Re: Findings of Fact, application application of Alan and Maureen Pidgeon to subdivide a 29.3 acre
parcel into two (2) lots of 19.3 acres and 10.0 acres, Berard Drive and Airport Parkway.
On the 24' day ofNovember, 1988, the South Burlington Planning Commission approved the request
of Alan & Maureen Pidgeon for final plat approval under Section 204 of the South Burlington
Subdivision Regulations based on the following findings:
1. This project consists of subdividing a 29.3 acre parcel into two (2) lots of 10.0 acres (lot A) and
19.3 acres (lot B). The preliminary plat was approved on 3/24/98.
2. This property located on Berard Drive and Airport Parkway lies within the IC District, the C.O.
District, the Floodplain Overlay District and the Airport Approach Zone. It is bounded on the
north by the Winooski River and undeveloped land, on the south by commercial and industrial lots
along Berard Drive and Airport Parkway, on the west by Berard Drive and a commercial lot, and on
the east by residences and Airport Parkway.
3. Access: Access will be provided to lot A along Berard Drive and to lot B by Airport Parkway.
The r.o.w. serving the land to north of lot "A" should be a minimum of 20 feet in width. The note
on the plat referring to the r.o.w. should be revised to read "Right-of-way for GMP and owner of
property to the north." Staff recommended a condition of approval that the easement language for
this r.o.w. be submitted to the City Attorney for approval.
4. Lot size/fronta-ge: Both lots will meet the minimum lot size requirement of 40,000 square feet.
5. Lot A will meet the minimum frontage requirement of 120 feet on Berard Drive. Lot B will meet
the minimum frontage requirement of 200 feet on Airport Parkway.
6. Wetlands: Wetlands on the property have been delineated. The final plat shows the C.O.
District/wetland buffer (50 feet from the edge of the wetland) along all the wetlands on the property.
This was a requirement of preliminary plat approval.
7. Sewer: No sewer allocation requested.
8. Property owner approval: A letter was received from the property owner indicating his approval
to allow the applicants to act as his agent,

DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission approves the final
plat application of Alan and Maureen Pidgeon to subdivide a 29.3 acre parcel into two (2) lots of 19.3
acres and 10.0 acres, Berard Drive and Airport Parkway, as depicted on a two (2) page set of plans,
page one (1) entitled, "Alan & Maureen Pidgeon South Burlington Vermont," prepared by Harold
N. Marsh, dated October, 1998, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. The plat plans shall be revised to show the changes below and shall require approval of the
Director of Planning & Zoning. Three (3) copies of the approved revised plans shall be submitted
to the Director of Planning & Zoning prior to recording.
a) The survey plat plan shall be revised to change the note referring to the r.o.w. to read
"Right-of-way for GMP and owner of property to the north."
b) The survey plat plan shall be stamped by the land surveyor.
c) The survey plat plan shall be revised to identify the 10 acre lot as lot "A" and the remaining
lands as lot `B".
d) The survey plat plans shall be revised to correctly show the lot lines in the vicinity of the
Berard Drive cul-de-sac. The eastern property line may be shifted to the east if necessary to
maintain a minimum 10 acre lot.
3. The easement language for the 20 foot r.o.w. shall be submitted to the City Attorney for approval
and shall be recorded prior to recording the final plat plans.
4. Any change to the final plat plans shall require approval by the South Burlington Planning
Commission.
5 . The final plat plans shall be recorded in the land records within 90 days or this approval is null
and void. The plans shall be signed by the Planning Commission Chair or Clerk prior to recording.
Prior to recording the final plat plans, the applicant shall submit a copy of the survey plat in digital

format. The format of the digital information shall require approval of the Director of Planning &
Zoning.

Trust and Berard, June A. Revocable for subdivision of an approximate 19.3 acre parcel into two(2)
lots of 3.6 acres and 15.7 acres, Berard Drive.
On the 15`' day of December, 1998, the South Burlington Planning Commission approved the request
of Noyes, Berard, Kitty Trust & Baldwin, Cherie A. Trust and Berard, June A. Revocable for
preliminary plat approval under Section 203 and final plat approval under Section 204 of the South
Burlington Subdivision Regulations based on the following findings:
1. This project consists of subdividing a 19.3 acre lot into two (2) lots of 3.6 acres and 15.7 acres,
Berard Drive and Airport Parkway. The sketch plan was reviewed on 11/24/98.
2. This property located on Berard Drive and Airport Parkway lies within the IC District, the C.O.
District the Floodplain Overlay District and the Airport Approach Zone. It is bounded on the north
by the Winooski River and undeveloped land, on the south by commercial and industrial lots along
Berard Drive and Airport Parkway, on the west by Berard Drive and a commercial lot, and on the
east by residences and Airport Parkway.
3. Access: Lot B has frontage along Airport Parkway. No access is proposed at this time. Lot C
has no frontage on a public street. It will be served by a 20 foot r.o.w. from Berard Drive.
4. Lot size/frontage: Both lots will meet the minimum lot size requirement of 40,000 square feet.
5. Lot B will meet the minimum frontage requirement of 200 feet on Airport Parkway. Lot C has
no frontage and will be served by a r.o.w.
6. Wetlands: Wetlands on the property have been delineated. The plan submitted for sketch plan
showed the C.O. District/wetland buffer (50 feet from the edge of the wetland) along the wetlands
on the property. This plan was not submitted with the final plat submittal.
7. Sewer: No sewer allocation requested.

DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission approves the
preliminary and final plat applications of Noyes, Berard, Kitty Trust & Baldwin, Cherie A. Trust and
Berard, June A. Revocable for subdivision of an approximate 19.3 acre parcel into two(2) lots of 3.6
acres and 15.7 acres, Berard Drive, as depicted on a plat entitled "Plat of Survey Showing A Portion
of Lands of Rene J. Berard, Et. Al. City of South Burlington, Vermont," prepared by Harold N.
Marsh, dated November, 1998, with the following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect.
2) The plat plans shall be revised to show the changes listed below and shall require approval of the
Director of Planning & Zoning (hereinafter Director). Three (3) copies of the approved revised plat plans
shall be submitted to the Director prior to recording.
a) The survey plat plan shall be revised to include the stamp and signature of the land surveyor.
b) A plan shall be submitted which shows all of lots B and C.
3) The easement language for the 20 foot r.o.w. shall be submitted to the City Attorney for approval and
shall be recorded prior to recording the final plat plans.
4) Any change to the final plat plans shall require approval by the South Burlington Planning
Commission.
5) The final plat plan shall be recorded in the land records within 90 days or this approval is null and void.
