SITE PLAN APPLICATION #SP-17-68
FINDINGS OF FACT AND DECISION
Carpenters Local 1996, hereinafter referred to as the applicant, is seeking approval to amend a
previously approved plan for a 6,332 sq. ft. building which includes: 1) 5,132 sq. ft. of "personal
instruction" use, and 2) 1,200 sq. ft. of "general office" use. The amendment consists of
converting 1,640 sq. ft. of "personal instruction" use to "auto repair" use, resulting in the
following uses: 1) 3,492 sq. ft. of "personal instruction" use, 2) 1,640 sq. ft. of "auto repair"
use, and 3) 1,200 sq. ft. of "general office" use, 5 Gregory Drive.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved plan for a 6,332 sq. ft.
building which includes: 1) 5,132 sq. ft. of "personal instruction" use, and 2) 1,200 sq. ft. of
"general office" use. The amendment consists of converting 1,640 sq. ft. of "personal
instruction" use to "auto repair" use, resulting in the following uses: 1) 3,492 sq. ft. of
"personal instruction" use, 2) 1,640 sq. ft. of "auto repair" use, and 3) 1,200 sq. ft. of
"general office" use, 5 Gregory Drive.
2. The owner of record of the subject property is Carpenters Local 1996.
3. The subject property is located in the Mixed Industrial - Commercial Zoning District.
4. The application was received on 9/27/2017.
5. The plan submitted is titled, "Carpenters Local 1996 5 Gregory Drive South Burlington,
Vermont", dated 4/03/97, and last revised on 4/17/97.
DIMENSIONAL REQUIREMENTS
6. Building coverage, overall coverage, and front yard coverage will remain unchanged as the
request is only for a change of use.
7. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Section 14.06 of the South Burlington Land Development Regulations establishes the following
general review standards for all site plan applications:

Only the standards below are affected by this application. All other standards will continue to be
met.
Vehicle and Bicycle Parking
8. The applicant will comply with Section 13.14 of the LDRs to include the new type and
location for bicycle racks, to accommodate the minimum requirement of two (2) (50% of
requirement) short-term bicycle parking space.
9. The vehicular parking requirement is 12 spaces and there are 12 parking spaces available,
including one (1) handicapped space.
Traffic
10. No change in traffic generation. The property is approved for a total of 5.0 vtes.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-68 of Carpenters Local 1996, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. This project shall be completed as shown on the plan and shall be on file in the South
Burlington Department of Planning and Zoning.
3. For the purpose of calculating road impact fees under the South Burlington Impact Fee
Ordinance, the Administrative Officer estimates that this change in use will generate
zero (0) additional vehicle trip ends during the p.m. peak hour.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to use of the building for the new use.
6. Any change to the site plan shall require approval by the South Burlington Development
Review Board or the Administrative Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision by
filing a Notice of Appeal with the secretary of the Development Review Board. This Notice of
Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of
this decision.
