Re: Findings of Fact, application of David and Barbara Flagg for
construction of a 4,608 square foot building for automobile and
marine sales and service, 10 Gregory Drive.
On the 25th of May, 1993, the South Burlington Planning Commission
approved the request of David and Barbara Flagg for site plan
reivew under Section 19.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project consists of the construction of a 4,608 square
foot building for auto service and auto/marine sales use. The
Zoning Board on April 12, 1993 granted the applicant a variance to
allow a front yard coverage of 63% and on May 24, 1993 the Zoning
Board granted a request from the applicant for a conditional use
permit for the uses and for a variance to allow a 39% front yard
coverage.
2. This property located at 10 Gregory Drive lies within the IC
District. It is bounded on the east by Barry's Transmissions, on
the south by Muddy Brook, on the west by a vacant lot and on the
north by Gregory Drive.
3. Access/circulation: Access will be via two (2) curb cuts. The
westerly curb cut is for ingress only and will be 18 feet in width
and the easterly curb cut is for egress only and will be 20 feet in
width. "Entrance only" and "Exit only" signs should be provided to
direct traffic to the appropriate access.
Circulation is adequate.
4. Parking: This project requires a total of 10 parking spaces
for employee and customer parking and 17 spaces are being provided
including one (1) handicapped space.
5. Landscaping: The minimum landscaping requirement for this
project is $4,350 which is being met. Plantings will include
Juniper, Red Oak, Crabapple and Norway Spruce.
6. Traffic: The applicant should contribute $1,746 to Williston
Road Traffic Impact Fund (Area 2) based on 12.1 P.M. peak hour trip
ends expected to be generated by this project.
7. Coverage/setbacks: Building coverage is 4.6% (maximum allowed
is 30%). Overall coverage is 19% (maximum allowed is 70%). Front
yard coverage is 39% (maximum allowed is 30%). The applicant is
seeking a variance to exceed the front yard coverage.

Setback requirements will be met.
8. Sewer: Sewer allocation needed for this project is 120 gpd
based on eight (8) employees. The per gallon fee should be paid
prior to permit.
9. Lighting: Exterior lighting will consist of two (2) 35 watt
high pressure sodium lights mounted on the building over the
entrances and five (5) 70 watt high pressure sodium lights with
photo controls mounted on the ends and front of the building.
10. Sidewalk: The applicant should either construct a sidewalk
along the frontage of the property or contribute $4,905 for the 327
feet of frontage calculated at $15 per linear foot.
11. Other: Dumpster will be enclosed by a fence.
DECISION & CONDITIONS
Based on the above Findings of Fact, the Planning Commision
approves the site plan application of David and Barbara Flagg for
construction of a 4,608 square foot building for automobile and
marine sales and service as depicted on a plan entitled "Site Plan,
Car Buff & Dave's Automotive", prepared by Krebs and Lansing
Consulting Engineers, Inc. and dated 5/14/93 with the following
stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The applicant shall post a $4,350 landscaping bond prior to
issuance of a zoning/building permit. The bond shall remain in
effect for three (3) years to assure that the planted landscaping
takes root and has a good chance of surviving.
3. A sewer allocation of 120 g.p.d. is granted. The applicant
shall pay the required sewer allocation fee prior to issuance of a
zoning/building permit.
4. All exterior lighting shall be downcasting and shielded and
shall not cast light beyond the property line. Any change in
existing lighting or new lighting shall be approved by the City
Planner prior to installation.
5. The applicant shall contribute $1,746 to the Williston Road
Area 2 Improvement Fund based on the 12.1 pm peak hour trip ends
estimated to be generated by this project.
6. The applicant shall install "enter" and "exit" signs to
properly identify which drive is for ingress and which drive is for
egress.

7. The plan shall be revised prior to issuance of a
zoning/building permit to show the proposed sidewalk continuous
across the driveways. The sidewalk shall be constructed prior to
occupancy.
8. The applicant shall obtain a zoning/building permit within six
(6) months or this approval is null and void.
9. The applicant shall obtain a Certificate of Occupancy from the
Administrative Officer prior to occupancy of the building.
10. Any changes to the site plan shall require approval by the
South Burlington Planning Commission.
11. There shall be no vehicles parked in designated green space.
