On the 14th of June, 1994, the South Burlington Planning Commission approved the request of Bruce Barry for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of expanding the parking area and adding a driveway to a property being used for auto repair and service. This site was originally approved on 8/13/85. Staff discovered that site changes had been made without Planning Commission approval and requested the owner to restore the site as originally approved or obtain approval for the changes. 2. This property located at 6 Gregory Drive lies within the I-C District. It is bounded on the north by the RIVCO building, on the east by an auto sales and repair business, on the south by an auto sales and repair business and Muddy Brook and on the west by Gregory Drive. 3. Access/circulation: Access is provided via two (2) 36 foot wide curb cuts. The southerly curb cut and driveway were not part of the 1985 approval. Section 19.103a of the zoning regulations states that "unless specifically approved by the Planning Commission there shall be one driveway per lot". 4. The applicant feels that it is necessary to retain the westerly curb cut due to the steep grade at the location of the easterly curb cut. The grade makes it difficult to tow disabled cars into the property without risking additional damages or repairs to the vehicle in tow. Additionally, the grade of the easterly curb cut is at times impassable in the winter due to snow and ice created from run-off from Gregory Drive. Circulation is adequate. 5. Coverage/setback: Building coverage is 6.8% (maximum allowed is 30%). Overall coverage is 37.5% (maximum allowed is 70%). Front yard coverage is 20.3% (maximum allowed is 30%). Setback requirements are met. 6. Landscaping: There is no minimum landscaping requirement, 1 based on building costs, for this project. The site is well landscaped and no additional landscaping recommended. 7. Parking: This project requires a total of 12 parking spaces and the plan shows a total of 57 spaces including two (2) handicapped spaces. The site has 24 paved spaces and 33 gravel spaces. The parallel spaces should be 22 feet in length. Staff recommended that the applicant move cars to the designated parking area as shown on the plan and that the proposed grass area be seeded within 60 days of approval. 8. Sewer: No additional sewer allocation needed. 9. Traffic: No additional traffic expected to be generated. 10. Lighting: Existing lighting consists of five (5) building mounted 70 watt high pressure sodium lamps with cutoffs. No additional lighting proposed. 11. Dumpster: The dumpster will be located behind the building and a new stockade fence erected to screen the dumpster from the east. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Bruce Barry to amend a previously approved site plan to expand a parking area and add one (1) additional curb cut to a property being used for auto repair and service, 6 Gregory Drive as depicted on a plan entitled "Bruce Barry, 1907 Williston Road, South Burlington, VT 05403" prepared by Chittenden Const. & Design, dated June 2, 1994, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 3. The applicant shall move all vehicles to the designated parking area as shown on the plan. All areas which are proposed to be grass shall be seeded within 60 days of this approval. 4. The plan shall be revised prior to issuance of a zoning/building permit to show the change listed below and shall require approval of the City Planner. Three (3) copies of the approved revised plan shall be submitted to the City Planner prior 2 to permit issuance. a) The site plan shall be revised to show the parallel parking spaces with a minimum length of 22 feet. 5. The applicant shall obtain a zoning/building permit within six (6) months or this approval is null and void. 6. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the expanded parking area. 7.
