Re: Findings of Fact, application of John Larkin to amend a planned
residential development consisting of 97 multi -family units and 45
single family units, Bay Crest Road. The amendment is to remove as
a requirement of approval the installation of a breakaway chain
across the northern section of the driveway serving the four (4)
duplex buildings located at the corner of Bay Crest Road and Harbor
View Road.
On the 3rd day of March, 1998, the South Burlington Planning
Commission approved the request of John Larkin for revised final
plat approval under Section 204 of the South Burlington Subdivision
Regulations based on the following findings:
1. This project consists of amending a previously approved
planned residential development consisting of 97 multi -family units
and 45 single family units. The amendment consists of: 1)
modifying the size and shape of porches on duplex #1, 2, 3 and 4,
and 2) eliminating the condition requiring a chain/gate across the
access driveway along the northern boundary. The sketch plan was
reviewed on 8/12/97.
2. This property located on Bay Crest Road lies within the R2
District and the Spear Street - Ridge View Protection Zone. It is
bounded on the north and west by Bay Crest Road, on the east by a
City park and on the south by undeveloped land.
3. Access/circulation: Access is provided by two (2) curb cuts on
Bay Crest Road. No changes proposed. A previous approval required
that a chain/gate be installed across the access driveway along the
northerly boundary. This chain/gate has never been installed. The
applicant requested that the requirement for the chain/gate be
eliminated. Staff attempted to contact the two (2) adjacent
property owners who had requested that the chain/gate be erected,
however, they did not return staff's calls. They were sent an
agenda for Tuesday's meeting. Staff supported removal of the
requirement to install the chain.
Circulation on the site is adequate.
4. Coverage/setbacks: Building coverage is 19.4% (maximum allowed
is 20%). Overall coverage is 39.8% (maximum allowed is 40%).
All the porches meet the setback requirements with the exception of
the porch on duplex #3, unit B. This proposal would remove all
portions of the porch within the setback area.
5. Landscaping: No additional landscaping required based on
building costs.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the final plat application of John Larkin to
amend a planned residential development consisting of 97 multi-
family units and 45 single family units, Bay Crest Road. The
amendment is to : 1) modify the size and shape of porches on duplex
#1,2,3 and 4, and 2) remove as a requirement of approval the
installation of a breakaway chain across the northern section of
the driveway serving the four (4) duplex buildings located at the
corner of Bay Crest Road and Harbor View Road, as depicted on a
plan entitled, "Site Plan Harbor Meadow Condominiums Bay Crest So.
Burlington, Vermont," prepared by Krebs & Lansing Consulting
Engineers, Inc., dated 3/5/96, last revised 1/20/98, with the
following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The portion of the porch on duplex #3, unit B, which projects
into the 30 foot setback, shall be removed by June 1, 1998.
3. Any change to the site plan shall require approval by the South
Burlington Planning Commission.
4. The final plat plan shall be recorded in the land records
within 90 days or this approval is null and void. The plan shall
be signed by the Planning Commission Chair or Clerk prior to
recording.
