HomeMy WebLinkAboutSP-02-22 - Decision - 0010 Gregory Drive#SP-02-22 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON RE: Findings of Fact, site plan application #SP-02-22 of Fleischer Sales, Inc. to amend a previously approved site plan for a 4,608 SF mixed -use building. The amendment consists of replacing 904 SF of auto repair and auto sales with wholesale business within the 4,608 SF mixed -use building at 10 Gregory Drive, South Burlington. On the 9' day of April, the Director of Planning & Zoning approved the site plan application of Fleischer Sales, Inc. under Section 26.10(b) of the South Burlington Zoning Regulations, based on the following findings: 1. This project consists of a site plan application to amend a previously approved site plan for a 4,608 SF mixed -use building. The amendment consists of replacing 904 SF of space occupied by auto repair and auto sales use with a wholesale business at 10 Gregory Drive. 2. The owner of record is Ten Gregory Drive Partners. 3. This property is located within the IC -Mixed Industrial Commercial District. 4. Access and circulation: No changes to access and circulation will result. 5. Parking: The requirements for parking are met by the 23 spaces provided on site, including one handicapped space, as the wholesale use requires fewer parking spaces (4 versus 10) than the use it is replacing in the building. 6. Traffic: Based on the ITE generation for general light industrial use, the proposed use is projected to generate .51 PM peak hour trip ends per employee. The applicant has stated that there will be 5 employees. Therefore the traffic projection is for 2.55 PM peak hour VTEs. This is below the 12.1 VTEs currently permitted for the auto repair and auto sales use occupying the same area of the building as the proposed use. No traffic impact fees will be required. #SP-02-22 7. Coverage/setbacks: No changes to coverages or setbacks are proposed. The existing building coverage is 4.6% (limit of 30%) and the existing site coverage is 23.3% (limit of 70%). Front yard coverage is 427o, which was allowed to exceed the 30% maximum through a previously -issued variance. All setbacks appear to be met. 8. Landscaping: No changes to the landscaping for the site are proposed and no additional landscaping is recommended. DECISION AND CONDITIONS Based on the above Findings of Face, the South Burlington Director of Planning and Zoning approves site plan application #SP-02-22 of Fleischer Sales, Inc. to amend a previously approved site plan for a 4,608 SF mixed -use building. The amendment consists of replacing 904 SF of auto repair and auto sales use with wholesale use at 10 Gregory Drive, as depicted on a plan entitled "Site Plan, Autohaus/Dave's Automotive," prepared by Krebs & Lansing, dated 2/26/99, with the following stipulations: 1. All previous approvals and stipulations that are not superseded by this approval shall remain in effect. 2. The applicant shall obtain a zoning permit within six (6) months of the date of this decision, pursuant to Section 27.302 of the Zoning Regulations, or this approval is null and void. 3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer. 4.
