The South Burlington Planning Commission held a meeting on
Tuesday, 9 December 1986, at 7:30 pm, in the Conference Room,
City Hall, 575 Dorset St.
Members Present

1. Minutes of November 18, 1986 and November 19, 1986.
Mrs. Maher requested that on page 7 of the minutes of Nov. 19th,
paragraph three should read "Mrs. Maher" instead of "Mrs.
Lafleur". In paragraph four "Mrs. Lafleur" should be "Mrs.
Maher".
Mrs. Maher moved that the minutes be approved as corrected.
Mrs. Hurd seconded and all voted in favor.
2. Public Hearing: Final Plat application of Bernard Brown for
a two lot subdivision of a .6 acre parcel at 100 Hinesburg Road.
Mr. Brown explained that he wished to subdivide his .6 acre
parcel into 2 lots a little over 13,000 square feet each.
Mrs. Lafleur noted that Mr. Szymanski said in his memo that he
did not want the existing right-of-way used as an access onto
Hinesburg Rd. Mr. Brown agreed. There will be a separate
driveway to each lot and this right-of-way would not be used.
Mr. Dooley asked how this right-of-way came to be. Mr. Brown
said it remained from when he subdivided the land for what is
now Davis Parkway and it was for drainage only.
Mr. Dooley moved for approval of the Final plat of Bernard and
Alfreda Brown for a two lot subdivision of a .6 acre lot into
two .3 acre parcels as depicted on a plan entitled "Plat of
Survey Bernard W. Brown Property" prepared by Warren A.
Robenstein, last revised November, 1986 with the following
stipulations:

Mrs. Maher seconded and all voted in favor.
3. Site plan application of Lane Press for construction of a
40,320 square foot addition to the existing building at 1000
Hinesburg Road. (former Semicon property)
Mr.Or„rnlleljzr said that Lane Press was a printing company which
prints magazine and is now located in Burlington. They wish to
come into the Semicon building and add a 40,320 square foot
addition. They plan to move the existing road on the east
further to the east approximatly 140 feet. Construction would
begin sometime in March with the move planned for July.
Mrs. Lafleur noted that they more than met the number of parking
spaces and that no additional parking would be needed.
Landscaping and sewerage are also adequate.
They will be asked to contribute to the fund for improvement of
the intersection at Hinesburg Rd. and Kennedy Dr.
Mrs. Lafleur said that the policy regarding the sidewalk had not
been completed so she wasn't sure how this applicant's amount to
the fund will be computed. She suggested that since they
didn't have actual frontage on Hinesburg Rd. that the 50 foot
right-of-way be used to find the figure. All agreed.
Mrs. Hurd asked if the front of the building will be changed to
face Hinesburg Rd. said that it would not but that
the large nitrogen tank which is now seen from Hinesburg Rd.
will be removed.
Mr. Jacob asked if they used any of the chemicals that Semicon
now used. Mr .7rumhe,lle( said they wouldn't be using the same
chemicals. They use printing ink, solutions to wash presses and
photographic chemicals. These are all trucked out.
Mrs. Maher asked if what was going into the sewer was OK. Mrs.
Lafleur said that that would be reviewed at the Act 250
hearings. They will have to get a discharge permit. Mr. Meador
said that that has already been approved.
Mrs. Maher asked if our landfill can hold the amount they will

Attached please find application for variance on land per address
above, with exhibits "A" and "B" to application.
We, the owners, see (Exhibit "A") of the application are applying
to partition the land into two (2) seperate building lots for single
family dwellings with a 77.49' frontage for each lot (Exhibit "B")
drawing of proposed land partition. Because each lot would need 80'
of frontage under current regulations, we are appealing for a 2.51'
variance for each building lot.
Reference is made to Presentation Procedures for Appellants to the
South Burlington Board of Adjustment which is part of the Notice of Ap-
peal application packet:
Criteria #2 - A variance is necessary to enable the reasonable
use of the property.
Criteria #4 - The variance, if authorized will not alter the
character of the neighborhood nor impair the appropriate use
or development of adjacent properties. Note (Exhibit "A")
that on the same side of the street as our property, between
the Munnett property to the south and Ruth Street on the north
that six (6) of the seven residences have frontages much shorter
than our two (2) proposed building lots.
Criteria #1 and #3 - We do not appear to be in violation of
these two (2) .
Criteria #5 - We are in consonance with this statement.

