HomeMy WebLinkAboutSP-95-0000 - Decision - 0002 Gregory DriveFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN _ t CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of David & Victoria Ross to convert a 24,000 square foot 2-story storage and distribution facility to a wholesale/retail/storage and distribution facility and expansion of the parking area, 2 Gregory Drive. On the 14th of February, 1995, the South Burlington Planning Commission approved the request of David & Victoria Ross for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of converting a 24,000 square foot 2- story storage and distribution facility to a wholesale/retail/storage and distribution facility and expansion of the parking area. This building was originally approved on May 28, 1985 and amended on October 22, 1985. The Zoning Board of Adjustment on 1/23/95 granted a conditional use permit for the proposed use. 2. This property located at 2 Gregory Drive lies within the IC District. It is bounded on the east and south by auto service and repair businesses, on the north by Williston Road and on the west by Gregory Drive. 3. Access/circulation: Access is provided by a 29 foot wide curb cut on Gregory Drive. No change proposed. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 14.9% (maximum allowed is 30%). Overall coverage is 43% (maximum allowed is 70%). Front yard coverage along Williston Road is 0% and front yard coverage along Gregory Drive is 31.9% (maximum allowed is 30%). This is an existing situation which is not being made worse by this application. Setback requirements are met. 5. Parking: This site requires a total of 31 parking spaces and 34 spaces including two (2) handicapped spaces are being provided. A bike rack is being provided as required under Section 26.253(b) of the zoning regulations. 6. Landscaping: There is no minimum landscaping requirement, based on building costs, for this project. The approved 1985 plan showed that evergreen trees were to be planted at the north end and along Gregory Drive. These were never planted. The applicant proposes to comply with this requirement by planting Mountain Ash trees. Staff recommended that four (4) trees (e.g., Littleleaf Linden) be planted along Williston Road 40 feet on center. This would promote the City's goal of lining Williston Road with street trees. 7. Traffic: This property is not located within the Traffic Overlay District. ITE estimates the previous use to have generated 18 vte's during the P.M. peak hour. ITE does not list a category for the proposed use. Applicant conducted a three (3) week traffic count at his current facility on Green Mountain Drive. This survey indicated that the proposed use generates an average of 13.9 vte's during the P.M. peak hour. Although the business will occupy additional space, the applicant does not anticipate a significant increase in trip ends. It was staff's position that the proposed use will probably not generate traffic in greater volumes than the previous use generated (i.e., 18 vte's). 8. Sewer: The additional sewer allocation required is 135 gpd . The applicant will be required to pay the per gallon fee prior to permit. 9. Dumpster: A screened dumpster storage area will be provided. 10. Lighting: Exterior lighting consists of the following: --- four (4) 75 watt spotlights aimed at the building sign. --- four (4) building mounted 75 watt flood lights mounted over two (2) doors. These flood lights should be replaced with downcasting shielded fixtures approved by the City Planner. --- two (2) building mounted 75 watt metal halide lights with downcasting fixtures. --- five (5) pole mounted metal halide lamps of unknown wattage with downcasting shielded fixtures on nine (9) foot poles. DECISION & CONDITIONS Based on above Findings of Fact, the South Burlington Planning Commission approves the site plan application of David & Victoria Ross to convert a 24,000 square foot 2-story storage and distribution facility to a wholesale/retail/storage and distribution facility and expansion of the parking area, 2 Gregory Drive, as depicted on a plan entitled "RIVCO, INC. - New Distribution Center, Gregory Drive, South Burlington, VT.", prepared by Michael Dugan, Architect, dated June 24, 1985, last revised January 3, 1995, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The Planning Commission grants a sewer allocation of 135 gpd for this project. A sewer allocation fee shall be paid prior to permit. 2 3. The site plan shall be revised prior to issuance of a zoning permit to show the changes listed below and shall require approval of the City Planner. Three (3) copies of the approved site plan shall be submitted to the City Planner prior to permit issuance. a) The site plan shall be revised to show four (4) trees (e.g. Littleleaf Linden) with a minimum size of 22" caliper planted along Williston Road 40 feet on center. 4. Prior to issuance of a zoning permit, the applicant shall post a landscape bond in an amount determined by the City Planner. The bond shall remain in effect for 3-years to assure that the planted landscaping takes root and has a good chance of surviving. 5. For purposes of calculating required road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the proposed use will generate no additional vehicle trip ends during the P.M. Peak Hour. 6. All lighting shall be downcasting and shielded so as not to cast light beyond the property line. Any change in lighting must be approved by the City Planner prior to installation. Prior to issuance of a certificate of occupancy/compliance permit, the applicant shall replace the four (4) building mounted floodlights with downcasting and shielded fixtures approved by the City Planner. 7. The zoning permit shall be obtained within 6 months or this approval is null and void. 8. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the building. 9.
