Re: Findings of Fact, application of Frederick & Louise McGibney
for subdivision of a 23,260 square foot lot containing a single
family dwelling and two-family dwelling into two (2) lots of 6,970
square feet (single-family dwelling) and 16,290 square feet (two-
family dwelling), 175 Hinesburg Road.
On the 23rd of November, 1993, the South Burlington Planning
Commission approved the request of Frederick & Louise McGibney for
final plat approval under Section 202 of the South Burlington
Subdivision Regulations based on the following findings:
1. This project consists of the subdivision of a 23,260 square
foot lot into two (2) lots of 16,290 square feet and 6,970 square
feet. Parcel #1 is developed with a single family dwelling and
parcel #2 is developed with a two (2) family dwelling. The Zoning
Board of Adjustment (ZBA) granted the applicant a variance on
2/25/85 to construct the single family dwelling. The ZBA granted
variances on 7/12/93 from lot size, lot frontage, building coverage
and setback requirements. The Planning Commission reviewed the
sketch plan on 7/20/93.
2. This property located at 175 Hinesburg Road lies within the R-4
District. It is bounded on the north by a duplex and a single
family dwelling, on the west by a single family dwelling, on the
east by Hinesburg Road and on the south by Barrett Street.
3. Access: Access to the lot is currently provided by two (2)
curb cuts on Barrett Street, one (1) for each residence. No
changes to the access are proposed.
4. Lot size: Parcel #2 (duplex lot) will meet the 12,000 square
foot minimum lot size requirement. Parcel #1 will not meet the
9,500 square foot requirement but a variance from this requirement
was granted by the ZBA on 7/12/93.
5. Coverage/setbacks: For parcel #1, building coverage is 25.6%
(maximum allowed is 20%). A variance to exceed building coverage
was granted by the ZBA on 7/12/93. Overall coverage is 30.4%
(maximum allowed is 40%).
Setback requirements for parcel #2 will not be met but variances
were obtained from the ZBA on 7/12/93.
6. Lot Frontage: Parcel #2 meets the 100 foot frontage
requirement. Parcel #1 does not meet the 80 foot frontage

requirement but a variance from the ZBA was granted on 7/12/93 for
only 58 feet of frontage.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the final plat application of Frederick and
Louise McGibney for subdivision of a 23,260 square foot lot
containing a single-family dwelling and two-family dwelling into
two (2) lots of 6,970 square feet (single-family dwelling) and
16,290 square feet (two-family dwelling), as depicted on a plat
entitled "Subdivision Plan for Frederick & Louise McGibney, South
Burlington, Vermont", prepared by Vermont Survey and Engineering,
Inc. and dated 8/93, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The applicant shall record the final plat in the South
Burlington land records within 90 days or this approval is null and
void. The Planning Commission Chair or Clerk shall sign the plat
prior to recording.
