The applicant proposed to subdivide the existing parcel into two lots. Lot 1 will retain the
existing house. Lot 2 will be a new building lot. A 20' shared access easement from Heath
Street is proposed to access Lot 2. Municipal utility connections will be used.

Plat plans shall be submitted which shows the information required by the City's Land Development
Regulations. Five (5) regular size copies, one reduced copy (11" x 17"), and one digital (PDF-format)
copy of the plans must be submitted. The application fee shall be paid to the City at the time of

property owners, in accordance with 24 V.S.A. §4464(a) and Section 17.06(B) of the South Burlington
Land Development Regulations, is the responsibility of the applicant. After deeming an application
complete, the Administrative Officer will provide the applicant with a draft meeting agendas or public
hearing notice and sample certificate of service. The sworn certificate of service shall be returned to the
City prior to the start of any public hearing.

The sketch plan application that you recently submitted was reviewed at a recent Planning & Zoning
staff meeting. It was a consensus of the staff that the Land Development Regulations (LDRs) would not
allow the approval of the subdivision. The reason by for this is that your lot has insufficient road
frontage.
Section 3.05 (C) of the LDRs states as follows:
C. Road Frontage. In order to promote infill development while protecting the character of
existing neighborhoods, no lot shall be created without a minimum of 50-ft of frontage on'a
public road in the following districts: R1, R1-LV, R2, R4, and LN
Your property is located within the R4 zoning district so it is subject to this provision which requires each
of the new lots you create to have at least 50 ft. of frontage along Heath Street which means you would
need at least 100 ft. of frontage to begin with. Your sketch plan indicates that you only have 52.14 ft. of
frontage which is not sufficient to comply with the road frontage requirement of 50 ft. for each new lot.
At this point your options would be withdraw the application in which case we would provide you with a
full refund or proceed with the application to the Development Review Board, but again, they would not
have the authority to approve it due to the insufficient amount of road frontage.
