These properties are connected to the Airport Parkway Wastewater Treatment Facility which has sufficient capacity to handle this demand. On November 23, 1993, the Planning Commission approved the subdivision of the property at the corner of Barrett Street and Hinesburg Road into two lots, a single family dwelling at 4 Barrett Street and a duplex at 175 Hinesburg Road. The single-family home was built in 1985 and the Hinesburg Road house was built substantially prior to 1971. Enclosed are copies of the assessor's cards designating the number of bedrooms in the two structures. Mc ibney Appeal #2, Fred, )ck & Louise McGibney Appeal of Frederick & Louise McGibney seeking a variance from Section 18.00 area, density & dimensional requirements. Request is for permission to subdivide a lot with parcel #1 containing 6,920 square feet and fifty-eight (58) feet of frontage. This proposed subdivision also creates a westerly rear line of four (4) feet and a northerly side line of four (4) feet on parcel #2. Lot in question is located at 175 Hinesburg Road and intersects with Barrett Street. Mr. Ward informed the Board the area is zoned R-4 District. Section 18.00 area, density & dimensional requirements. Minimum lot 9,500 square feet and 80 feet frontage. Minimum rear yard, 30 feet, side 10 feet. Proposed subdivision creates lot #1: 6,920 square feet and 58 feet of frontage on Barrett Street. Lot #2: 16,267 square feet and 111 feet of frontage on Hinesburg Road, 142 feet on Barrett Street. Rear of four feet and a side yard of 4 feet (distance of-12 feet along the sides of a detached 241x40' garage). Variance granted 2/25/85 allowing for two (2) single family dwellings on one lot. After the warning he learned the lot coverage of 6,920 square foot lot would be 200 or 1,384 square feet. The existing structure is 1,522 square feet. This is also under Section 18.00 so there is no need to rewarn he wanted to bring it to the Board's attention. The distance along the garage is the only problem with the four (4) feet. STATE OF VERMONT CITY UOFYSOUTHHBURLINGTON V'� 7 /n� OF ✓ d �� DECISION AND FINDING OF FACT On the 12th day of July 12, 1993, the South Burlington Zoning Board of Adjustment heard evidence regarding the appeal of Frederick McGibney, 175 Hinesburg Road based on the following facts and findings: 1) The applicant is requesting to subdivide a parcel of land containing 23,187 square feet into two lots. Lot #1 contains 6,920 square feet and lot #2 contains 16,267 square feet. The property is occupied with two single family dwellings. 2) The neighborhood has a number of non -complying structures=in keeping with what exists. 3) The narrowness of the proposed lot is due to the location of the garage. 4) The general character of the neighborhood will not change. 5) Proposed property line represents the minimum variance and is created by the location of the detached garage. Based upon the above facts and findings the appellant's request for a variance is hereby granted. Other Business: a. Mr. Weith advised that S.T. Griswold has asked for a 6-month extension on the Green Acres Quarry approval. Mr. Austin moved to rant the 6-month extension on the Green Acres uarr a roval to S. T. Griswold. Mr. Crain seconded. Motion asked 4-0 with Mr. Sheahan abstainin . 2. Minutes of 12 & 26 October 1993: Mr. Craig moved to approve the Minutes of 12 October as writ- ten. Mr. Sheahan seconded. Motion passed 4-0 with Mr. Austin abstaining. (single family dwelling) and 16,290 (2-family dwelling), 175 Hinesburg Rd. and 4 Barrett St: Mr. McGibney said he bought the property in 1971. There was a single family dwelling and a large garage. The lot is about 1/2 acre. In 1985, he got permission to build a single family dwelling. He has received waivers on setbacks and now wants to subdivide. Mr. Weith said the application is in order with no outstanding issues. Mr_. Site plan application of Jeff Noyes, Jeff Nelson & Craig Heindel for conversion of a 8,700 sq. ft. motel (i.e., 2 build- ings) to professional office use, 428 & 434 Shelburne Rd: Mr. Nelson said this was previously the Queen city Inn & Motel. They will move the company office into the facility. No changes will be made to the exterior of the building. The property is located on the city line with the right-of-way in front of the property being located in the City of Burlington. The company has 22 employees who will occupy the Inn building. The motel building will be used for cold storage. There are 22 parking spaces proposed which, Mr. Nelson said, they probably won't need. Regarding the question of a sidewalk, Mr. Nelson said the proper- ty to the north of them has a sidewalk that terminates at this property line. There is no sidewalk to the south. They are willing to build a sidewalk to line up with the the Larkin pro- perty sidewalk. They met with the City of Burlington which has no problem with the sidewalk location. There has also been an issue of curb cuts. Currently, there are 4 on the property, 2 on Shelburne Rd. and 2 on White Place. They are willing to eliminate 1 on Shelburne Rd. but would like to keep the other 3. Mr. Craig said he didn't like the Shelburne Rd curb cut because he felt it entices people to go against the traffic flow on the lot. He felt that closing curb cuts on Shel- burne Rd. helps the road situation. Mr. Weith said that is staff's opinion as well. He said that this business is not de- pendent on passer-by traffic and didn't feel the curb cut was necessary for the success of the business. Messrs. Sheahan and Austin had no strong feelings because of the low trip ends. Mrs. Maher and Mr. Teeson felt the applicant PLANNING COMMISSION 20 July 1993 page 2 Mr. Khouri said they eliminated a row of parking parallel to Dorset St. and widened the green area. also reduced the impact on the wetlakids and increased the visual barrier from I-89 and maintained as much of the stand of deciduous trees as possible. The Mall will create a new full entrance be- tween Steinbach's and CWT which will encourage people to park in that area. Mr. Khouri noted staff wanted 2 rows of parking removed, but this wouldcreate a problem for Steinbach's and would cost 13 parking spaces. Mr. Weith felt a 16 ft. planting strip was too narrow and wanted to go with the original staff recommendation. He said screening is very important. Mr. Khouri felt another 9 ft. of green area wouldn't make much difference but it would make a difference to parking. Mr. Weith noted that zoning regulations require that no more than 30% of the front yard be covered. Mr. Craig felt the Commission had given the impression last week that removing one row of parking would be satisfactory. Mr. Burgess said he is comfortable with getting more parking and more green space. He added that the dorset St. project will give a row of plantings between the sidewalk and the Mall. Other members felt the addition green space would be nice, but could live with it th way. Mrs. Maher said it was OK if the crabapple trees are changed. MR. Khouri raised the question of a kiosk proposed by the Dorset St. Committee to be on U Mall property. He said they would like to see the design in order to make it happen. With regard to the former Gleeson property, Mr. Khouri said they haven't been able to get a tenant for the site. In the interim, they have paved it for interim parking.
