HomeMy WebLinkAboutSP-16-81 - Decision - 0020 Harbor View Road#SP-16-81 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING & ZONING JOHN LARKIN, INC. — 20 HARBOR VIEW ROAD SITE PLAN APPLICATION #SP-16-81 FINDINGS OF FACT AND DECISION John Larkin, Inc., hereinafter referred to as the applicant, is seeking site plan approval to amend a previously approved plan for a 21,012 sq. ft. 62 unit congregate care facility. The amendment consists of revising the parking layout to relocate three (3) parking spaces, 20 Harbor View Road. Based on the findings below, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking site plan approval to amend a previously approved plan for a 21,012 sq. ft. 62 unit congregate care facility. The amendment consists of revising the parking layout to relocate three (3) parking spaces, 20 Harbor View Road. 2. The owner of record of the subject property is John Larkin, Inc. 3. The subject property is located in the Commercial 2 Zoning District. 4. The application was received on December 13, 2016. S. The plan submitted is entitled, "Site Plan (for City Parking Space approval) Pillsbury Manor South 20 Harbor View Road — Lots 7 & 8 South Burlington, Vermont" prepared by Krebs & Lansing Consulting Engineers, Inc., dated 8/23/16, and last revised on 12-13-16. DIMENSIONAL REQUIREMENTS 6. All dimensional requirements will continue to be met. SITE PLAN REVIEW STANDARDS Only the standards below will are affected by this application. All other standards will continue to be met. Parking 7. A total of 90 parking spaces are required under the current parking requirements and 26 spaces are being provided including two (2) handicapped spaces. The number of spaces is not changing, just the layout from the previously approved #SP-16-81 plan to relocate three (3) spaces to provide adequate maneuvering room for fire apparatus. 8. A "compact car" sign is proposed to be placed in front of space #26. Compact car only spaces are not allowed so this sign must be removed from the plan. 9. The landscaping plan must be revised to reflect the revised parking layout. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan #SP-16-81 of John Larkin, Inc., based on the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and will be on file in the South Burlington Department of Planning and Zoning. 3. The site plan must be revised to show the changes below and will require approval of the Administrative Officer. Three (3) copies of the approved revised plan must be submitted to the Administrative Officer prior to permit issuance. a. The site plan must be revised to remove the notation for a compact only car sign and the compact car sign symbol. b. The site plan must be revised to include the landscaping plan so it shows the proposed revised parking layout. 3. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The Applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to the use of the new parking layout. 5. Prior to issuance of a zoning permit, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. 6. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board. /4 Signed on this /Y day of bZ4 2016 by J Rmond J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
