address without
obtaining a Certificate of Occupancy from the City as required
under Section 27.201 of the South Burlington Zoning Regulations and
24 VSA 4443(a)(2).
You have seven days from the date of this letter to discontinue
this violation and take appropriate remedial action. Specifically,
you must accomplish the following site improvements in order to
comply with the site plan approved on 4/13/93:
1) Add four (4) parking spaces to the site so that there are a
total of 68 parking spaces including four (4) handicapped spaces as
shown on the approved site plan.
2) Add two (2) Armstrong Red Maple trees (1 3/4"-2" caliper), one

If you do not accomplish the actions directed in this letter within
seven (7) days of the date of this letter, the City may pursue this
matter in court. In such court proceeding, the City will be
entitled to seek appropriate injunctive relief and fines of up to
$50.00 per day for each day your violation continues beyond the
seven (7) day period provided in this letter.
If the violation described in this letter occurs again within
twelve (12) months of the date of this letter, you will not be
entitled to receive a further Notice of Violation from the City
before the City pursues further enforcement proceedings.
You may appeal this Notice of Violation to the Board of Adjustment
by filing a written notice of appeal within fifteen (15) days of
the date of this letter with the Clerk of the Board of Adjustment
at the following address: 575 Dorset Street, South Burlington,
Vermont 05403.

Recommendation: The proposed plan improves some existing
deficiencies on the site (e.g., illegal parking in front of the
ATM), but it causes new problems (e.g., forcing all traffic onto
O'Dell Parkway). The best situation in terms of traffic safety and
circulation would be to relocate the bank to the rear of the
property where there is adequate space for such an intense use.
Regardless, any approval should include a stipulation that no
zoning/building permit be issued until O'Dell Parkway is improved
to City standard as shown on the approved plans for the new bank
behind Ben Franklin.
5) CPA PARTNERSHIP - 2 YEAR EXTENSION - REVISED FINAL PLAT
This application is for a two (2) year extension to the expiration
of a revised final plat approved on 12/4/90 (minutes enclosed).
This project consists of the construction of a 50 residential unit
addition to the existing 76 unit elderly housing project known as
Country Park Apartments, 635 Hinesburg Road.
Pursuant to Section 605 of the subdivision regulations, the
Planning Commission may extend the approval for up to two (2)
additional years if, after a public hearing, the Commission
determines that the developer has since final plat approval, been
diligently and consistently pursuing financing or other approvals
necessary for the project. The applicant has submitted a written
explanation detailing their attempts to obtain financing (see
enclosed). The applicant obtained Act 250 approval for the project
on 11/25/92.
6) WILLIAM THOMPSON/DANIEL MORRISSEY - SIGN ORDINANCE APPEAL
This is an appeal taken by William Thompson and Daniel Morrissey of
a decision made by Code Officer Richard Ward to deny a permit for
a wall sign at 550 Hinesburg Road (see enclosed sign application,
letter from Richard Ward and appeal letter). This appeal is being
taken pursuant to Section 29, Appeals, of the South Burlington Sign
Ordinance.
The section of the sign ordinance which is in question is Section
18, Signs in Residential Areas. The applicants applied for a wall
sign for an office building in an R-7 District and Mr. Ward

rejected the application because it is his interpretation that
Section 18 does not address wall signs and is therefore not
permitted. The City Attorney was consulted for his interpretation
and it is his opinion that "the phrase authorizing location of a
sign on a lot under Section 18 authorizes approval of a wall sign
in a residential district" (see enclosed).
Pursuant to Section 29 of the sign ordinance, in deciding this
appeal "the Planning Commission may not grant variances, exemption,
extra -ordinary relief or otherwise alter, amend, enlarge or modify
the provisions of the Ordinance, it being the intent of this
section to merely provide for appeals from the decision of the Code
Officer and not to provide for variances or exceptions hereto".
Therefore, the Commission can only determine whether the Code
Officer properly interpreted the ordinance. In reviewing this
appeal, the Commission should take into consideration the items
listed in Section 29b.
It should be noted that the Code Officer's denial was based solely
on his interpretation that wall signs are not allowed in
residential districts. Therefore, this is the only issue which the
Commission should consider. If the Commission determines that wall
signs are allowed, it should then make that ruling and send the
matter back to the Code Officer for his determination of whether or
not the application meets all other requirements of the sign
ordinance (e.g., maximum size, etc.).

