HomeMy WebLinkAboutVR-95-0000 - Decision - 0044 0046 Hinesburg Road (2)d STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON vR , v ppd DECISION AND FINDING OF FACT On the 22nd day of May, 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Lionel Sicotte, 44-46 Hinesburg Road, this meeting was also attended by Attorney Robert Perry. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned R-4 District. 2) Section 25.00 requires a minimum frontage of 85 feet. 3) The proposed subdivision will create two (2) lots with 50 feet. One lot fronting on Hinesburg Road and the other off Heath Street. 4) The property contains 1.6 acres with a maximum density of six (6) units. 5) Land development consists of a duplex unit. 6) Future land development would be a second duplex unit. 7) Due to lot configuration a variance is requested for the development of lot #2. Conclusion 1) This subdivision was created in 19301s, all lots were set-off 50'x 100' and fronted on Clark Street. 2) This subdivision was abandoned in the early 1960's and lots were purchased by the applicant. 3) The applicant developed the property with a duplex and a second duplex is proposed. 4) The hardship was created by others, the subdivision was never completed. 5) The lots in question pre-exist zoning by-laws. 1 6) Five lots were purchased by the applicant and have since merged. 7) Subdivision does not alter the character of the neighborhood. 8) Lots were small and irregular and would require a variance prior to development. Based upon the findings and conclusions setforth above, the Zoning Board of Adjustment hereby grants the applicants request for a variance to create two lots w' h fif (50) foot frontage located at 44-46 Hinesburg R d, tipuWigns, Chairman, South Burlington Zoning Board of Adjustment JUN 12 M 2
