MINOR LOT LINE ADJUSTMENT APPLICATION #AD-14-01
FINDINGS OF FACT AND DECISION
Soon Kwon, hereinafter referred to as the applicant, is seeking approval for a minor
boundary line adjustment between 10 & 20 Highland Terrace.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the follow:
FINDINGS OF FACT
1. The applicant is seeking approval for a minor boundary line adjustment between 10 &
20 Highland Terrace.
2. The owners of record of the subject properties are Soon & Mikyung Kwon (20
Highland Terrace) and Edith Hendley (10 Highland Terrace).
3. The subject properties are located in the SEQ Zoning District.
4. The application was received on June 5, 2014
5. The plat submitted is entitled, "Proposed Plan of Lot Line Adjustment & Easement
Establishment", prepared by Wilson consulting Engineers, PLC, dated February, 2014.
DIMENSIONAL REQUIREMENTS
6. All area and dimensional requirements will continue to be met for all two (2) lots
involved.
PURSUANT TO SECTION 15.19(B) OF THE LAND DEVELOPMENT
REGULA TIONS;
7. NO NEW LOTS ARE CREATED THROUGH THIS ADJUSTMENT.
The boundary line adjustment between the lots involved will not result in the creation of
any new lots. The boundary line adjustment involves the exchange of 0.32 acres from
20 Highland Terrace to 10 Highland Terrace and the exchange of 0.32 acres from 10
Highland Terrace to 20 Highland Terrace. The result being that there will no change in
the lot size of either lot.
8. THE SALE OR EXCHANGE OF PARCELS OF LAND IS BETWEEN ADJACENT
PROPERTY OWNERS.
The lot line adjustments will be between adjacent property owners.

9. THE RELOCATION OF THE LOT -LINE DOES NOT RESULT IN THE CREATION
OF A NON -CONFORMING LOT, STRUCTURE OR USE.
Lots are in conformance with the City of South Burlington Land Development
Regulations, Article 15 Subdivision and Planned Unit Development, Section 15.19 Minor
Lot Line Adjustments.
10. THE PROPOSED CHANGE DOES NOT VIOLATE ANY CONDITIONS IMPOSED
FROM PRIOR MUNICIPAL APPROVAL.
This lot line adjustment does not violate any conditions of prior approval.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves Minor
Lot Line Adjustment Application #AD-14-01 of Soon Kwon, for a boundary line
adjustment between 10 Highland Terrace and 20 Highland Terrace subject to the
following conditions:
All previous municipal approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. This project shall be completed as shown on the plat and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
4. The final plat plan shall be recorded in the land records within 180 days or this
approval is null and void. The plan shall be signed by the Administrative Officer prior
to recording. Prior to recording the final plat plan, the applicant shall submit a copy
of the survey plat in digital format. The format of the digital information shall require
approval of the South Burlington GIS Coordinator.
5. Any change to the plat plan shall require approval by the South Burlington
Development Review Board or the Administrative, (Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision
by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