Having reviewed your request for a wall sign for the proposed
office complex located at 550 Hinesburg Road, I am of the opinion
that the sign as proposed does not comply with provisions setforth
within the Sign Regulations for the City of South Burlington.
The area (Hinesburg Road) in question, is zoned Residential
District 7. Section 18 "Signs in residential areas" allows one
sign for a lot which a valid non-residential use exists under the
zoning regulations. Sub -section (b) of Section 18 allows a sign
not to exceed twenty (20) square feet for the purpose of
identifying a multi -family complex, dental or medical clinic.
A lot defined by the sign regulations is a parcel of land or
contiguous parcels of land under the same ownership. Section 18
does not address wall signs, therefore, your request for permission
to erect a wall sign is denied.
As you are aware, South Burlington has a committee reviewing the
sign regulations. I suggest that you contact the City Planner in
order to schedule a discussion regarding -possible amendments to
Section 18 which would permit wall signs.

Dear Commissioners:
Pursuant to Section 29 of the City of South Burlington Zoning and
Planning Ordinance, the undersigned, being designated as the
applicant and property owner respectively in a certain Sign
Application dated December 14, 1993, hereby appeal Mr. Richard
Ward's December 16, 1993 rejection of said application. Applicant,
a travel agency, hopes to occupy office space in a building which
the owner intends to construct at 550 Hinesburg Road. The owner
has received municipal approval for the intended development which
is in a R-7 district. The application is for the erection of a
wall sign to advertise applicant's business.
The undersigned believe that the resolution of this appeal turns
solely on an interpretation of the use of the word "sign" as
utilized in Section 18 of the Ordinance.
Mr. Ward has denied our application by asserting that Section 18
does not address, and therefore does not authorize erection of a
wall sign. He asserts, by implication, that a Section 18 sign must
be a free standing sign. We believe Mr. Ward's interpretation of
the word "sign" in Section 18 is too narrow and fails to consider
the definition of "sign" as provided in Section 3, subsection (bb)
of the ordinance which defines the word "sign" to "... mean and
include every sign, billboard, bulletin -board, free-standing sign,
wall sign ..." (emphasis added).
There is no other language in the ordinance which states or implies
that the Section 3 bb definition of a sign shall not be utilized in
defining "sign" as utilized in Section 18.
The applicant and owner have spent a significant amount of time and
energy in negotiating their relationship and in planning specific
aspects of the building. This negotiation and planning process
included a review of the sign provisions of the ordinance. We have
proceeded, relying on what we believe to be the unambiguous
language of these provisions. We find it distressing and
disconcerting that we are now being advised by the City Enforcement
Officer of an interpretation of the word "sign" which clearly
contradicts its express definition in the ordinance. The
consequent delay realized from the rejection of the application
triggers an adverse financial consequence. Please understand that
it is not our intent to circumvent the ordinance nor the authority
of the enforcement officer. However, it is disheartening to now
learn that what the ordinance clearly states may not be what it
means.
We understand from Mr. Ward that this appeal should be on the
Planning Commission's January 25, 1994 agenda. We hope that the
Commission will be able to address the merits of our appeal at this
meeting. Thus we respectfully request that the Commission procure,
prior to the meeting, whatever advice it deems necessary for it to
render a decision at the meeting.

