HomeMy WebLinkAboutSP-17-33 - Decision - 0011 Gregory Drive#SP-17-33 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING STEVE POLLI — 11 GREGORY DRIVE SITE PLAN APPLICATION #SP-17-33 FINDINGS OF FACT AND DECISION Steve Polli, hereinafter referred to as the applicant, is seeking after -the -fact approval to make site modifications to a previously approved plan for a 5,000 sq. ft. office, wholesale and distribution building and approval to change the use to a "contractor or building trade facility" use, 11 Gregory Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking after -the -fact approval to make site modifications to a previously approved plan for a 5,000 sq. ft. office, wholesale and distribution building and approval to change the use to a "contractor or building trade facility" use, 11 Gregory Drive. 2. The owner of record of the subject property is M & P Realty, LLC. 3. The subject property is located in the Mixed Industrial - Commercial Zoning District. 4. The application was received on May 9, 2017. 5. Unauthorized site modifications were made to the property since the last site plan approval (#SP-01-68) and the plan submitted is an "as -built" plan showing the current state of the property and includes additional plantings to make up for the missing plantings from the 6. The plan submitted is entitled "Site Plan Polli Construction 18 (sic) Gregory Drive South Burlington, Vermont", prepared by Summit Engineering, Inc, and dated 4/24/17. DIMENSIONAL REQUIREMENTS 7. No changes to coverages proposed. 8. Setback requirements will continue to be met. - 1 — #SP-17-33 SITE PLAN REVIEW STANDARDS Pursuant to Section 14.03(A)(6) of the Land Development Regulations, any PUD shall require site plan approval. Section 14.06 establishes the following general review standards for all site plan applications: Only the standards below are affected by this application. All other standards will continue to be met. Traffic 9. The change in use not expected to generate any additional traffic. (c) Parking shall be located to the rear or sides of buildings 10. No additional parking spaces proposed. The site currently has 13 parking spaces available which are located on the side of the building. The new use requires a total of seven (7) parking spaces which will be accommodated. The site plan does include one (1) handicapped space which meets the requirement for the number of handicapped spaces. LANDSCAPING 11. The site is currently missing plantings that were approved and required to be planted when the building was approved in 1988 which have valued at $1867. The site also has plantings which were not on the originally approved plan valued at $1015. The applicant is proposing to add $870 worth of new plantings to make up for the missing plantings. The City Arborist has reviewed the site plan and in an email dated 5/16/17 indicated that the plan was fine. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves Site Plan Application #SP-17-33 of Steve Polli, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and will be on file in the South Burlington Department of Planning and Zoning. -2— #SP-17-33 3. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The plan must be revised to show the changes below and shall require approval of the Administrative Officer. Three (3) copies of the approved revised plans must be submitted to the Administrative Officer prior to permit issuance. a. The plan must be revised to show the snow storage areas. 5. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Administrative Officer estimates that this change in use will generate zero (0) additional vehicle trip ends during the p.m. peak hour. 6. Prior to permit issuance, the applicant must post an $870 landscaping bond. This bond must remain in full effect for three (3) years to assure that the landscaping has taken root and has a good chance of survival. 7. Prior to issuance of a zoning permit for the project, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. 8. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the newly converted space in the building. 9. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. Signed on this day of , 2017 by aymond J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
