HomeMy WebLinkAboutSP-99-0000 - Decision - 0010 Gregory DriveFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN S CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of David Flagg to amend a previously approved site plan for a 4,608 square foot building for auto service and auto/marine sales. The amendment consists of. 1) enlarging the dumpster storage area, 2) revising condition #7 of the 5/25/93 approval regarding the construction of a sidewalk, and 3) adding two (2) parking spaces. On the —'- day of March, 1999, the Director of Planning & Zoning approved the request of David Flagg for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a previously approved site plan for a 4,608 square foot building for auto service and auto/marine sales. The amendment consists of: 1) enlarging the dumpster storage area, 2) revising condition #7 of the 5/25/93 approval regarding the construction of a sidewalk, and 3) adding two (2) parking spaces. 2. This property located at 10 Gregory Drive lies within the I-C District. It is bounded on the east by an auto service and repair facility, on the south by Muddy Brook, on the west by an industrial building, and on the north by Gregory Drive. 3. Access/circulation: Access is provided by two (2) curb cuts. The easterly curb cut is for egress only and the westerly curb ut is for egress only. No changes proposed. Circulation on the site is adequate. 4. Coverage/setbacks: Building coverage is 4.6% (maximum allowed is 30%). Overall coverage is 24% (maximum allowed is 70%). Front yard coverage is 42% (maximum allowed is 30%). The applicant obtained a variance to allow the 42% coverage. Setback requirements are being met. 5. Parking: This property requires a total of 10 parking spaces for employee and customer parking and 23 spaces are being provided including one (1) handicapped space. 6. Landscaping: No changes 7. Dumpster: No changes. 8. Lighting: The building mounted floodlight located at the westerly end of the building should be replaced with a downcasting shielded fixture approved by the Director of Planning & Zoning. 9. Sidewalk: The sidewalk that was required to be constructed under condition #7 of the 5/25/93 approval was never constructed due to the location of a utility pole guy wire. The applicant requested that in lieu of constructing the sidewalk he be allowed to contribute $15 per linear frontage foot for the City to construct the sidewalk. DECISION & CONDITION Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of David Flagg to amend a previously approved site plan for a 4,608 square foot building for auto service and auto/marine sales. The amendment consists of enlarging the dumpster storage area, 2) revising condition #7 of the 5/25/93 approval regarding the construction of a sidewalk, and 3) adding two (2) parking spaces, 10 Gregory Drive, as depicted on a plan entitled, "Site Plan Autohaus Dave's Automotive Gregory Drive Lot #4 South Burlington, Vermont," prepared by Krebs & Lansing Consulting Engineers, Inc., dated 5/14/93, last revised 2/26/99 , with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 3. The existing building mounted flood light located at the westerly end of the building shall be replaced with a downcasting shielded fixture approved by the Director of Planning & Zoning. 4. The applicant shall fulfill the obligation to construct a sidewalk along the Gregory Drive frontage by paying to the City the sum of $4,900 ($15 per foot of frontage) on or before one year from the date of site plan approval which funds shall be used by the City to construct sidewalk improvements along Gregory Drive. The City shall construct the sidewalk improvements along Gregory Drive within one year of receipt of the funds. If City fails to construct such sidewalk improvements within one year, the funds shall be returned to the then property owners. 5. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the expanded parking and dumpster storage areas. 6.
