This property is located within the Nfixed Industrial and Commercial District. It is bounded on the west by a single family dwelling, on the north by an office building, on the south by a wholesale business, and on the east by Gregory Drive. Access/Circulation: Access is provided via a shared 26 foot wide curb cut on Gregory Drive. No changes are proposed. Circulation on the site is adequate. It is bounded on the west by a single family dwelling, on the north by an office building, on the south by a wholesale establishment, and on the east by Gregory Drive. Access/circulation: Access is provided by a shared 26 foot wide curb cut on Gregory Drive. No changes proposed. Circulation on the site is adequate. Coverage/setbacks: Building coverage is 15.7% (maximum allowed is 30%). Overall coverage is 58.8% (maximum allowed is 70%). Front yard coverage is 27.7% (maximum allowed is 30%). Setback requirements are met. Parking: A total of 11 spaces are required and 13 spaces are provided including one (1) handicapped space and a bike rack. All leases for space in the building approved herein shall require the maintenance of the same. 7. This project is approved for the following maximum cumulative impacts: 225 gallons per day of water and wastewater, 20 vehicle trips per day, and the installation of 18 vehicle parking spaces. 8. The heated structures approved herein shall be constructed with insulation with an R-Value of at least R-19 in the exterior walls, at least R-30 in the roof or cap and at least R-12 around the foundation or slab. 9. The Permittees and all assigns and successors in interest shall continually maintain the landscaping as approved in Exhibit #25 by replacing any dead or diseased plantings as soon as seasonably possible. Page 3 Land Use Permit Amendment #4C0437-6 10. The installation or use of electric resistance space heating is specifically prohibited without the written approval of the District Commission. 11. The installation of exterior light fixtures is limited to those approved in Exhibit #25, and shall be mounted no higher than 20 feet above grade level. All exterior lighting, shall be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 12. The Permittee shall comply with Exhibit #17 for erosion control. Hay bale dams shall be installed as depicted on the plans prior to commencement of construction or within 24 hours of grading. The Permittees shall prevent the transport of any sediment beyond that area necessary for construction. From October 1 to April 15 of any calendar year, all non -vegetated disturbed areas of the construction site shall be mulched until final vegetative cover is established. All erosion control devices shall be periodically cleaned, replaced, and maintained until vegetation is permanently established on all slopes and disturbed areas. The Commission reserves the right to schedule hearings and site inspections to review erosion control, and to evaluate and impose additional conditions with respect to erosion control, as they deem necessary. 13. The Permittees shall seed disturbed areas and slopes as soon as final grade is established. 14. Prior to any site work, the Permittees shall notify the Commission of the starting date for the commencement of construction, so that the Commission's representative may review the installed erosion control devices. 15. This building is approved for use as office and warehouse space for Marquis Brothers, Foundations Inc. who will be storing concrete forms and trucks (Exhibit #16). The Permittee shall recover waste oils and other chemicals generated by truck maintenance, and dispose of them through a State approved private contractor, and is prohibited from flushing these wastes into the sewer. The Permittee shall post signs in the vicinity of the truck maintenance area which state that no oil or other waste chemicals from vehicles maintained shall be disposed of through the floor drains, and in the case of an accidental spill, the drain will be cleaned immediately. 16. The connection of floor drains to the stormwater drainage system, as depicted in Exhibits #8, 11 and 13, is specifically prohibited. An oil separator floor drain (shown in Exhibit #14, drawn by Carlson Mechanical Inc. and received April 7, 1987) will be installed as shown on Exhibit #18. The Permittees shall file and receive approval from the District Commission for the occupancy of the building approved herein by any tenant that uses or stores regulated substances or hazardous wastes, as defined by the Agency of Environmental Conservation, as a part of its business operations. Each prospective purchaser or leasee of any portion of the building approved herein shall be shown a copy of the approved plot plan, the Public Building Permit, and the Land Use Permit before any written contract of sale is entered into. 21. No further subdivision or development of the parcel approved herein shall be permitted without the written approval of the District Environmental Commission. 