construction of the wastewater disposal system.
Based upon our field observations, we feel the wastewater disposal system has been constructed
in general conformance with the approved plans and Water and Wastewater Permit.

8. Site plan application 4SP-02-24 of Everett J. Prescott, Inc., to amend a previously
approved site plan consisting of a 8120 sq. ft. warehouse building and an 8057 sq. ft.
storage shed. The amendment consists of 1) converting the use of the main building
from warehouse to wholesale use, 2) demolition of 5383 sq. ft. of storage shed, 3)
addition of a curb cut, and 4) minor landscape changes, including additional
paving, installation of fence, and tree plantings, 1235 Airport Parkway:
Mr. Gardner said they are a water/sewer/drain distributor headquartered in Maine. They
have been looking for a place in this area and have purchased 1235 Airport Pkwy.
Mr. Nedde said this is an existing building. There was a u-shaped shed in back which
will be partly removed. They are also removing some asphalt near the existing curb cut.
There will be screening with landscaping and a fence.
A new sanitary system is proposed to comply with current standards.
Ten parking spaces will be provided.
There is a request from staff to reduce the entrance drive to 16 ft. This doesn't work
with the tractor trailers that will be used. Mr. Belair said he has no problem with what is
proposed. There is a concern with 2 curb cuts so close together.
Mr. Kupferman asked about drainage. Mr. Nedde said there is an infiltration basin. They
also found deep sand at 8 feet.
Mr. Boucher asked about the outside storage and how things are stored. Mr. Gardner said
pipe is stored the way it comes on the truck (pipes are 20 ft. long) on skids, about 8 ft.
high at maximum.
Members amended the motion to eliminate condition #2 (curb cut width reduction).
Mr. Schmitt moved to approve Site Plan application #SP-02-24 of Everett J.
Prescott, Inc., subject to the stipulations in the draft motion of 7 May 2002 as
amended to eliminate condition #2. Ms. Quimby seconded. Motion passed
unanimously.

Please find enclosed a site plan application for E.J. Prescott on 1245 Airport Parkway. The
Owner/Applicant is proposing a minor modification to the entrance drive.
The Owner has found a uniform crack along the entrance drive which would make it difficult to
remove pavement as originally permitted. The Owner requests to use the existing crack as a limit
of pavement to be removed.
This results in six feet of additional pavement being retained and has minor impacts on lot
coverage and front yard coverage.

WHEREAS, DEVELOPER is required by said approval, at its own
expense, to complete the construction of the development site in
accordance with the plan approved by the Planning Commission; and
WHEREAS, the parties to this Agreement wish to establish a
mechanism to secure the obligations of the DEVELOPER for the work

WHEREAS, the BANK executes this Agreement solely in the
capacity of issuer of a Letter of Credit hereinafter specified;

3. DEVELOPER shall replace or repair any defective or
improper work or materials which may be recognized within one year

the purpose of this Agreement "completion" shall be deemed to have
occurred when the MUNICIPALITY has inspected and approved the
construction of all the improvements required by this Agreement and
issued Written notice to the DEVELOPER that the construction is
complete.
4. For the guarantee of DEVELOPER's performance of all
requirements hereunder set forth, DEVELOPER has caused the BANX to
issue its Irrevocable Letter of Credit in favor of the
MUNICIPALITY, the original, of which is attached to the
MUNICIPALITY's copy of this Agreement, and a copy of which is
attached to the DEVELOPER's copy of this Agreement. During the
term of this Agreement, DEVELOPER shall cause the attached Letter
of Credit to be renewed .at least thirty (30) days before the
maturity date thereof. Failure of DEVELOPER to deliver evidence of
such renewal to MUNICIPALITY thirty (30) days prior to the date of
expiration of said Letter of Credit shall constitute a default of
the terms of this Agreement:.
5. Said Irrevocable Letter of Credit provides that the drafts
drawn under said credit, must be accompanied by a written statement
signed by a duly authorized agent of the MUNICIPALITY, that in the
judgement of the MUNICIPALITY, the DEVELOPER is in default under
the terms of this Agreement, and that the funds to be drawn by the
draft are in payment for, or in anticipation of payment for
materials, labor and services required for completion of the
improvements identified in Paragraph 1. Payment of each draft will
be made at sight when presented to the, BANK by the MUNICIPALITY,
the payment limited only by the aggregate amounts presented i.n
relationship to the maximum amount of tho Letter of Credit. If
DEVELOPER shall be in default of the Agreement for seven (7) days
because of Its failure to provide evidence of renewal of the Letter
of Credit, required In paragraph 4 above, the MUNICIPALITY shall
notify DEVELOPER by certified wail of said default. DEVELOPER
shall then within three ( 3 ) business days provide XMICIPALIT'Y with
evidence of said renewal of! Letter of Credit or MUNICIPALITY may
notify SANK of such default and request payment under said Letter
of Credit.

