6) JOANN HOUGH - GARAGE - VARIANCE
This request is to construct a 26' x 28' garage such that it projects 25 feet into the required
30 foot rear yard setback requirement.
This property located at 46 Hinesburg Road lies within the R4 and C1 Districts. The
property is developed with a two (2) family dwelling with an attached garage.
CRITERIA REVIEW
1. There are no unique physical circumstances or conditions, including irregularity
narrowness or shallowness of lot size or shape, or exceptional topographical or other
physical conditions peculiar to the particular property. The unnecessary hardship is not
due to such conditions . It is created by the circumstances or conditions generally created
by the provisions of the zoning regulations in the neighborhood or district in which the
property is located. The lot may be irregular in shape but it does not prevent the applicant
from constructing the garage and meet the setback requirements.
2) Since there are no physical circumstances or conditions, there is a possibility that the
property can be developed in strict conformity with the provisions of the zoning regulations
and that the authorization of a variance is therefore not necessary to enable the reasonable
use of the property. The property is currently developed with a two (2) family dwelling
and attached garage. The proposed garage can be constructed without a variance.
3) The claimed unnecessary hardship has been created by the appellant. Since the garage
can be constructed without a variance, there is no hardship.
4) The variance, if authorized, will not alter the essential character of the neighborhood
or district in which the property is located, nor substantially or permanently impair the
appropriate use or development of adjacent property, nor be detrimental to the public
welfare.
5) The variance, if authorized, would not represent the minimum variance that would
afford relief and would represent the most modification possible of the zoning regulations
and of the plan.
All five (5) criteria have not been met. Staff recommends denial.

The South Burlington Development Review Board will hold a public hearing at the South
Burlington City Hail, Conference Room, 575 Dorset Street, South Burlington, Vermont on
Tuesday, December 7, 1999, at 7:30 P.M. to consider the following:
1) Application of JoAnn Hough seeking a variance from Section 25.00, Area, Density and
Dimensional Requirements, of the South Burlington Zoning Regulations. Request is for
permission to allow a 26' x 28' garage to project 25 feet into the 30 foot rear yard setback
requirement, 46 Hinesburg Road.
2) Application of Waste Systems International, Inc. seeking approval from Section 26.05,
Conditional Uses, of the South Burlington Zoning Regulations. Request is for permission to
operate an automobile repair and service use, 73 Ethan Allen Drive.
3) Final plat application of Healthy Living to amend an approved planned unit development
consisting of 96,800 square feet of general office and shopping center use in four (4)
buildings. The amendment consists of adding 2105 square feet of mezzanine space
(shopping center use) resulting in a total of footage of 98,905 square feet, 4 Market Street.
4) Application of Alexander H. & Phyllis P. Rose seeking approval from Section 26.05,
Conditional Uses, and Section 26.65, Multiple Structures and Uses on Lots, of the South
Burlington Zoning Regulations. Request is for permission to allow auto sales use in

LOWE'S - AMENDMENT TO PUD - SKETCH PLAN
-the applicant should submit an overall site plan
- the applicant should provide landscaping details for final plat submittal. The trash
compactor and the area on the west side of the building should be screened.
- the plan should include the location of exterior lights. The applicant should provide
exterior lighting details (cut -sheets).
-the stormwater management/wetland mitigation pond should be relocated so that it is

- staff recommends that an additional pedestrian crossing be provided across access

of -way to Dorset St. had to be upgraded to city standards. The applicant would prefer not
to do this, but staff feels it makes sense to access the other lots through the existing right-of-
way.
Ms. Goldberg said they could bring a portion of the road to city standard, but it wasn't
feasible beyond that. She indicated that they intend to connect to city sewer.
It was noted there is a 20 ft. easement for a rec path.
No other issues were raised.
6. PUBLIC HEARING: Application of JoAnn Hough seeking a variance from Section
25.00 Area, Density & Dimensional Requirements, of the South Burlington Zoning
Regulations. Request is for permission to allow a 26'a28' garage to project 25 ft. into
the 30 ft. rear yard setback requirement, 46 Hinesburg Rd:
Mr. Belair said it is staffs feeling that there is room to put the garage where it will not violate
the setback.
Dan Girard, a neighbor, noted that Dick Ward had called the back of the duplex a side yard.
Mr. Belair said it doesn't make a difference if it's a side or rear yard, but he is calling it a rear
yard.
Mr. Hough noted that other neighbors use part of the space for one their three vehicles.
Members said they wanted the garage at least 10 ft. from the property line.
Mr. Belair suggested the applicant withdraw and come back with a request that is 10 ft. from
the chain link fence.
The applicant withdrew the application at this point.
7. PUBLIC HEARING: Final Plat application of Healthy Living to amend an approved
planned unit development consisting of 96,800 sq. ft. of general office and shopping
center use in 4 buildings. The amendment consists of adding 2015 sq. ft. of mezzanine