22. The Permittees shall supply all exterior sign plans to the District Commission for approval prior to the installation of said signs, and shall construct the project in accordance with those plans as approved. The stacking space for the drive -through is 20 vehicles and 26 for the self-service. This should be sufficient to prevent any backups onto Shelburne Road. PARKING: The plan designates three employee parking spaces. LANDSCAPING: A $4,800 landscaping plan and bond is required. The plan meets this and shows new planting along the property boundaries. There are three existing crab trees in the Shelburne Road right-of-way. I suggest that the island in the middle of the property be planted with large trees rather than small shrubs. LOT COVERAGE: The proposed lot coverage is 61%; 70% is permitted. TRAFFIC: Roger Dickinson has prepared a traffic study (enclosed). The site permits a maximum of 61 trip onds during the peak hour. The proposed use would generate 104-106 trip ends per hour based on the present counts at the car wash. The ITE data sugqests 132 to 149. The level of service on Shelburne Road north of Home Avenue is licit and is "D" at O'Dell Parkway and Shelburne Road south. The level of service with the car wash will continue at "C" on Shelburne Road but at the project's exit will be "E". A separate left and right turn lane for exiting traffic will give right turns level "A" and left turns will remain at "E". Although the study argues the value of the relocation of this facility from a congested area of Shelburne Road to a less congested area, representatives of Tom Farrell have alerted me that this is not the case and indeed a car wash may continue to operate on Bacon Street. Craig Leiner agrees with Dickinson's analysis and findings and notes the significant increase in the number of vehicles created by the car wash in comparison with the office. OTHER: See Bill Szymanski's and Jim Goddette's comments. 5. MARQUIS, LOT #2, GREGORY DRIVE Mr. Marquis proposes to construct a 33,000 square foot commercial/office building on the 1.86 acre lot #2 on Gregory Drive. The construction is proposed in two phases. Phase I is a 9000 square foot footprint; Phase II is a 12,000 square foot footprint. This lot was once approved for the Park and Fly facil- ity that was constructed on White Street extension instead. The area is zoned Industrial -Commercial. 4 GENERAL: There are a number a mistakes on the plan. These should be corrected prior to permit. ACCESS AND CIRCULATION: Access is proposed from one 24 foot wide curb cut on Gregory Drive. Circulation is allowed on three sides of the building. The driveway narrows to 20 feet at one corner although the plans label it as 22 feet; this should be at least 24 feet. PARKING: Fifty-two parking spaces are proposed to meet the requirement of one space per 250 square feet for a 10,000 square foot office. Twelve spaces of this ate for the commercial -retail portion of the business. The parking aisles are incorrectly shown at 22 feet and should be 0 �� 24 feet wide. Also, the spaces are not the length that is labeled. Double loaded parking aisles and spaces should be 60 feet wide. LANDSCAPING: The two phase plan requires a $7500 plan in phase one and a a $13,500 plan in phase two. The plan does not distin- guish between Phase I and II plantings and is undervalued by $8000. This should be revised. LOT COVERAGE: The plan shows a 60% lot coverage. This will change when the parking lot is drawn correctly. TRAFFIC: The proposed use will generate 35 new trips daily. Assuming -all of these occur during the peak hour, they will not exceed the 45 trips that were approved for the two lots in Park and Fly. I will have traffic information on the entire subdivision available at the meeting. OTHER: See Bill Szymanski's and Jim God3ette's comments. 6. DENNIS DEMERS, BURLINGTON INTERNATIONAL AIRPORT Mr. Demers proposes to construct a 4800 square foot airplane hangar for private planes at the southern end of the airport. The area is zoned industrial -commercial. ACCESS AND CIRCULATION: According to Act 250 and City stipulations, the road from Williston Road leading to this area may only be used by Brockway employees and to serve two hangars in the area. Therefore, access for this hangar should be through the airport from National Guard Road. Circulation is shown on two sides of the proposed hangar. The Permittee shall post signs in the vicinity of the truck maintenance area which state that no oil or other waste chemicals from vehicles maintained shall be disposed of through the floor drains, and in the case of an accidental spill, the drain will be cleaned immediately. 