DEVELOPER to payment of said draft by BANK to the MUNICIPALITY
under said Letter of Credit shall not be required.

8. The MUNICIPALITY shall not filo with the BANK a Statement
of Default until ten (10) days after notice has been sent to the
DEVELOPER, by certified mail, setting forth its intention to do so.
9. All funds drawn on the BANK by the MUNICIPALITY pursuant
to the Letter of Credit shall be used solely by the MUNICIPALITY
for the purpose of completing construction of the Improvements
Identified in Paragraph 1. Any work contracted for by the
MUNICIPALITY pursuant hereto shall be let on a contractual basis,
or on a time and material basis, or shall be performed by the
MUNICIPALITY's own work force and equipment, or shall be
accomplished ,in such other manner as in the judgement of the
MUNICIPALITY shall accomplish the work more expeditiously and
economically.
10. If payments are drawn on the SANX by the MUNICIPALITY
pursuant to said Letter of Credit, and it shall later develop that
a portion of the monies drawn are in excess of the MUNI+CIPALITY'S
needs, any such excess amount shall, be refunded by the MUNICIPALITY
to the BANX,'to be credited by said BANK to the DEVELOPER.
11. This Agreement and said Letter of Credit shall terminate
and shall be of no force and effect upon completion of the one year
warranty period as described in the above Paragraph 3. If the
MUNICIPALITY has not delivered any written► notice to the DEVELOPER
of any defective or improper work or materials in the construction
of the improvements within the twelve (12) month period, or if
notice has been given and the defective work or materials have been
corrected by the DEVELOPER, -the MUNICIPALITY shall forthwith notify
the BANK in writing that the Letter of Credit may be canceled, and
shall return the original Lotter of Credit to the BANK, and both
the DEVELOPER and the BANK shall be released from all obligations
hereunder and under said Letter of Credit.
12. The BANK may not modify the Letter of Credit without
first receiving written consent of the MUNICIPALITY.
13. DEVELOPER hereby agrees to indemnify and hold BANK
harmless from all claims, causes of action or liability of any kind
arising out of this Agreement or the issuance by BANK of this
Letter of Credit, including attorney's fees, as long as BANK
follows the terms and conditions outlined in said Letter of Credit.
14 This Agreement shall be binding on all parties hereto and
their respective heirs#,axecutors, administrators, successors and
assigns.

This project, consisting of a one lot subdivision being 1.67 acres in size with the commercial
building approved by Water Supply and Wastewater Disposal Permit #WW-4-1618 served by
municipal water and on -site wastewater disposal systems located off Airport Parkway in the City
of South Burlington, Vermont, is hereby approved under the requirements of the regulations named
above subject to the following conditions.
GENERAL
This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from local officials prior to proceeding with this project.
The project shall be completed as shown on the plans Project 02101, Sheet 1 "Site Plan"
dated April 22, 2002 prepared by Krebs & Lansing Consulting Engineers, Inc. which
have been stamped "approved" by the Wastewater Management Division. The project shall
not deviate from the approved plans without prior written approval from the Wastewater
Management Division.
Each prospective purchaser of the lot shall be shown a copy of the approved plot plan and
this Subdivision Permit prior to conveyance of the lot.
4. The conditions of this permit shall run with the land and will be binding upon and
enforceable against the permittee and all assigns and successors in interest. The permittee

GENERAL
This permit does not relieve the permittee from obtaining all other approvals and permits as
may be required from local officials prior to proceeding with this project.
2 The project shall be completed as shown on the following plans which have been stamped
"approved" by the Wastewater Management Division:
Project 02101, Sheet 1 "Site Plan" dated April 22, 2002 and Sheet 2 "Details" dated
April 18, 2002 prepared by Krebs & Lansing Consulting Engineers, Inc.
The project shall not deviate from the approved plans without prior written approval from
the Wastewater Management Division.
No alterations to the building other than those indicated on the approved plan or Water
Supply and Wastewater Disposal Permit, which would change or affect the exterior water
supply, or wastewater disposal, or the approved use of the building shall be allowed without
prior review and approval from the Division of Wastewater Management.
4. The Wastewater Management Division now reviews the water supply systems and
wastewater disposal systems for public buildings under 10 V.S.A., Chapter 61 - Water
Supply and Wastewater Disposal Permit.