If the variance is authorized, the surveyor who prepard the Plat
of Survey, Exhibit "A" to the application, Warren A. Robenstein, will
place iron pins at the 77.49' point on the frontage and at a point on
the rear boundary of 75' plus or minus which will insure lots of approxi-
mately 13,314 square feet, plus or minus.

This project, consisting of a two lot subdivision identified as Lot N and Lot S each being 0.30 acre
in size and each proposed for one three bedroom single family residence, served by municipal water
and wastewater services, located off Hinesburg Road in the city of South Burlington, Vermont is
hereby approved under the requirements of the regulations named above, subject to the following
conditions.
GENERAL
This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from local officials prior to proceeding with this project.
2. The project shall be completed as shown on the plans "Bernard & Alfreda Brown 2 Lot
Subdivision" dated 2-25-00 signed by Tom Thompson which have been stamped
"approved" by the Wastewater Management Division. The project shall not deviate from
the approved plans without prior written approval from the Wastewater Management
Division.
3. Each prospective purchaser of each lot shall be shown a copy of the approved plot plan and
this Subdivision Permit prior to conveyance of the lot.
4. The conditions of this permit shall ran with the land and will be binding upon and
enforceable against the permittee and all assigns and successors in interest. The permittee
shall be responsible for the recording of this permit and the "Notice of Permit Recording"
in the South Burlington Land Records within 30 days of issuance of this permit and prior to
the conveyance of any lot subject to the jurisdiction of this permit.
5. This project has been reviewed and is approved for the construction of one three bedroom
single family residence on each approved lot. Construction of other types of buildings or
dwellings, including public buildings, commercial buildings, duplexes, and condominium
units, is not allowed without prior review and approval by the Wastewater Management
Division and such approval will not be granted unless the proposal conforms to the
applicable laws and regulations.

6. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property subject to this permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations.
WATER SUPPLY
7. Each lot is approved for water supply by connection to the municipal water system as
depicted on the approved plans. No other means of obtaining potable water shall be allowed
without prior review and approval by the Wastewater Management Division.
WASTEWATER DISPOSAL
8. Each lot is approved for connection to the South Burlington Airport Parkway wastewater
treatment facility as depicted on the approved plans. The project is approved for a
maximum of 900 gallons of wastewater per day. No other method of wastewater disposal
shall be allowed without prior review and approval by the Wastewater Management
Division, and such approval will not be granted unless the proposal conforms to the
applicable laws and regulations.

warehouse/storage space on previously approved Lot 11, for a maximum of 15 employees, served
by municipal water and wastewater services, located off Ethan Allen Drive in South Burlington,
Vermont is hereby approved under the requirements of the regulations named above, subject to the
following conditions.
This permit does not constitute approval under Act 250 case number 4C0643-19.
1. This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from the Act 250 District Environmental Commission, the Department of
Environmental Conservation, Water Supply Division - telephone (802) 241-3400, the
Department of Labor and Industry - telephone (802) 828-2106 or (802) 658-2199, and local
officials prior to proceeding with this project.
2. The project shall be completed as shown on the following plans which have been stamped
"approved" by the Wastewater Management Division:

prior review and approval from the Division of Wastewater Management.
4. The Wastewater Management Division now reviews. the sewage and water systems for public
buildings under 10 V.S.A., Chapter 61 - Water Supply and Wastewater Disposal Permit.

5. By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property covered by the permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations,
with this permit.
6. A copy of the approved plans and this permit shall remain on the project during all phases
of construction and, upon request, shall be made available for inspection by State or local
personnel.
7. All conditions set forth in Certificate of Compliance #4C0643, Subdivision Permit #'s EC-4-
1183 and amendments shall remain in effect except as modified or amended herein.
WATER SUPPLY
S. The project is approved for water supply by connection to the South Burlington municipal
water system as depicted on the approved plans. No other means of obtaining potable water
shall be allowed without prior review and approval by the Wastewater Management
Division.
9. The installation of the water line extension shall be inspected by a professional engineer
registered in the State of Vermont who shall report in writing prior to occupancy, that the
work has been completed in accordance with the approved plans. The engineer's report shall
include, but not be limited to, the results of all leakage tests performed on the water line and
review of the pipe in the trench before covering, and the disinfection of all water pipes.
WASTEWATER DISPOSAL
10. The project is approved for connection to the South Burlington Airport Parkway wastewater
treatment facility as depicted on the approved plans. The project is approved for a maximum
of 225 gallons of wastewater per day. No other method of wastewater disposal shall be
allowed without prior review and approval by the Wastewater Management Division, and
such approval will not be granted unless the proposal conforms to the applicable laws and
regulations.