16. Mrs. Lafleur noted that in the Larkin development there is a 40,000 gal retention area underground. She said someone will check on the situation and will also check to see that erosion control steps that were to be taken during construction have been followed. A poll of the Commission indicated that members felt the traffic issue would keep them from approving the project. Mr. Dooley moved that the Planning Commission deny the site plan application of Hoyt Gahagan for construction of a 10,300 sq.. ft. car wash at 1810 Shelburne Road as depicted on a plan entitled "Site Plan," Car Wash, Shelburne Road, South Burlington, Vermont" prepared by Wiemann-Lamphere Architects, dated March 16, 1987 for the following reasons: 1. The traffic overlay Zone 5 allows 140 peak hour trip ends for this 2.86 acre lot. The applicant projects 200 trip ends during some peak hours with 80% or 160 using the Shelburne Rd/Harbor View Road intersection. —This exceeds the allowable number under the overlay zone and Section 17.304 of the Ordinance. 2. The traffic generated by this development will cause further delays for traffic turning left onto Shelburne Road from Harbor View Road and the level of service for this turning movement is already at "E". Mrs. Maher seconded, and the motion passed unanimously. 3. Mrs. Lafleur said Mr. Szymanski has reviewed the plan and has no problems with it. Gregory Drive has not been built to city standards and the city is getting an opinion on what it will take to bring it to standard. The bank released the bond without city approval. Brian Precourt said College Formals wants to store merchandise on the premesis, and the basement area would be for this purpose. There would also be 2 additional stores as a result of the project. One curb cut into College Formals would be closed, leaving only the 2 into the shopping center area. The landscaped area would be increased slightly. Mrs. Hurd raised the question of the parking configuration at College Formals and Mrs. Lafleur said the Fire Chief says it is too narrow for emergency vehicles. Mrs. Maher noted that the first few spaces would back out into the ingress/egress. Mrs. Peacock said she felt the applicant was trying to cram more onto the lot than it can hold. A truck unloading goods would take out 3 or 4 parking spaces. Mr. Precourt said parking is a short-term problem as they will be filling in the back area. Mrs. Lafleur said that with the shopping center standard 84 parking spaces are required, and they are showing 65. Mrs. Lafleur noted they had gotten a variance for the side property line, but front yard coverage is not conforming as more than 300 of the setback is paved. Even with the ad- ditional green space, it will not be to standard. Mr. Dooley noted that he has never had a problem finding a parking space in the shopping center. Mrs. Hurd raised the question of what would happen if College Formals moves out and the Commission then has no control over what C-1 use goes in there. The entire project should be served by Holmes Road extension. 2. Holmes Road extension should be 32 feet in paved width with curbs and sidewalk. 3. The inside housing unit square shall have rounded corners not square. 7) NBC BUILDING, SHELBURNE ROAD 1. The Shelburne Road curb cut should be closed and circulation around building eliminated. Lafleur, City Planner �Op , Re' March 24 1987 Agenda Items Date: March 20, 1987 2) GAHAGAN, 1810 SHELBURNE ROAD Enclosed is a traffic study from North County Planning that evaluates the impact of this car was at the Harbor View Road/ - Route 7 intersection. Also enclosed are Craig Leiner's comments. David Spitz concludes that the car wash traffic will not add enough traffic to require a signal. He suggests that the future widening of Route 7 will help right turns from Harbor View Road but that left turns will be delayed as they are at all side streets. With a new signal at Allen Road, gaps will be created to allow easier turns. Mr. Spitz has assumed 80% of the traffic will come from or go to Route 7 and 20% to/from Spear Street. He concludes that in 1987 left turns from Harbor View will have an E level of service and right turns will have C. In 1992 with a widened Route 7, right turns from Harbor View and left turns from Route 7 on to Harbor View will have A while the left turn from Harbor View will have E. In both years, Harbor View must be widened for a right turn and left turn lane to maintain these levels. Craig Leiner agrees with this analysis and suggests that the applicant pay for widening the radius at Harbor View Road. Erosion control data will be available at the meeting. 