Associate Planner Cathyann LaRose and Administrative Officer Ray Belair have reviewed the plans submitted on June 19, 2008 and have the following comments. This application shall be reviewed under Section 3.12 of the Land Development Regulations. The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other similar material in an amount equal to or greater than twenty (20) cubic yards, except when incidental to or in connection with the construction of a structure on the same lot, shall require the approval of the Development Review Board. The Development Review Board may grant such approval where such modification is requested in connection with the approval of a site plan, planned unit development or subdivision plat. This section does not apply to the removal of earth products in connection with a resource extraction operation. Standards and Conditions for Approval: (1) The Development Review Board shall review a request under this Section for compliance with the standards contained in this sub -Section 3.12(B). An application under Section 3.12(A) above shall include the submittal of a site plan, planned unit development or subdivision plat application showing the area to be filled or removed, and the existing grade and proposed grade created by removal or addition of material. The plan which has been submitted is acceptable. The proposed change in grade is clearly delineated on the plan. (2) The Development Review Board, in granting approval may impose any conditions it deems necessary, including, but not limited to, the following: (a) Duration or phasing of the permit for any length of time. The applicant has noted that this fill is used to improve the existing stormwater treatment areas. This is a permanent change and staff does not recommend a time limit on the removal of the fill. (b) Submission of an acceptable plan for the rehabilitation of the site at the conclusion of the operations, including grading, seeding and planting, fencing drainage, and other appropriate measures. The proposed location of the fill will result in improved stormwater treatment. Staff does not recommend any further action with regards to this criterion. Access/Circulation: Access to the back parking lot is provided by a 23 foot wide driveway off of Victory Drive and a 14 foot wide one-way driveway off of Williston Road. The one-way drive runs along the eastern side of the building. Circulation is provided on the east and north sides of the building by these driveways. Chief Goddette would like the 14 foot wide driveway increased to 20 feet so that he may have sufficient room to set./ up equipment. This would require waiving the City policy of a 5 foot buffer strip along property lines and also require decreasing the 4 foot sidewalk along the northeast corner of the building to 3 feet wide. Setbacks/Coverage: The existing building does not meet side yard setback requirements or lot coverage requirements. Existing building coverage is 14.2% and proposed building coverage is 18.3% (maximum of 20% allowed). Existing lot coverage is 43.7% and proposed lot coverage is 60% (maximum of 40% allowed). Parking: By applying the parking space standards for "places of assembly containing fixed seats" the building, including additions, requires 52 parking spaces. The plan shows 58 parking spaces. The plan shows 11 additional spaces in front of the building and an expanded gravel lot in back. Apparently, there is currently a parking problem experienced at the church, particularly on Sundays. Eleven new parking spaces are proposed in front of the building. This would require losing existing green space., Bill Szymanski would like the applicant to consider moving these 11 spaces to the green area in back of the building so as to maintain the existing aesthetic quality of the front yard. Landscaping: The proposed additions require $6000 in new landscaping. The proposed plan shows new Red Pine in the parking lot which values $900. There is sufficient landscaping in the front of the building, however, I feel more landscaping should be put in along the north and west property lines to properly screen the parking lot. The plan shows 18 spaces. This should be sufficient. Landscaping: The proposed building requires $1,500 in landscaping. The plan shows Norway Maple, Dogwood, Burning Bush, Juniper, Austrian Pine, Pin Oak and Spreading yew. The plan meets the required value. Traffic: This project is required to pay a contribution into the Williston Road Impact Area #1 improvement fund, which includes improvements to the Williston Road/Kennedy Drive/Airport Parkway intersection and the Kennedy Drive/Kimball Avenue intersection. Based on the 10 trip ends this project is expected to generate during the peak hour (ITE Trip Generation, 4th Edition), a $99 contribution will be required. The issue of money allocated to landscaping however did pose a problem and Ms. Maher asked Mr. Weith to see if there was a mistake in the estimated cost of the building in relation to the amount of money alloca.e; for landscaping. The District Environmental Commission maintains continuing juris- diction during the lifetime of the permit and may periodically require that the permit holder file an affidavit certifying that the project is being completed, operated and maintained in accor- dance with the terms of the permit. 4. The Permittee shall apply and receive approval for any change in the use of the buildings which involves the storage or handling of any regulated substances or the generation of hazardous wastes. 9. The floor drain shall empty into a holding tank which will periodically be pumped and the waste di posed in a certified disposal facility. 10. The Permittee shall apply to the District Environmental Commis- sion for approval for any change in the use of the building and land manufacturing processes which would cause noxious or un- healthy emissions into the air or injection of toxic wastes into the soils. 11. The Permittee and all assigns and successors in interest shall install and maintain water conserving plumbing fixtures. The plumbing fixtures shall operate with the following specifica- tions: (1) internal system water pressure of 50 psi maximum, (2) toilets with a maximum of 3.5 gallons per flush, (3) showerheads operating with a maximum of 3 gallons per minute, and (4) faucets on sinks and 1 ays shall operate at a maximum of 3 gallons per minute. An alternative water conservation plan may be presented to the Commission for approval before implementation. The ap- proved alternate shall be implemented and maintained by the Permittee for the duration of the permit. 12. The Permittee shall comply with Exhibits #7 and #14 for erosion control. Hay bale dams and silt fences shall be installed as depicted on the plans prior to commencement of construction. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. For all construction from October 15 to April 15 of the calendar year the Permittee shall abide by all winter erosion control measures outlined in the "Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites." All erosion control devices shall be periodically cleaned, replaced and maintained until vegetatiein is permanently established on all slopes and dis- turbed areas. The Commission reserves the right to schedule hearings and site inspections to review erosion control and to evaluate and impose additional conditions with respect to erosion control as they deem necessary. In addition to conformance with the requirements of condition #12, the Permittee shall not cause, permit or allow the discharge of waste materials into any surface waters. Compliance with the requirements of this condition does not absolve the Permittee from compliance with 10 V.S.A., Chapter 47, Vermont's Water Pollution Control Law. 14. The Permittee and all assigns and successors in interest shall continually maintain the landscaping as approved in Exhibits # 7 and #14 by repl aci ng any dead or di seased pl anti ngs as soon as seasonably possible. 15. Prior to any site work, the Permittee shall install and maintain snow fencing along the tree line on the east side of the property to protect existing tree for the duration of construction. 16. The installation of exterior light fixtures is limited to those approved in Exhibit #15, and shall be mounted no higher than 20 feet above grade level. All exterior lighting shall be in- stalled or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 17. The building colors will be as approved in Exhibit #20. 18. The Permittee must submit a color rendering of the proposed sign prior to installation to the Commission for review and approval. 19. All heated structures approved herein shall be constructed to comply with the ASHRAE 90-80 standards. 20. The installation and or use of electric resistance space heating is specifically prohibited without the prior written approval of the District Environmental Commission. 21. All construction on this project must be completed by October 15, 1989. 22. This permit shall expire on October 15, 2019 unless extended by the District Commission. Notwithstanding, this permit shall expire one year from date of issuance if the Permittee have not demonstrated an intention to proceed with the project.