I move the South Burlington Planning Commission approve the site
plan application of Eugene and'an Morrissey for construction of an
18,000 square foot building for general office use as depicted on
a plan entitled "Site Plan, 550 Hinesburg Road Building, South
Burlington, Vermont", prepared by Weimann-Lamphere Architects,
Inc., and dated 2/18/93, last revised 4/8/93, with the following
stipulations:
1. The applicant shall post a $15,500 landscaping bond prior to
issuance of a zoning/building permit. The bond shall remain
in effect for three (3) years to assure that the landscaping
takes root and has a good chance of surviving.
2. A sewer allocation of 975 g.p.d. is granted. The applicant
shall pay the required sewer allocation fee prior to issuance
of a zoning/building permit.
3. All exterior lighting shall be downcasting and shielded and
shall not cast light beyond the property line. Any change in
lighting shall be approved by the City Planner prior to
installation.
4. The plan shall be revised prior to issuance of a
zoning/building permit to show a 15 foot wide landscape strip
between the planned r.o.w. line and the balance of the lot as
required in section 19.104(b) of the zoning regulations. This
will require removal of the two (2) parking spaces closest to
Hinesburg Road.
5. The planning commission approves a building height of 40.5
feet above average pre -construction grade. It is the
Commission's opinion that the requirements of section
18.112(b) are adequately met.
6. The Planning Commission approves 68 parking spaces for this
development. This represents a waiver of 4 spaces or 5.6% of
the total required. It is the Commission's opinion that 68
spaces will adequately serve the project since a significant
portion of the gross square footage of the building will be
devoted to stairway and elevator space and therefore will not
be devoted to uses which typically generate parking demand.
7. This property is located in Traffic Overlay zone 5 which
permits this property to generate a maximum of 50 trip ends
during the peak hour. Based on I.T.E., it is estimated that
an 18,000 square foot office building will generate 52.5 trip
ends during the peak hour. This estimate is based on gross
square footage. However, as stated in condition # 6 above,
since a large portion of the building will be devoted to
stairway and elevator use, it is the Commission's opinion that
the building will generate no more than 50 trip ends during
the peak hour.
8. Prior to issuance of a zoning/building permit, the applicant
shall contribute $8,272 to the Hinesburg Road Improvement Fund
based on the estimated 50 peak hour trip ends to be generated
by this development.
9. The plan shall be revised prior to issuance of a
zoning/building permit to show a sidewalk along the entire
frontage of the property and extending southward to connect to
the Winding Brook access road. The applicant shall attempt to
obtain slope rights from Winding Brook so as to construct the
sidewalk along the Hinesburg Road r.o.w. line. If such slope
rights can not be obtained, the revised plan shall show the
sidewalk moved closer to Hinesburg Road to a location that
does not require slope rights.
10. The applicant shall obtain a zoning/building permit within six
(6) months or this approval is null and void.
11. The applicant shall obtain a Certificate of Occupancy from the
Administrative Officer prior to occupancy of the building.
12. Any changes to the site plan shall require approval by the
Planning Commission.

8) EUGENE & DAN MORRISSEY - OFFICE BUILDING - SITE PLAN
This project consists of the construction of a three (3) story
18,000 square foot general office building on a 1.02 acre lot.
This lot was previously used by Goodrich Construction to store
construction equipment and supplies. The Zoning Board of
Adjustment on 3/22/93 granted the applicants a conditional use
permit for this project.
This property located at 550 Hinesburg Road lies within the R7
District. It is bounded on the north, east and south by the common
land which is part of the Winding Brook residential development and
on the west by Hinesburg Road.
Access/circulation: Access is proposed to be via a 30 foot curb
cut on Hinesburg Road.
Circulation is adequate.
Parking: This project requires a total of 72 parking spaces and
only 70 spaces including four (4) handicapped spaces are being
shown. The applicant will be making the argument that the spaces
lost in the building for stairs and elevator reduces the
requirement to 70 spaces. In addition two (2) spaces at the
entrance should be removed to comply with the front yard
landscaping requirement (see discussion under landscaping). This
would reduce the number of spaces available to 68.

