Mr. Burgess noted they are landscaping due to $30,000 the Dorset Street project. asking for credit for existing worth of plantings put in as part of Members felt this was acceptable. Mr. Chattman noted there will be an oil tank buried on the site. Mr. Austin moved the Planning Commission approve the site plan application of South Burlington School District to construct a 640 sq. ft. boiler room addition to South Burlington High School, 550 Dorset Street, as depicted on a plan entitled "Site Plan, City of South Burlington School Department, Dorset Street, South Burlington, Vermont 05403, City of South Burlington, Vermont," Prepared by Brooks Land Surveying, Inc, dated April 7, 1995, with the following stipulations: 1. All previous approvals and stipulations which are not super- seded by this approval shall remain in effect. 2. The Planning Commission approves a landscaping credit of $1050 for the landscaping planted as part of the Dorset Street recon- struction. 3. All new exterior lighting shall consist of downcastinq shielded fixtures so as not to cast light beyond the property line. Any change in existing or proposed lighting shall be approved by the City Planner prior to installation. 4. The applicant shall obtain a zoning permit for the addition within six months or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy Com- pliance from the Administrative Officer prior to occupancy of the addition. 6. Sketch plan application of Lionel Sicotte for the subdivision of a 1.6 acre lot with a 2 family dwelling into 2 lots, 44-46 Hinesburg Road: Mr. Burgess noted the Zoning Administrator has ruled that because neither lot will meet frontage requirements, there will have to be a variance. Mr. Perry located the property just past Gracey's Store. There PLANNING COMMISSION 25 APRIL 1995 PAGE 6 is a paved driveway which goes into these lots. Mr. Perry gave members a copy of the tax map showing a number of smaller lots in the Heath Acres development. The property is not taxed as 5 separate lots including the road lot and garage lot. The plan is to divide the lots across the road with the hope that the road would not be opened up but would access the parcel. The Zoning Administrator has said they will have to count frontage on Hinesburg Rd. and Heath St. which don't meet requirements. They will also need a variance for rear yard setbacks to help line up the properties. Mr. Weith noted the lots had been merged because they are contiguous, nonconforming lots and are thus merged by definition. He said he had no problem with what is proposed but suggested the final plat show all proposed and existing easements. Members raised no issues. 8. Sketch plan application of Judge Development Corporation to 1) raze a 9312 sq. ft. theater containing 600 seats, 2) construct a 35,000 sq. ft. 2-story retail building, and 3) adjust a property boundary with the adjacent Anchorage Motor Inn property, 100 Dorset Street: Ms. Lindsey said a 25 ft. setback would continue the landscaping theme. The entrance to the building would be on the east side. The proposed boundary line adjustment with the Anchorage Inn would open up the bottleneck and give them more frontage. The proposed building would be built around the Phone Co. hut. Mr. Judge said they are looking for guidance and are very flexible. He said the proposed tenant is also flexible within the proposed dimensions. Mr. Weith said that staff had talked about the 25 ft. setback which is only half of the requirement and felt they would like the building up close to Dorset St. with parking in back. They feel it would be more in keeping with what the city is trying to do on Dorset St. Mr. Judge said the proposed building would be 2 stories with escalators and elevators. Mr. Burgess said that the plan takes Corporate Way and turns it into a parking lot. This is where the city wants development. Mr. Judge acknowledged that this is correct. He said he would prefer to build on Corporate Way but until the street goes through, that isn't possible. He felt that having an anchor store such as the one being proposed, development on Corporate Way may be possible. This property located at 44-46 Hinesburg Road lies within the Cl and R4 Districts. It is bounded on the north by single family residences and a restaurant, on the east by residences and Heath Street, on the south by residences and on the west by residences, a retail building and Hinesburg Road. Access: Access to lot #1 is via an existing driveway to Hinesburg Road serving the existing two (2) family dwelling. Access to lot #2 will be via a driveway to Heath Street. Lot size/frontage: Proposed lot sizes have not been provided. It appears that lot #1, which is developed with a two (2) family dwelling, will meet the 12,000 square foot minimum lot size requirement. Lot #2 appears to meet the 9,500 square foot lot size requirement. Neither of the proposed lots meet the 100 foot frontage requirement along Hinesburg Road nor the 80 foot frontage requirement along Heath Street. JUDGE DEVELOPMENT CORPORATION - RETAIL BUILDING - SKETCH PLAN This project consists of: 1) razing a 9,312 square foot theater building containing 600 seats, 2 ) construct a 35,000 square foot 2- story building for retail use and 3) adjust a property boundary with the adjacent Anchorage Motor Inn property on a site containing a 41,959 square foot retail/office building. The ZBA on 3/27/95 granted the applicant a conditional use permit allowing the regulations for the Cl District to be extended 50 feet beyond the district line into the CD1 District on land located at 2 Corporate Way. The reason the applicant did this was to obtain four (4) acres within the C1 District to quality for a PUD. The last review of this property by the Planning Commission was on 6/22/93 (minutes enclosed). This property located at 100 Dorset Street lies within the Cl District. It is bounded on the north by a commercial building used for personal service and retail, on the east by Ramada Inn, on the south by Anchorage Motor Inn and on the west by Dorset Street. Access/circulation: Access is via a 30 foot curb cut on Dorset Street opposite the Chittenden Bank access drive at a signalized intersection. There are also two (2) secondary access drives to the Greer property to the north. The applicant has previously recorded a legal agreement which requires the applicant to provide an access easement to the Greer property when the Greer's provide the applicant with a similar access easement. A 24 foot wide curb cut is proposed on Corporate Way. Circulation is adequate. Access: Access to lot #1 is via an existing driveway to Hinesburg Road serving the existing two (2) family dwelling. Access to lot #2 will be via a driveway to Heath Street. Plat should show an access easement across lot #2 to the Blanchette and Brown properties with metes and bounds if the applicant wishes to provide a legal access to these two (2) properties. Lot size/frontage: Lot #1 will meet the 12,000 square foot minimum lot size requirement for a two (2) family dwelling. Lot #2 will meet the 9,500 square foot lot size requirement. Neither of the proposed lots meet the 100 foot frontage requirement along Hinesburg Road nor the 80 foot frontage requirement along Heath Street.
