HomeMy WebLinkAboutSD-10-35 - Decision - 0114 Highland Terrace#SD-10-33 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING GARDNER CONSTRUCTION- 22 & 30 HIGHLAND TERRACE FINAL PLAT APPLICATION #SD-10-35 FINDINGS OF FACT AND DECISION Gardner Construction, Inc. is seeking final plat approval to amend a previously approved three (3) lot subdivision. The amendment consists of connecting two (2) of the lots to the City's sewer system in place of on -site septic systems, 22 & 30 Highland Terrace. The Development Review Board held public hearings on December 7, 2010, January 4, and May 17, 2011. Brad Gardner represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. Gardner Construction, Inc. is seeking final plat approval to amend a previously approved three (3) lot subdivision. The amendment consists of connecting two (2) of the lots to the City's sewer system in place of on -site septic systems, 22 & 30 Highland Terrace. 2. The owner of record of the subject property is Gardner Construction Inc. 3. The application was received on November 12, 2010. 4. The subject property is located in the Southeast Quadrant Zoning District. 5. The plans submitted consist of a two (2) page set of plans, page one (1) entitled "Site Plan Gardner Construction Inc, Revision to ww-4-2773 for Connection to Municipal Sewer Highland Terrace South Burlington, VT", prepared by McCain Consulting Inc, dated 4/26/11. The applicant is seeking to connect the proposal to municipal wastewater rather than on -site septic. The Director of Public Works has reviewed the plans and has stated that they are acceptable. The only comment is that the applicant shall provide a mechanism for monitoring wastewater usage for sewer billing. Most wastewater billing is based on water usage; as the subject property will be utilizing well -water, the property will require a separate meter. I91x6164IQ I, Motion by Gavle Quimby, seconded by Roger Farley, to approve Final Plat Application #SD- 10-35 of Gardner Construction Inc, subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect except as amended herein. CADocuments and Settings\Mark C. This project shall be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall propose and install a mechanism for monitoring sewage usage. This mechanism must be approved by the Director of Public Works and installed prior to occupancy of the residence. 4. Any changes to the final plat plan shall require approval of the South Burlington Development Review Board. 5. The final plat plan (sheet 1 of 2) shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the South Burlington GIS Coordinator.
