In response to;a request from your office, I would like to clarify
traffic volume estimates from my September 8, 1986 report for the Harbor
View Office Building. Through the date of that report, approvals had been
granted for 53 single-family and duplex units, 89,multi-family units, 3
mixed commercial buildings and a 200 room hotel and restaurant. Trip gen-
eration estimates are as follows :

In previous reports, I have estimated that 90% of commercial traffic,
50% of residential traffic and none of the hotel traffic will pass through
the key Route 7/Harbor View Road intersection. Total current estimated
traffic through this intersection is given in table 4 of the September,
1986 report.

Thanks for the copy of your memorandum regarding the setback from
the stream located to the rear of the office complex proposed for
lot 9, Harborview Road by L.T.H. Associates. Be advised that Mr.
Larkin has applied for a variance from the City Zoning
Regulations. Section 18.00 Dimensional requirements allows for a
setback of forty (40) feet from the front: property line. The
variance requested is for a twenty (20) foot setback. Having
discussed this request with the City Attorney, it is his opinion
that in no way should a variance be granted. He feels and I
agree that a request of this nature does not meet the criteria
setfor•th under Title 24, Chapter 117, Section 4468 V.S.A The
plan as originally submitted to and approved by the Planning
Commission was in total compliance with al.l dimensional require-
ments setforth by the City Zoning requirements.
Mr•. Larkin has been made aware of these facts and will continue
to pursue the appeal. The hearing is scheduled for June 8, 1987
at 7:00 P.M., meetings are conducted in the Conference Room at
City Hall. You may want, to attend that, hearing.
I have enclosed a copy of Seel- ,ion 4468 for your review. Should
you decide not to attend the hearing [ will forward a copy of the

MEMORANDUM

The hearing held on May 7, 1987 for the above referrenced
application is in recess. As a result of this first hearing
the District Environmental Commission requests receipt of
the following information:
1) The Commission is very concerned that the 2 to 6
foot buffer strip from the top of the streambank is not
adequate to maintain the natural condition of the
stream and may cause unreasonable soil erosion and
reduce the capacity of the land to hold water. The
recommendations of the Town and the Agency of
Environmental Conservation of a 50 foot buffer strip
measured from the centerline of the stream puts the
development within 2 to 6 feet of the top of the
streambank. The Commission feels that a much wider
buffer strip (25 to 35 feet) may be necessary in order
to maintain the stream and prevent unreasonable soil
erosion.
2) A certification from a registered engineor that the
erosion control plan contains site specific erosion
control measures necessary to provide a level of
protection at least equivalent to the procedures
outlined in the "Vermont Handbook for Soil Erosion and
Sediment Control on Construction Sites and that the
plan if followed will cause the project to meet the
technical requirements of the Vermont Water Quality
Standards.
3) Evidence that the project will not have an undue
adverse effect on historic sites should be included as
per Supplemental Pre -Hearing Comments of May 7, 1987
submitted by Mr. Emigh, Land Use Attorney.
4) Please provide a copy of the minutes of the South
Burlington Planning Commission meeting.
5) Additional evidence under Criterion 7 that indicate
present municipal services are available.
6) Please submit sign details if you wish to install a
sign at this time.
7) Land Use Permit #4C0526 requires that each amendment
application provide a cumulative impact statement which
specifically estimates the total number of estimated
trip ends per day generated by this project, please
provide such information.
Copies of any information, revised plans, etc., submitted
after the hearing must also be sent to all parties. This
includes the municipality, the regional planning commission
and individuals or organizations granted party status.
The District Environmental Commission is considering adding
at least the following conditions:
1) The Permittee shall establish a 30 foot buffer strip
along the top of the streambank. All earthwork,
construction and removal of vegetation is prohibited
within this buffer strip.
2) A professional engineer, or other qualified person
shall certify that the erosion control plan in the
application contains site specific erosion control
measures necessary to provide a level of protection at
least equivalent to the procedures outlined in the
"Vermont Handbook for Soil Erosion and Sediment Control
on Construction Sites", and that the plan if followed,
will cause the project to meet the technical
requirements of the Vermont Water Quality Standards.
3) The Permittee shall hire a professional engineer, to
assure that the contractors implement the certified
erosion control plans and shall send periodic and final
reports to the District Commission.
Upon request, the District Environmental Commission is
willing to hear written or oral arguments regarding these
conditions prior to incorportation into the permit.