11. A professional engineer, registered in the State of Vermont, is to generally supervise the
construction of the sanitary sewer line extensions and, upon completion of construction, the
supervising engineer is to submit to the Wastewater Management Division a written
certification stating all construction has been completed in accordance with the stamped
approved plans. The engineer's certification is to be submitted to the Division prior to the
occupancy of any unit and the certification shall include, but not be limited to, the results of
all leakage testing performed on each segment of the sanitary sewer extension and all
manholes, as described in the Environmental Protection Rules, Chapter 1, Appendix A.

That the South Burlington Planning Commission approve the Final
plat of Bernard and Alfreda Brown for a two lot subdivision of
a .6 acre lot into two .3 acre parcels as depicted on a plan
entitled "Plat of Survey Bernard W. Brown Property" prepared
by Warren A. Robenstein, last revised November, 1986 with the
following stipulations:
1. The 10 foot right-of-way along the northern boundary shall
not be used for any future road opening on to Hinesburg Road.
2. It is the applicant's responsibility to record the final
plat within 90 days or this approval is null and void. It shall
be approved by the Planner and signed by the Chairman of the

2) BROWN, 100 HINESBURG ROAD
Mr. Bernard Brown proposes to subdivide the .6 acre vacant lot on
Hinesburg Road into two .3 acre lots (13,000 + square feet). The
property received a variance for the 77.49 feet of frontage for
each lot. It is zoned R4. There are no major problems with this
subdivision. See Bill Szymanski's memo regarding the r.o.w.
3) LANE PRESS, 1000 HINESBURG ROAD
Lane Press proposes to construct a 40,320 square foot addition to
the eastern side of the former Semicon building. The 31.2 acre
property is zoned Industrial -Agricultural and this use was
permitted by the Zoning Board. The total building with the
addition and including both floors will be 131,537 square feet.
Access: Access will remain from the right-of-way provided from
Hinesburg Road.
Circulation: Circulation will continue on three sides of the
building as it presently exists. The eastern driveway will be
reconstructed since the addition will be constructed where the
driveway is now located.
Parking: There will be 300 total employees with 165 in the first
shift. Using the requirement of 2 spaces per 3 employees, 200
parking spaces are required. There are 251 provided on the site.
Landscaping: A number of trees will be relocated to build the
addition. The plans require $15,000 in new landscaping based on
the $650,000 building addition and the $100,000 in renovations.
The plans show this amount.
Other: See Chief Goddette's and Bill Szymanski's comments.
The project is expected to produce 82 trip ends during the peak
hour of 3 to 4 p.m. This will require a $5227 contribution
toward the intersection improvement fund.
A 14,000 gallon per day sewer allocation was given to Semicon.
Lane Press expects to use 12,000 gallons per day of this
allocation.
This new lot has no Hinesburg Road frontage. The Commission

1. Site plan is acceptable.
4) BUILDING AT 10 FARRELL STREET
1. There exists a drainage swale along the easterly property
line. This swale drains a large area. The plan shows the
parking lot extended on to this swale. It should not be
disturbed or pipes should be added.
2. Plan should identify the owner and architect. This is
helpful for future reference.
3. Access should be limited to the two Farrell Street openings.
The existing Swift Street opening as shown on the plans was never
an approved access. Original plans are on record.
5) NORDIC FORD, GREEN MOUNTAIN DRIVE
1. Curb out on Green Mountain Drive shall'be closed.
2. Plan not well done. It lacks dimensions, pipe sizes,
elevations.
3. Impact on adjacent property *and existing storm system
resulting from diverting drainage must be made.
4. The long narrow detention basin will be difficult to
maintain. It should be designed so that it will completely
drain.

