This project involves a minor boundary line adjustment between the Hendley's and Kwon's, as well as the dissolving of an existing 30' ROW easement and the creation of a new 65' x 65' ROW easement. The owners have prepared some preliminary easement language, but would prefer to wait on the expense of an attorney drafting the final deed and easement language until the application is at least preliminarily approved. Cc: WCE file #13037 Proposed Boundary Adjustment between Hendley Propert and Kwons Property 1. This proposed easement is in conjunction with a proposed property boundary line adjustment as shown on the attached plan. The boundary adjustment involves the exchange of two approximately equal areas, 0.32 acres each, more or less, in triangular shapes, for the purpose of ensuring that Hendley's existing driveway is located entirely within Hendley's revised property boundary. 2. As part of this boundary line adjustment, the Hendley relinguishes the existing 30 feet ROW along the existing north -south boundary line between the Kwon and Hendley properties. 3. As part of this boundary line adjustment, Hendley grants to Kwon a 65 feet by 65 feet, more or less, ROW and easement as shown in the proposed plan, to benefit the Kwon property for the purpose of accessing from and to Highland Terrace including future development of Kwon property and providing easement for installing and maintaining, underground and/or above -ground, utilities as necessary to serve the Kwon property. Utilities to typically include water, sewer, stormwater, electrical, gas, and communication services. Hendley also grants to Kwon that the ROW and easement are assignable to Kwon's heirs, future buyers of Kwon's property in part and/or as a whole, as well as Kwon's contractors as necessary. 4. The final ROW and easement language will be determined by the attorneys of both sides upon approval of this proposed boundary line adjustment plan. This list has been prepared by Soon K.
