Associate Planner Cathyann LaRose and Administrative Officer Ray Belair, referred to herein as staff, reviewed the plan submitted on April 9, 2008 and have the following comments. ACCESSORYRESIDENTIAL UNITS Pursuant to Section 3.10(E)(1) of the proposed Land Development Regulations, in any district where a single-family residence is a principal permitted use, one (1) accessory residential unit within or attached to a primary single-family residence or within an existing, permitted accessory structure may be permitted by the DRB in accordance with Article 14, Site Plan Review, and the following additional criteria: (a) Floor space of the accessory residential unit shall not exceed thirty percent (30%) of the total habitable area of the single-family dwelling unit. The single family dwelling unit is 5611 SF. This includes the finished basement and the proposed accessory apartment. The accessory residential unit is proposed to be 1284 SF, or 22.9% of the habitable area of the principal dwelling. Thus, the applicant is in compliance with this criterion. (b) The principal dwelling shall be owner occupied. At this time, the subject property is under construction and owned by a development company who does not live in the home. No occupancy of the accessory unit shall take place until the land owner is the occupant of the principal dwelling unit. The principal dwelling unit must be owner occupied. 1. The principal dwelling shall remain owner -occupied. (c) Adequate wastewater capacity is available to service the accessory unit, as demonstrated by the issuance of a Wastewater Allocation or on -site wastewater permit pursuant to the South Burlington Sewage Ordinance. 2. The applicant shall apply for wastewater allocation. (d) Two additional off-street parking spaces shall be provided on the same lot, either in a garage or a driveway, or not in any areas required to meet coverage limitations, or any front yard other than a driveway, required by these Regulations. The subject property contains a 3-car garage and ample driveway space. This is sufficient to satisfy this requirement. (e) A zoning permit shall be required for the accessory residential unit. CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING 3. The applicant shall obtain a zoning permit from the Administrative Officer for the accessory residential unit. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. There is adequate consideration given to pedestrian movement and parking on the site. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. Parking is to the front and side of the building. However, given that the nature of the project as a single-family residential use, staff finds this layout acceptable and in harmony with the rest of the neighborhood. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. The height of the existing home is within the limits specified by the SBLDR. No exterior construction is planned. (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. The applicant has not proposed any additional lighting as part of this application. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. The principal residential dwelling and accessory unit are in compliance with this criterion. (>) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. The principal residential dwelling and accessory unit are in compliance with this criterion. Site plan applications shall meet the followina specific standards as set forth in Section 14.07 of the South Burlington Land Development Regulations: (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. CITY OF SOUTH BURLINGTON 4 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING Staff does not feel it is necessary to require any additional access easements as part of the proposed project. (b) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). As the subject building is a single family residence, staff understands that trash will be maintained inside the building until time for trash pickup. Traffic This project will not generate a sufficient amount of traffic to warrant concern or further review. Staff recommends that the Development Review Board approve Site Plan application #SP-08-26 subject to the conditional items above. Miscellaneous application #MS-08-02 of Mark Kelley to construct a 437 sq. ft. addition to an existing dwelling with an 876 sq. ft. footprint, 66 Bartlett Bay Road: Mr. Fitzpatrick said they are withdrawing the request for a height waiver and will comply with the 25 foot height limit. Residents said they would like to see what is proposed. Mr. Dinklage said the DRB does not control single family homes unless waivers are required. He noted that an L-shaped addition is being proposed. Mr. Bruhn said the neighbors are concerned because there was a lot of surprise when the house across the street was built by Mr. Kelley. Mr. Belair said the addition proposed is 437 sq. ft., which is within the regulations. Mr. Dinklage added there is no incursion