DECISION AND FINDING OF FACT
On the 28th day of April, 1997, the South Burlington Zoning Board
of Adjustment heard testimony regarding a conditional use
application of John P. Larkin, 16 Harbor View Road. Greg Rabideau
represented Mr. Larkin.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findinqs of Fact
The area in question zoned C-2 District.
The proposed construction is a four-story, forty eight (48)
unit congregate housing facility.
The property contains 1.02 acres with 175 feet of frontage and
is bounded by other care home facilities and
industrial/manufacturing uses.
Section 13.20 requires conditional use approval by the ZBA.
Site plan approval was granted by the Planning Commission on
February 11, 1997.
Conclusion
Proposed use is residential in nature and provides a buffer
from the industrial uses along the Harbor View Road area.
Other parcels adjoining this site are developed with similar
uses. General character of the area is protected.
No permit will be issued until sewer capacity is available.
Proposed use is expected to generate eight (8) vehicle trip
ends, impact fees at zero.

5) Landscaping, parking, coverage are in compliance.
Based upon the findings and conclusion setforth above, the Zoning
Board of Adjustment hereby grants the applicant's request to
construct a 48 unit congregate housing facility on a 1.02 acre
parcel located at 16 Harbor View Road.
