HomeMy WebLinkAboutSP-99-69 - Decision - 0200 Hinesburg Road#SP-99-69 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of pact, conditional use and site plan application of the Roman Catholic Diocese for construction of an addition to an accessory structure for a church On the 4th of January, 2000, the South Burlington Development Review Board approved the conditional use and site plan applications of the Roman Catholic Diocese under Sections 26.05 and 26.10 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of construction of a one-story wood frame 440 square foot addition to an existing 1500 sq, ft. _m__ainte_n_ance /office building, The addition will be used to house a reception area, conference room and Handicapped bathroom. 2. The owner of record of this particular property is the Roman Catholic Diocese. 3. This property located at 200 Hinesburg Road lies within the R4 District and is bounded on the west by Hinesburg Road and on the north; south, and east by residences. 4. Access/Circulation: Access is provided via an existing curb cut on Hinesburg Road. No changes are proposed. Circulation on the site is adequate. 5. Coverage/setbacks: Setback requirements have been met. Coverage is not determinable at this time as the applicant did not provide lot size information. However, the proposed addition is expected to Have a minimal impact on coverage considering the vast size of the lot. 6. Parking: A total of 8 parking spaces are required and a total of 16 spaces are provided. The plan should be revised to show the limits of parking and circulation. 7. Landscaping_ The minimum landscaping requirement based on building costs is $1191. The applicant has not provided details ofproposed landscaping. The applicant should submit landscaping plans including the name, number, size, and species of proposed plantings. 8. Sewer No additional sewer allocation needed. 9. Traffic: The proposed addition is not expected to generate any additional traffic. 10. Li t' : If the applicant is proposing any additional exterior lighting, the applicant should provide exterior lighting details (cut -sheets). 11.Other: The plan should be revised to show the true north arrow pointing in the correct direction. 12 _This property located at 200 Hinesburg Road lies within the R4 District. The proposed use complies with the stated purpose of the R4 District to "encourage residential use at moderate densities that are compatible with existing neighborhoods and undeveloped land adjacent to those neighborhoods." The proposed Church reception area and conference rooms are compatible with the residential neighborhoods found in this district. 13. The proposed use will not adversely affect: a) the capacity of existing or planned con nunity facilities. It is a community facility that will be used by city residents b) the character of the area affected. It is compatible with the existing maintenance/office space for the cemetery and surrounding residential neighborhoods. c) traffic on roads and highways in the vicinity. The proposed use is not expected to impact traffic. d) bylaws in effect. The addition will comply with the area and dimension requirements. e) utilization of renewable energy resources. The proposed use will not impact any renewable energy resources utilization. 0 general public health and welfare. No adverse effect expected. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves the application of Roman Catholic Diocese of Burlington for conditional use approval from Section 26.05 Conditional Uses; of the South Burlington Zoning Regulations. Request is for permission to construct a 440 square foot addition to an existing 1500 square foot accessory structure for a church, and the site plan application of Roman Catholic Diocese of Burlington to construct a 440 square foot addition to an existing 1500 square foot accessory structure for a church, 200 Hinesburg Road, as depicted on a plan entitled "Resurrection Cemetery Roman Catholic Diocese of Burlington Hinesburg Road, South Burlington, Vermont 05403 Master Plan- 1999 Update" prepared by TK Landscape Architects, dated 10/8/99, with the following stipulations: 2 1. All previous approvals and stipulations that are not superseded by this approval shall remain in effect. 2. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the addition will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 3. Any new exterior lighting shall consist of downeasting shielded fixtures. Any change to existing lights shall require approval by the Director of Planning and Zoning prior to installation. 4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the addition. 6. Any change to the site plan shall require approval by the South Burlington Development Review Board. 7. Prior to issuance of a zoning permit, the applicant shall post a $1,191 landscape bond.
