Findings of Fact, Conclusions of Law & Order
This matter came before the South Burlington Zoning Board of Adjustment on January 25, 1999 by
application of Ken Desmond, Tyler Hart represented Mr. Desmond for a conditional use to occupy an
existing 17,400 square foot building with a maximum of four (4) uses, located at 12 Gregory Drive
according to plans submitted. The Board of Adjustment finds as follows:
1) Area in question is zoned Industrial/Commercial Mixed District.
2) Section 26.65 requires Zoning Board approval as a condition use.
3) A maximum of four permitted uses are proposed by the applicant.
4) The structure contains 17,400 square feet and the lot contains 1.81 acres.
5) Traffic generated by the proposed uses complies with the overall vehicle trip ends allocated to
the Green Tree Park subdivision approvals.
6) The essential character of the area is not affected by the proposed uses.
7) Structure is connected to municipal services, allocations are approved.
8) No adverse impacts are expected to existing bylaws.
The conditional use approval to occupy an 17,400 square foot structure with a maximum of four (4)
uses at 12 Gregory Drive is hereby GRANTED