Mr. Jacob noted that from time to time the Commission asks a
developer to give a recreation fee in lieu of land for
recreation. He questioned whether this developer would
consider giving a stated amount for Williston Rd.
improvements in exchange for reduced lot coverages. Mr.
Pomerleau said he would have no objection provided the money
was used in this particular area.
Members agreed to continue the discussion until next week
and reconsider the curb cuts on Williston Rd, location of
bank drive -up tellers, and the reduced parking/shared parking
question.
Mr. Burgess then moved to continue discussion until Wednesday
19 November, at 7.30 pm. Mrs. Maher seconded, and the motion
passed unanimously.
3. Sketch plan application of Bernard & Alfreda Brown for a
2-lot subdivision of a .61 acre parcel at 100 Hinesburd Rd.
The Browns are proposing 2 single family lots each with 77.14
ft. frontage. There had been a 10 ft. right of way for
drainage but this was never utilized by the developer.
Members saw no problems with the plan.
4. Sketch Plan application of Richard & Marsha Alvarez for
the subdivision of a 31,000 sq. ft. lot from the 41-acre
Irish farm, 200 Allen Road
Mrs. Lafleur noted the Commission recently approved a lot
south of the water tower. The proposed lot would be 30,000
sq. ft. and would be served by the same 20-foot right of way.
Water and sewer would be extended from Harbor Ridge Rd. Mr.
Szymanski would like agreements for reimbursement for the
extension of the sewer and an agreement to maintain the right
of way. Dr. Alvarez said he would object to paying for half
the cost of the future road . Mrs. Lafleur noted that Mr.
Szymanski felt this should have been a public road to be 9t(N
with. She added that the Commission can approve up to 3 lots
on a private drive which usually means that the next guy gets
stuck with the road. Mrs. Maher said if the Commission does
approve this request, they should then not allow any more
houses of this road. Members agreed with this.
5. Review landscaping plan for Wickes Lumber on request of
the Zoning Board, 1825 Shelburne Rd.
Mr. Dooley asked why a project that affects traffic, parking,
etc., didn't come to the Commission in the first place. Mrs.

Existing Conditions: Mr. Spitz finds that Hinesburg
Road/Williston Road intersection operates at level of service C.
The Williston/White Street intersection operates at.i) and the
shared right and left turn exit from Midas Road operate at level
E.
Future Conditions: In 1986, with the development, Spitz says the
level of service can be kept at C at both intersections. By
1991, without -the development, the level of service will be "E"
at Hinesburg Road. In 1991 with the development, a new signal at
Midas and White Street and left turn lanes, the level of service
will be B at Midas/White Street and C at Hinesburg Road.. A "C"
also requires the prohibition of east bound left turns at Willis-
ton/Hinesburg Road.
Craig Leiner's comments are enclosed although not summarized
here. Craig and David will both attend the meeting Tuesday
night.
Other: See Bill Szymanski's and Chief Goddttte's comments. A
sewer allocation of 23,090 gpd is required (motel-21,600 gpd,
bank-60 gpd, shopping center-1430 gpd) and this project shall be
placed on the waiting list. The $2.50 per gallon fee must be
paid prior to permit.
3) BERNARD AND ALFREDA BROWNS 100 HINESBURG ROAD
Mr. & Mrs. Brown propose to subdivide a .61 acre (26,628 square
foot lot) into two lots of 13,314 square feet each. The vacant
property is approximately across from where Corporate Circle will
exit onto Hinesburg Road. It is zoned R4. The Zoning Board will
be reviewing this Monday, November 10, 1986 for a variance for
the frontage requirement.
4) ALVAREZ, 800 ALLEN ROAD
Dr. and Mrs. Alvarez and Mr. Irish propose to subdivide a 31,000
square foot lot from the 41 acre Irish Farm north of Allen Road.
This lot is located just north of the water tower. It will be
served by the 20 foot r.so.w. to the recently approved to the
Dewey Irish lot located south of the water tower. Water and
sewer will be extended from Harbor Ridge Road.
This is the lot that we suggested be subdivided at the same time
Dewey Irish subdivided the lot to the south. See Bill
Szymanski's comments regarding water, sewer and the road
extension.