toward the lake. Mr. Stone asked where they will be parking cars. Ms. Sullivan said there is a 2-car garage in the addition and 2 parking spaces out front. Mr. Belair said the stipulations will be revised to remove the height waiver. Ms. Fox asked if there will be a written decision. Ms. Brown said neighbors will get a copy of the decision if they signed the attendance sheet. Miscellaneous application #MS-08-03 of Marcel Beaudin to amend a previously approved Plan for the reconstruction of a single family dwelling. The amendment consists of revising the location and dimensions of a deck, 5 Lyons Road: Mr. Beaudin said they had planned to salvage the existing decks, but found they were rotted beyond saving. Changes were thus made. Mr. Belair said staff had no issues. Ms. Quimby moved to approve Miscellaneous Application #MS-08-03 of Marcel Beaudin subject to the stipulations in the draft motion. Motion passed unanimously. l� Site Plan Application #SP-08-26 of Allen Road Land Company for an accessory residential unit, 78 Haymaker Lane: DEVELOPMENT REVIEW BOARD 6 MAY 2008 Ms. Dufresne said the house is under construction and they want to provide an accessory apartment in the building. Mr. Dinklage noted the stipulation that the home must be owner -occupied. Ms. Dufresne said there will be private stairs from the garage to the attic apartment. Mr. Dinklage noted there can be no exterior construction for the apartment unit. Ms. Quimby moved to approve Site Plan Application #SP-08-26 of Allen Road Land Company subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. 11. Continued Preliminary Plat Application #SD-08-17 of Sierra Pacific II to amend a planned unit development consisting of 210 residential units, a 61 room hotel, a 20,000 sq. ft. movie theater building (1000 seats), a 22,500 sq. ft. restaurant/ medical office/day care building, a 3500 sq. ft. restaurant with drive -through service, and a bank with drive -through service. The amendment consists of: 1) constructing a 4000 sq. ft. addition to the building a 7 Fayette Drive and 2) converting 17,900 sq. ft. of restaurant and indoor recreation use to retail use, 7 Fayette Drive: Mr. Plumeau stepped down due to a conflict of interest and left the meeting at this point. Sean Carroll said they have done the technical traffic review and feel they have met all the concerns. Mr. Belair said the traffic consultant is reviewing the last version of the report. Mr. Belair noted there is a long list of waivers being requested. Ms. Desautels said they are encroaching into the stream buffer by 1 foot, 3 inches ( she noted this is an existing condition and was not approved, but the stream may have moved since the building was built). In addition, part of the drive is in the stream buffer, the proposed canopy encroaches into the setback on Fayette Road, the addition encroaches 4 feet into the setback, and the utility cabinet is within the 30-foot front setback. Mr. Belair said staff had no problems with these waivers. Mr. Dinklage noted the curb cut is being widened beyond the regulations. Mr. Carroll said it facilitates access to the rear parking spaces which are rarely used now. Mr. Dinklage questioned potential pedestrian/vehicle conflicts in that wide area. Ms. Desautels said the only way to make it safe is to widen the curb cut. Mr. Belair said it is still a very open area if you are just walking by. Mr. Dinklage asked about the retaining wall. Ms. Desautels said it is to encourage people to park in the underground parking by drawing attention to the area. This permit may be revolted if it is determined that the project does not comply with these Rules. The project is approved for a maximum of 610 gallons of water per day. No changes to the water supply shall be allowed without prior review and approval by the Wastewater Management Division. :.WASTEWATER DISPOSAL 3.1 This project is approved for connection to the South Burlington municipal wastewater treatment facility as depicted on the approved plans. The project is approved for a maximum of 350 gallons of wastewater per day. No changes to .the wastewater disposal system shall be allowed without prior review and approval by the Wastewater Management Division. 3.2 This permit is based, in part, on a municipal approval for connection to their wastewater treatment facility. If the municipal approval expires, and the municipality files a written request with the Secretary, the Secretary will remove the sewage allocation for this project from the list of committed reserve capacity. If the municipal approval expires, this permit shall be invalid unless the municipality renews its approval and does not request that the Secretary remove the sewage allocation for this project from the list of committed reserve. Once the project is removed from the list of committed reserve capacity, a new permit must be issued for the project. An updated application form and an application fee will be required.