By acceptance of this permit, the permittee agrees to allow representatives of the State of
Vermont access to the property subject to this permit, at reasonable times, for the purpose
of ascertaining compliance with Vermont environmental/health statutes and regulations.
6. All conditions set forth in Land Use Permit #PB-4-0019 and Subdivision Permit #EC-4-2474
shall remain in effect except as modified or amended herein.
7. A copy of the approved plans and this permit shall remain on the project during all phases
of construction and, upon request, shall be made available for inspection by State or local
personnel.
WATER SUPPLY
8. The project is approved for water supply by connection to the municipal water system as
depicted on the approved plans. No other means of obtaining potable water shall be allowed
without prior review and approval by the Wastewater Management Division.
WASTEWATER DISPOSAL
9. The project is approved for wastewater disposal by construction and utilization of the
site -specific wastewater disposal system depicted on the approved plans. No other method
or location of wastewater disposal shall be allowed without prior review and approval by the
Wastewater Management Division.
10. The on -site, subsurface wastewater treatment/disposal system herein approved shall be
routinely and reliably inspected during construction by a professional engineer, registered
in the State of Vermont, who shall, upon completion and prior to August 30, 2002, report in
writing to the Wastewater Management Division that the installation was accomplished in
accordance with the approved plans and permit conditions.
11. No buildings, roads, water lines, or other construction that might interfere with the
installation or operation of the sewage disposal field are permitted on or near the site -specific
wastewater disposal system or replacement area depicted on the approved plans. All
isolation distances, which are set forth in the Environmental Protection Rules, will be
incorporated into the construction/installation of the sewage disposal field. Compliance with
these isolation distances is required. The Wastewater Management Division is to be notified
if at any time this system fails to function properly and/or creates a health hazard.

12. The future wastewater disposal "replacement area" designated on the approved plans shall
be held in reserve for the eventual construction of a replacement disposal system in the event
of failure of the primary system. No construction, earthwork, or other activity shall be
allowed within the replacement area which would diminish its natural suitability for such
eventual use as a wastewater disposal site.
13. The approved sewage disposal system has been designed to serve a commercial building
with a maximum of 15 employees. Prior to any increase in design flows, an application, fee
and engineering plans must be submitted for review and approval by the Wastewater
Management Division.

I move the South Burlington Development Review Board approve site plan application
#SP-02-24 of Everett J. Prescott, Inc. to amend a previously approved site plan consisting of
a 8,120 square foot warehouse building and an 8,057 square foot storage shed. The
amendment consists of. 1) converting the use of the main building from warehouse to
wholesale use, 2) demolition of 5,383 square feet of storage shed, 3) addition of a curb cut,
and 4) minor landscape changes, including additional paving, installation of fence, and tree
plantings, as depicted on a two page set of plans, page one (1) entitled, "Site Plan E.J.
Prescott, Inc. 1235 Airport Parkway South Burlington, Vermont", dated 4/22/02, with a last
revised date of 4/29/02, with the following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2) The plans shall be revised to show the changes below and shall require approval of
the Director of Planning and Zoning (hereinafter Director). Three (3) copies of the
approved revised plans shall be submitted to the Director prior to permit issuance.
a. The site plan be revised to show a 16' wide entrance driveway.
3) All floodlights shall be removed or replaced with downcasting shielded fixtures
approved by the Director prior to installation.
4) For the purpose of calculating road impact fees under the South Burlington Impact
Fee Ordinance, the Development Review Board estimates that the change in use will
generate zero (0) additional vehicle trip ends during the P.M. peak hour.
5) Prior to issuance of a zoning permit, the applicant shall post a $2,000 landscape
bond. The bond shall remain in effect for three (3) years to assure the landscaping
takes root and has a good chance of surviving.
6) The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the zoning regulations or this approval is null and void.
7) The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer before use of the three (3) structures.
8) Any change to the site plan shall require approval by the South Burlington
Development Review Board.

