Re: Findings of Fact, application of Lionel Sicotte to subdivide
70,192 square feet of land with an existing duplex into two (2)
lots of 40,090 square feet and 30,102 square feet, 44-46 Hinesburg
Road.
On the 13th day of June, 1995, the South Burlington Planning
Commission approved the request of Lionel Sicotte for final plat
approval under Section 202 of the South Burlington Subdivision
Regulations based on the following findings:
1. This project consists of the subdivision of a 1.61 acre parcel
with a two (2) family dwelling into two (2) lots of 0.91 acres (lot
#1) and 0.69 acres (lot #2).
2. Access: Access to lot #1 is via an existing driveway to
Hinesburg Road serving the existing two (2) family dwelling.
Access to lot #2 will be via a driveway to Heath Street.
3. Lot size/frontage: Lot #1 will meet the 12,000 square foot
minimum lot size requirement for a two (2) family dwelling. Lot #2
will meet the 9,500 square foot lot size requirement.
4. Neither of the proposed lots meet the 100 foot frontage
requirement along Hinesburg Road nor the 80 foot frontage
requirement along Heath Street. The ZBA on 5/22/95 granted the
applicant a variance from the frontage requirements.
5. Setbacks: The proposed boundary line between lots #1 and #2
must be at least 30 feet from the two (2) family building and the
garage to meet the rear setback requirement. The ZBA on 5/22/95
granted a variance from this requirement.
6. Sewer: The sewer allocation being requested for lot #2 is 600
gpd. The sewer allocation fee will be required to be paid prior to
permit issuance.
7. Impact fees: The applicant was made aware that road, school
and recreation impact fees will be assessed for any development on
lot #2.
DECISION & CONDITIONS
Based upon the above Findings of Fact, the South Burlington
Planning Commission approves the final plat application of Lionel
Sicotte to subdivide 70,192 square feet of land with an existing

duplex into two (2) lots of 40,090 square feet and 30,102 square
feet, 44-46 Hinesburg Road, as depicted on a plan entitled "Plat of
Survey Showing Proposed Subdivision for Lionel R. Sicotte in the
City of South Burlington, Vermont", prepared by Harold Marsh, dated
May 6, 1995, last revised 6/2/95, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. A sewer allocation of 600 gpd is granted for lot #2. The
developer of this lot will be required to pay the per gallon fee
prior to issuance of a zoning permit.
3. The final plat plan shall be recorded in the land records
within 90 days or this approval is null and void. The plan shall
be signed by the Planning Commission Chairman or Clerk prior to
recording.
4. Any deed transfer of property shall contain a reference to the
Planning Commission approvals dated 6/13/95 and Zoning Board
approval of 5/22/95.
