STIPULATIONS AND/OR FINDINGS OF FACT 4p p
TOWNHOUSES AT TIMBERLANE 0
For -the Final plat application of O'Brien Bros. Agency, Inc. for (1) a
one -lot subdivision of 17.25 acres at the end of Timberlane, and (2) a 120 unit
condominium complex to be located on said parcel, both as depicted on a plan,
with 7 pages of drawings, entitled "Townhouses at Timberlane", last revised
3/11/80, prepared by Wiemann-Lamphere, Architects.
Stipulations:
1) The gravel access road shall be maintained and plowed by the applicant so as
to be accessible to emergency vehicles year-round.
2) Plans and profiles for the extension of the street and sidewalk to Twin Oaks
shall be provided prior to the issuance of the first building permit.
3) Upon development of the property to the east, the subsequent developer shall
connect to the terminum point of the street and sidewalk as depicted on the plat
for the Townhouses at Timberlane development.
4) Construction of units shall be phased over at least a 30 month period with no
more than 48 units constructed in any given year.

6) A landscaping bond or equivalent surety in ttf-d- amount of $16,000 shall be
provided prior to the issuance of any building permits. Landscaping plans for
each cluster shall be submitted for approval prior to the issuance of building
permits for that cluster.
7) The 15 foot pedestrian easement shown on the final plat is an approximate
location. The actual easement shall be fixed when the walkway is constructed
and shall be located entirely within the 150 foot wide conservation district.
8) A bonding agreement or equivalent surety covering all street, water)sewer,
drainage and related improvements shall be provided for approval prior to the
issuance of the first building permit. b -Ae G

9) Sewer manholes A2 and A3 shall be provided with access for mobile sewer
cleaning equipment. No plantings shall occur in this area.
10) Road grave and road subgrade shall be approved by the City prior to place-
ment of road gravel.
11) The applicant shall submit to the State for review and approval of the
emergency sewage holding tank proposal.
12) Elevations at 100 foot intervals shall be added to the street profiles
for all proposed public streets.
13) Site detail plans shall be stamped by the project engineer.

15) The applicant shall upgrade the Timberlane pumping station as referenced
by the City Manager and as agreed to by the applicant in letters dated 3/11/80.
16) This approval expires if construction is not begun within ?ls months or
if construction is not completed within 32 years from this date.