DEVELOPMENT REVIEW BOARD MEMO
May 7, 2002 MEETING
consists of: 1) converting the use of the main building from warehouse to wholesale use, 2)
demolition of 5,383 square feet of storage shed, 3) addition of a curb cut, and 4) minor
landscape changes, including additional paving, installation of fence, and tree plantings.
This property at 1235 Airport Parkway lies within the IC District. It is bounded on the north
by undeveloped land owned by June Berard Revocable Trust, on the south by Airport
Parkway, on the east by the Medical Store and on the west by Leisure World.
SITE PLAN CRITERIA
Coverage/Setback: The proposed building coverage is 14.9% (maximum allowed is 30%).
The proposed overall coverage is 63.2% (maximum allowed is 70%). Proposed front yard
coverage is 25.4% (maximum allowed is 30%). The existing shed does not met the rear
and side yard setbacks.
Access/Circulation: Proposed access to the property is provided via a two curb cuts one
existing and one proposed. The existing curb cut is 24 feet wide; the proposed is 16 feet
wide. Under Section 26.103 of the zoning regulations the Board may approve dual
driveways where one lane is marked for entering traffic and one lane for exiting traffic. Staff
suggests the entrance curb cut be reduced to 16' wide as well.
Staff is concerned the proposed curb cut is within 50 feet of the adjacent property's curb cut.
Circulation on the site is adequate.
Traffic: ITE estimates the current use (warehouse) to generate 18.63 vehicle trip end's
(vte's) during the PM peak hour. The applicant estimates the proposed wholesale use to
generate 17 vte's for a 1.63 vte reduction.
Parking: The parking requirement is 10 spaces. The site plans shows 10 spaces including
one accessible space. There is a bike rack shown on the plan.
Fence: The applicant should be aware the fence can located up to but not on a property line.
Dumpsters: The location for a dumpster is identified on the site plan. It is located behind
the building and not visible from the public right-of-way.
Landscaping: There is no minimum landscaping requirement based on construction costs
for this property. At the request of staff the applicant is proposing three deciduous trees to
replace some substantial evergreen trees which will be removed from the property to allow
for the additional drive and curb cut.
The applicant is also proposing six (6) cedar trees. The applicant is aware they will need to
bond for the proposed additional landscaping, which has a value of $2,000.00.
9) FINAL PLAT APPLICATION OF FARWATER LTD, 325 LIME KILN ROAD
This project consists of amending a previously approved planned unit development
consisting of 85 residential units in four (4) buildings and a 42 unit congregate housing

resources to be affected.

SITE PLAN CRITERIA:
Access/Circulation: Access is provided via an eighteen foot ( 18') wide curb cut. Both
properties share the curb cut. Circulation on the site is adequate.
Coverage/Setbacks: Building coverage for 9469 Lime Kiln Road is 9.6%, (maximum
allowed is 30%) and remains unchanged from the last approval. Overall coverage is
changing from 42% to 39%, (maximum allowed is 70%). Front yard coverage is
changing from 16% to 11%, (maximum allowed is 30%).
463 Lime Kiln Road remains unchanged from last approval. Building coverage is 17.2%
(maximum allowed is 30%), overall coverage is 64.7% (maximum allowed is 70%), and
front yard coverage is 30.3% and remains unchanged.
Buildings `B" and "D", as shown on the site plan, do not meet the front yard setback
requirements, and building "E", as shown on the site plan, does not meet the side yard
setback requirement. All of these buildings are non -complying structures and subject to
Section 26.002 of the South Burlington Zoning Regulations.
Traffic: ITE estimates vehicle trips ends (vte's) increase by 2.19 with the addition of
the 136 square feet of retail floor area. ITE estimates this property to generate 27.55
vte's (including the additional 2.19 vte's) during the PM peak hour. The applicant should
be aware an additional road impact fee will be accessed for this property.
Parking: The proposed addition will not require additional parking. The plan shows 21
parking spaces and 1 accessible space. The parking is adequate. A bike rack is provided.
Li htg ins: All exterior floodlights should be removed and/or replaced with downcasting
and shielded light fixtures. Cut sheets should be submitted to the Director of Planning and
Zoning for approval of any new light fixtures.
Dumpsters: Locations of existing dumpsters are shown on the plan. These should be
screened if visible from the public right-of-way.
Landscaping: The minimum landscaping requirement, based on building costs is $225
which is being met.

