HomeMy WebLinkAboutSP-16-60 - Decision - 0002 Gregory Drive#SP-16-60 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING & ZONING MICHAEL DUGAN — 2 GREGORY DRIVE SITE PLAN APPLICATION #SP-16-60 FINDINGS OF FACT AND DECISION Michael Dugan, hereinafter referred to as the applicant, is seeking site plan approval to amend a previously approved plan for a 31,000 sq. ft. building (including a 7,000 sq. ft. mezzanine) consisting of 24,000 sq. ft. of wholesale/retail/storage and distribution facility, and 7,000 sq. ft. of auto, motorcycle, boat and RV sales, service and repair. The amendment consists of revising the parking layout resulting from the relocation of an overhead door, 2 Gregory Drive. Based on the findings below, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT The applicant is seeking site plan approval to amend a previously approved plan for a 31,000 sq. ft. building (including a 7,000 sq. ft. of mezzanine) consisting of 24,000 sq. ft. of wholesale/retail/storage and distribution facility, and 7,000 sq. ft. of auto, motorcycle, boat and RV sales, service and repair. The amendment consists of revising the parking layout resulting from the relocation of an overhead door, 2 Gregory Drive. 2. The owner of record of the subject property is Two Gregory, LLC. 3. The subject property is located in the Mixed Industrial & Commercial (Mixed IC) Zoning District. 4. The application was received on August 29, 2016. 5. The plan submitted is entitled, "Site Plan Add -On Accessory Outlet 2 Gregory Drive South Burlington, Vermont" prepared by Michael Dugan AIA, dated October 5, 2005, with a last revised date of 9/06/16. DIMENSIONAL REQUIREMENTS 6. All dimensional requirements will continue to be met. -1- #SP-16-60 SITE PLAN REVIEW STANDARDS Only the standards below will are affected by this application. All other standards will continue to be met. Parking 7. A total of 34 parking spaces are required and 40 spaces will be provided including one (1) handicapped space. One (1) additional handicapped spaces must be provided so the plan should be revised to show parking space #17 as a handicapped space. This application results in a two (2) space reduction in the number of spaces from 42 to 40 spaces. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan #SP-16-60 of Michael Dugan, based on the following conditions: All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and will be on file in the South Burlington Department of Planning and Zoning. 3. The site plan must be revised to show the changes below and will require approval of the Administrative Officer. Three (3) copies of the approved revised plan must be submitted to the Administrative Officer prior to permit issuance. a. The site plan must be revised to show parking space #17 as a handicapped space. 3. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The Applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to the use of the new parking layout. 5. Prior to issuance of a zoning permit, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. 6. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