3) MARQUIS, 5 GREGORY DRIVE Mr. Marquis proposes to subdivide a 1.86 acre parcel into two lots. Lot #2A will be 40,458 square feet; lot #2B will be 40.364 square feet. This property is directly south of Reprographics on Gregory Drive. A 6000 square foot building was approved several weeks ago on lot 2B. The property is zoned Industrial -Commercial and the lots meet the minimum lot size. Access is shown from a shared 24 foot wide driveway. An easement will be granted to lot #2A. The plan incorrectly shows Szymanski as the westerly abutter. It should be labeled RDR Enterprises prior to recording. The permittees and all assigns and successors in interest shall continually maintain the landscaping substantially as approved in Exhibit #9 by replacing any dead or diseased plantings as soon as seasonably possible. 9. The permittees shall comply with Exhibits #5 and #8A for ero- sion control. Hay bale dams shall be installed as depicted on the plans prior to commencement of construction. The permittees shall prevent the transport of any sediment be- yond that area necessary for construction. From October 1 to April 15 of any calendar year, all non -vegetated dis- turbed areas of the construction site shall be mulched until final vegetative cover is established. All erosion control devices shall be periodically cleaned, replaced, and main- tained until vegetation is permanently established on all slopes and disturbed areas. The Commission reserves the right to schedule hearings and site inspections to review erosion control, and to evaluate and impose additional con- ditions with respect to erosion control, as they deem neces- sary. 10. The Permittees shall apply to the District Environmental Commission for approval for any change in the use of the property which would cause noxious or unhealthy emissions into the air or injection of toxic wastes into the soils. 11. Within 30 days of issuance of this permit, the Permittees shall file with the Commission and the Agency of Environmental Conservation a list of all process materials, regulated substances and hazardous wastes utilized in the Page 4 Land Use Permit Amendment #4C0437-5 manufacturing process and shall file any approvals required by the Agency of Environmental Conservation with the Commission. The Permittees shall notify and receive approval for any change in the use of such materials prior to instituting any such change. 13. All outdoor lighting shall be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view substantially beyond the perimeter of the area to be illuminated. 14. The permittees shall supply sign plans to the District Commission for approval prior to installation of any signs, and shall construct the project in accordance with those plans as approved. The Commission may request a hearing to consider said plans. 15. The permittees shall apply and maintain calcium chloride on all roadways within the project during construction and until paved to control dust. 16. This project is approved for the following maximum cumulative impacts: 100 gallons of water and wastewater per day, 30 vehicle trips and 10 peak hour vehicle trips per day. 17. All construction on this project must be completed by Novem- ber 1, 1986. 18. This permit shall expire on November 1, 2016, unless extended by the District Commission. Notwithstanding the latter date, this permit shall expire one year from date of issuance if the permittee has not demonstrated an intention to proceed with the project. In any event, substantial construction must occur within two years of the issuance date. 19. No alteration of these plans shall be allowed except where written application has been made to the Agency of Environmental Conservation and approval obtained. (2) The Vermont Department of Health is to be contacted in regard to any regulations and/or licenses required by their department. WATER SUPPLY (3) The project is approved for connection to a municipal type water system approved by the Department of Health provided that all construction is in accordance with the approved plans and the Environmental Protection Rules, Effective September 10, 1982. SEWAGE DISPOSAL (4) The project is approved for connection to a municipal sewage collection system. The work shall be done in accordance with the Environmental Protection Rules, Effective September 10, 1982. PLUMBING (5) The applicant is reminded that all plumbing material and workmanship must meet the standards of the Environmental Protection Rules, Chapter 9, Plumbing; the National Plumbing Code; and the requirements of the Vermont Fire Prevention Section of the Department of Labor and Industry.