Overview:
Application to make minor site plan modifications for a construction materials business, 1235
Airport Parkway.
Issues:
Staff has visited the property to assess the exterior light fixture situation. Upon this visit, staff discovered
the proposed drive will require the removal of some significant evergreen trees. Staff requests the
applicant replace these trees with three medium sized deciduous trees. Bill Nedde suggested these
replacement trees be planted within the new added greenspace.
The applicant should choose at least two species to plant.
Some suggested species are : Prunus maackii, Gleditsia triacanthos `Imperial', and Prunus sargentii
`Columnaris'. But the applicant is not limited to these species.
The Bond
The bond for the plant material is calculated using the wholesale cost of the plant material multiplied by
2.5 (installation cost). Staff will calculate this once the additional trees are added to the site plan.
This bond for landscaping is provided at the time a building permit is issued for the project.
The applicant can either get a letter of credit from a bank (see attached),
create an escrow account (see attached),
or, get a performance bond written directly to the City of South Burlington, this is usually issued by an
insurance company.

Please find enclosed a site plan application for E.J. Prescott, Inc. on 121 Airport Parkway. The
Applicant is proposing some minor modifications to the existing infrastructure to accommodate
their construction materials sales business.
The 1.67 acre parcel of land is located on Airport Parkway between Leisure World and The
Medical Store. It has existing office/warehouse, and a storage shed in the rear. The Applicant is
proposing to establish a one way loop around the existing building. Vehicles would enter the
site on the west side and exist the property on the east side. The Applicant is proposing to
remove 2/3 of the existing storage shed in the rear. A new stockade fence will screen the
construction materials stored on site (see site plan). The applicant is proposing Cedar trees in
front of the fence.
The Applicant will have three employees and one company vehicle. We researched the ITE
Manual for a category that would be appropriate for this project's use. The closest category was
(812) Building Materials and Lumber Store. This category clearly was not appropriate due to
the high volume anticipated with lumber sales and retail that this facility clearly will not have.
The traffic estimates provided are from client information on similar facilities.
Please schedule this project for the May 7' Development Review Board.

(formerly known as the "Homestead Exemption)
(Under the authority of 18 V.S.A. Chapter 23 and the Environmental Protection Rules,
Chapter 1, Subchapter 3, §1-304 Exceptions, A)
As of September 18, 1969, the creation of any lot less than 10 acres in size, requires a permit unless it qualifies for an
exemption as set forth in Chapter 1, Subchapter 3 of the Environmental Protection Rules. This application form may be used by
landowners proposing to create a lot of less than 10 acres that has an existing structure on it, provided it meets the exemption
criteria.
INSTRUCTIONS
Location: List the town & road where the property is located.
Deed to property - List the book & page in which the deed to the property is recorded in the town land records.
Size of Parcel - Indicate the size of the proposed parcel in acreage or square feet. A plot plan or sketch showing the
house, septic, well location as well as the boundary lines and dimensions must be provided.
4. Size of remaining parcel. Indicate the size in acreage or square feet the land remaining after creation of the exempt
lot. Also, indicate if the remaining lot is improved and if so with what type of structure. If remaining parcel is under
10 acres a permit may be required.
5. List the number of lots, of any size, which have been created by the applicant/landowner within the environmental
district within the last five years.
6. List any prior Environmental or Act 250 permits issued on the same tract of land. (i.e., Subdivision Permit, Land
Use Permit, Public Building Permit, Water Supply and Wastewater Disposal Permit or Certificate of Compliance).
Criteria. The building must be a prima single family residence, or a public building with design flows of domestic
type sewage of 300 gallons per day (gpd) or less. If building is a public building with design flows of domestic type
sewage of 300 gallons per day (gpd) or less, indicate what the building is used for and the number of employees.
8. Construction date. Indicate if the building was on the subject lot and constructed prior to March 5, 1973.
9. Sewage Disposal System:
a. If the building is served by a municipal sewer service, provide the name of the municipality.
b. If the building is served by a sub -surface sewage disposal system, it must be functioning properly (not surfacing or
backing up into building plumbing), and not causing pollution or a health hazard.