Landscaping: The minimum landscaping requirement for this project
is $15,500 which is being met. Planting will include Honeylocust,
Hemlock, Arborvitae, Burning Bush, Juniper and Wintercreeper.
Section 19.104b. of the zoning regulations requires a 15 foot
landscaped strip between the street line and the balance of the
lot. Staff interprets the street line to begin at the edge of the
planned r.o.w. Since only driveways can traverse this strip, two
(2) parking spaces at the entrance must be removed.
Traffic: This property is located in Traffic Overlay Zone 5 which
limits this property to 50 vehicle trip ends (vte's) during the
P.M. peak hour. According to I.T.E. a general office building of
this size is estimated to generate 52.5 vte's during the P.M. peak
hour. The applicants will be required to contribute $8,685 to the
Hinesburg Road Traffic Impact Fund based on the 52.5 vte's
estimated to be generated by this project.
Coverage/setbacks: Building coverage is 7.4% (maximum allowed is
25%). Overall coverage is 60% (maximum allowed is 60%). Front
yard coverage is 26.7% (maximum allowed is 30%).
Sewer: The sewer allocation needed for this project is 975 gpd
based on 65 employees. The applicant's will be required to pay the
per gallon fee prior to obtaining a zoning/building permit.
Lighting: Exterior lighting will consist of eight (8) 175 watt
metal halide lamps with cutoff luminaries on 18 foot poles and two
(2) bollard lights 42" high with 100 watt metal halide lamps.
Building height: The proposed building will exceed the 40 foot
height limit provided for in Section 18.112a of the zoning
regulations for a pitched roof by 1/2 foot. Section 18.112b allows
the Planning Commission to increase the height of the structure if
the three (3) criteria contained in this section are met and
greater setback requirements are met. The building will be setback
an additional 1/4 foot on the side and 1/2 foot on the front to
meet the additional setback requirement.
Sidewalk: Applicants are proposing to construct a sidewalk along
the front of their property within the Hinesburg Road r.o.w. The
plans shows that only the north-westerly portion will be
constructed. The applicants propose to contribute money to the
sidewalk fund for the remaining 128 feet to the Winding Brook
access road. The reason given for not constructing this portion is

that slope rights would have to be obtained from the Winding Brook
Landowner's Association.
Staff recommends that the applicants try to obtain the necessary
slope rights and if they are unsuccessful that the sidewalk be
constructed closer to the street to avoid the need for the slope
rights.

type proposed have to be acceptable to them.
2. Final plans must include a road typical section also storm

3. If the street is to be public, a gravel turn around is required
for maintenance trucks especially snow plows. Using the existing
driveway is not acceptable because the plow will deposit snow in
the entrance resulting in a hazardous condition.
4. The far easterly entrance drive to Bambino's must have a
depressed curb across it. Also the road curb along the southerly
road should be straight and it could remain when the road is
extended.
5. Two 25 m.p.h. speed sign should be installed along the
Shelburne Street entrance and another toward end of road.

GOODRICH LOT - 550 HINESBURG ROAD
1. Drainageway of Potash Brook crossing Hinesburg Road is in poor
condition and needs replacement. It has plugged and backed water
for quite a distance. The finished floor of this building should
be at an elevation higher than the elevation of Hinesburg Road
where the brook crosses. The contours on the plan are not to
U.S.G.S. datum so it is difficult to check.
2. The sidewalk along the frontage should be extended to the
Winding Brook development driveway so it can be used.
3. The parking lot should drain toward the north not the east as
plan shows.
4. Existing sewer main continues southerly. It should be shown
on the plans.
CHITTENDEN BANK - DORSET STREET
1. The proposed Dorset Street sidewalk and bike path will be
constructed across the entrance drive. Plans should show it.
2. A stairway connecting the bank with the mall parking lot along
the south property line such as exists between the Merchant's Bank
and the Post Office on White Street would be beneficial to
pedestrians.

I am writing in response to your request relative to the
above -referenced matter. Specifically, you have asked whether it
is appropriate to include sidewalks, or similar paved pathways,
in lot coverage calculations. It is our opinion that it is
appropriate to include such improved areas in lot coverage
calculations.
As you know, the City of South Burlington Zoning Regulations
do not specifically define "lot coverage" or specify identify
what types of improvements should be included in the calculation
of lot coverage. Table 25-1, which sets forth the area, density
and dimensional requirements for the City's respective zoning
districts, does distinguish between maximum lot coverage for
"buildings,"� alone, and for "buildings, parking and outside
storage." T e do not- Lo 'Look at those categories as necessarily
limiting the lot coverage calculation, however, since they are
not addressed in any specific provision of the Zoning
Regulations. Further, sidewalks and other paved pathways may be
viewed as integral components of a building or a parking
facility, and excluding sidewalks from the lot coverage
calculation creates a difficult situation in which the City is
required to distinguish between various forms of paved
improvements having virtually identical environmental effects
(i.e., the surface of the ground is covered by impermeable
material). In sum, as a general rule, if an improvement covers
the surface of the ground, and cannot be easily removed, it
should be included in the lot coverage calculation.

of the City sign regulations does not define the type of sign
which is allowed within a Residential 7 District. Based on his
ruling, this office has issued sign permit #94-06 dated January
21, 1994.
Be advised that other than direction signs (maximum of three (3)
square feet), no other wall or pylon sign will be allowed at this
location.

Section 18. Signs in Residential Areas
(a) There shall be no signs in a residential district (as
so classified under the South Burlington Zoning Regulations as,
presently in force or hereafter adopted and amended from time to
time), except one sign may be erected and maintained for a lot

Having reviewed your request for a wall sign for the proposed
office complex located at 550 Hinesburg Road, I am of the opinion
that the sign as proposed does not comply with provisions setforth
within the Sign Regulations for the City of South Burlington.
The area (Hinesburg Road) in question, is zoned Residential
District 7. Section 18 "Signs in residential areas" allows one
sign for a lot which a valid non-residential use exists under the
zoning regulations. Sub -section (b) of Section 18 allows a sign
not to exceed twenty (20) square feet for the purpose of
identifying a multi -family complex, dental or medical clinic.
A lot defined by the sign regulations is a parcel of land or
contiguous parcels of land under the same ownership. Section 18
does not address wall signs, therefore, your request for permission
to erect a wall sign is denied.
As you are aware, South Burlington has a committee reviewing the
sign regulations. I suggest that you contact the City Planner in
order to schedule a discussion regarding -possible amendments to
Section 18 which would permit wall signs.

Dear Commissioners:
Pursuant to Section 29 of the City of South Burlington Zoning and
Planning Ordinance, the undersigned, being designated as the
applicant and property owner respectively in a certain Sign
Application dated December 14, 1993, hereby appeal Mr. Richard
Ward's December 16, 1993 rejection of said application. Applicant,
a travel agency, hopes to occupy office space in a building which
the owner intends to construct at 550 Hinesburg Road. The owner
has received municipal approval for the intended development which
is in a R-7 district. The application is for the erection of a
wall sign to advertise applicant's business.
The undersigned believe that the resolution of this appeal turns
solely on an interpretation of the use of the word "sign" as
utilized in Section 18 of the Ordinance.
Mr. Ward has denied our application by asserting that Section 18
does not address, and therefore does not authorize erection of a
wall sign. He asserts, by implication, that a Section 18 sign must
be a free standing sign. We believe Mr. Ward's interpretation of
the word "sign" in Section 18 is too narrow and fails to consider
the definition of "sign" as provided in Section 3, subsection (bb)
of the ordinance which defines the word "sign" to "... mean and
include every sign, billboard, bulletin -board, free-standing sign,
wall sign ..." (emphasis added).
There is no other language in the ordinance which states or implies
that the Section 3 bb definition of a sign shall not be utilized in
defining "sign" as utilized in Section 18.
The applicant and owner have spent a significant amount of time and
energy in negotiating their relationship and in planning specific
aspects of the building. This negotiation and planning process
included a review of the sign provisions of the ordinance. We have
proceeded, relying on what we believe to be the unambiguous
language of these provisions. We find it distressing and
disconcerting that we are now being advised by the City Enforcement
Officer of an interpretation of the word "sign" which clearly
contradicts its express definition in the ordinance. The
consequent delay realized from the rejection of the application
triggers an adverse financial consequence. Please understand that
it is not our intent to circumvent the ordinance nor the authority
of the enforcement officer. However, it is disheartening to now
learn that what the ordinance clearly states may not be what it
means.
We understand from Mr. Ward that this appeal should be on the
Planning Commission's January 25, 1994 agenda. We hope that the
Commission will be able to address the merits of our appeal at this
meeting. Thus we respectfully request that the Commission procure,
prior to the meeting, whatever advice it deems necessary for it to
render a decision at the meeting.
