Trip Generation Staff and the applicant reviewed the history of the property following the July 17'h Board meeting to determine what the pre-existing, approved maximum trips generation is for the property. The following information was uncovered. • The Planning Commission approved the building for office / warehouse use in August 1988. • The Administrative Officer issued a zoning permit to construct the building, as warehouse only, in July 1989. • The acting Administrate Officer issued a certificate of occupancy for the property for "mixed office / warehouse" in 2000. • The Administrative Officer issued a sign permit (not related to the Land Development Regulations) for Willari's Self Defense" in January 2011. There is sufficient lack of clarity in the history of this property for staff to request that the Board consider a range of possible pre-existing trip generation figures to assign to the property. Staff SP 12 3l 7GreenTreeDrive_GreenMtnHoldings page 2 of 4 presents two possible viable options and has indicated to the applicant that they may present others if they choose. Optionl: Based on the original zoning permit issued in 1989, the Board determines that the only approved use was warehouse for the entire building. This results in a maximum trip generation figure of 4.51. Any combination of uses which exceeds this figure would require Board approval. Option 2. Based on the original Planning Commission approval and subsequent Certificate of Occupancy issued in 2000, the Board determines that office and warehouse uses were each approved for the building. Using the applicant's warehouse/office breakdown for three (3) of the four (4) suites, and considering the "Valleri's Self Defense Space", which at some point in 1990s became a recreational use without a permit as simply warehouse, this results in a maximum trip generation figure of 10.0. Staff has requested that the applicant provide the city with the current and near -future uses of the property in order to determine how these uses match up with the traffic generation options above. Staff has indicated that should the current or future uses exceed whichever maximum figure the Board determines, the applicant will be responsible for seeking Board approval for such and paying any result traffic impact fees. As noted above, any changes proposed to category of use and resulting traffic shall be reviewed under the umbrella permit, and limited to the maximums set herein. SITE PLAN REVIEW STANDARDS Pursuant to Section 14.03(A) (6) of the Land Development Regulations, any PUD shall require site plan approval. Section 14.06 establishes the following general review standards for all site plan applications: Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. The applicant is seeking an umbrella approval for the following uses: Agriculture & construction equipment sales, service & rental; Processing & storage; Distribution and related Storage, with >15% of GFA in office or principal permitted use by same tenant, Equipment service, repair & rental; Transportation Services; Light manufacturing; Warehousing, processing, storage & distribution; Recreation facility, indoor, Office, general, Research facility or Laboratory; Printing & binding production facilities; Radio & Television Studio; Pet Grooming. Staff finds no issues with the approval of these uses as of right on the subject property. There are 28 parking spaces provided on site. The property contains 14,087 square feet of space in one building. Staff will calculate the actual impacts on parking and traffic as changes in use are proposed for the building. With few exceptions of the most intensive uses of restaurant and retail, the building and parking can support all of the proposed uses. If the land development regulations change so that any of the above uses are no longer permitted, then those uses which are no longer permitted shall no longer be approved. These uses shall not exceed in need 28 parking spaces or 4.51 pm peak hour vehicle trip ends, without further review and approval by the Development Review Board. Traffic As noted above, any changes proposed to category of use and resulting traffic shall be reviewed under the umbrella permit, and limited to the maximums set herein. The existing uses are grandfathered at a total of 4.51 pm peak vehicle trip ends. Any changes in use shall not exceed 4.51 pm peak hour vehicle trip ends without returning to the Development Review Board for specific approval thereof. Section 13.01(G)(5) requires that bicycle parking or storage facilities are provided for employees, residents, and visitors to the site. A bicycle rack is shown on the plans. Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. There are no changes proposed to the height of the existing buildings. Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. No changes are proposed to utility services. The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. There are no changes proposed to the existing structures. Proposed structures shall be related harmoniously to themselves, the terrain and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. Section 13.01(G)(5) requires that bicycle parking or storage facilities are provided for employees, residents, and visitors to the site. A bicycle rack is shown on the plans. Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. I would like to comment on the conclusions made and provide additional information that was not available to you at the time of your review of this project. Under Issues: I count 30 Austrian Pines on the property and 3 that are planted in the City's Right of Way. We paid a bill to Willis Landscaping in Dec '89 in the amount of $13897.00 for the original landscaping on this site. See attached. In the summer of 1992 we had to replace almost all the Austrian Pines and several of the Plantings due to poor soil conditions. I am unable to find the bill for this work but I believe it was in the $7000 to $8000.00 price range. The "missing" trees are a result of trees that have died since that time period. I have not replaced them since I felt that the lot is quite heavily planted at this time. The 3 remaining Austrian Pines that are in the Right of Way were put there as spares for this lot but have since provided an ideal visual barrier from the "portapotties" stored on the lot behind us. The staff's recommendation that we plant an additional $3500.00 worth of Austrian Pines would cause the lot to be over planted and could effect the survivability of the new plantings as well as the existing trees and shrubs. This lot is already the most landscaped lot in the subdivision and would not benefit from any additional work. The proposed amendment would alter the approved site plan for the property to reflect the landscaping planted. This accounts for a reduction in the required landscaping. The original site plan approval stipulated that $15,000 worth of landscaping be installed. Approved plans called for 39 Austrian Pine, 14 Sargent Crabapple, 17 Emerald Lust Norway Maple, 47 Globe Arborvitae, and 8 Seagreen Juniper ($18,205 11 worth of landscaping). The approved landscaping plan was not implemented. The applicant has proposed an amended site plan that does not include any new landscaping, but asks the Board to accept the current value of what was planted and has matured (see enclosed letter). The property is located within the Mixed Industrial and Commercial District. It is bounded on the south by an office building, on the east by a residence, on the north by an undeveloped parcel, and on the ;vest by a light industrial building. LandscQLm&. Mr. Palmer noted that the trees at the Williston Road location were cut down by someone who "got carried away." He said he had replaced them but they were then taken down by the power company. There is a new landscaping plan for Kimball Avenue. Mrs. Maher said this should be reviewed by the Natural Resources Committee. Mr. Krassner said the Committee is developing a reasonable plan for replacement of trees that are cut down in violation of Commission stipulations. This will be brought to the Com- mission in the fall. Mrs. Maher noted that credit was given on Kimball Ave. for existing trees that have now been cut down and this should be reviewed as well. Green Tree Park Mr. Desmond said they have moved the holding pond to a location approved by the City Engineer. They have also added 2 to 3 ft. to the top of the berm and substantially increased plantings for a screen. The screen now comes all the way around to the front, though they are not happy with blocking the view. Members felt they had no probelm moving some trees from the western side to allow for a view. Mr. Desmond said they have turned the building a little to allow deeper' parking spaces. There driveway is now 24 ft. Mr. Weith noted the Fire Chief had a problem with the location of the second fire hydrant. There should be 2 within 800 ft.. It is shown correctly on the subdividion plan. The applicant has addressed the issues raised by the Water Dept. and will loop to the 8" AC water main on the east side of Green Mountain Drive. There will be l service per building. The Developer shall repair or replace any faulty or defective work or improper material which may appear within 3 year of completion. 5. For the guaranty of Developer's performance of all requirements hereinabove set forth, Developer and Bank agree that the sum of $(Amount set by planning commission or its designee) shall be set aside and held in escrow by the Bank and shall be available for payment to the Municipality, in accordance with the terms herein set forth. 6. The Municipality will promptly submit -to the Developer a copy of such statement as it files with the Bank. The consent of the • Developer to such payment by the Bank to the Municipality shall not be required. The Bank shall incur no liability to the Developer on account of making such payment to the Municipality, nor shall the Bank be required to inquire into the propriety of any claim by the Municipality of default on the part of the Developer or into the use of such funds by the Municipality in completing such improvements. The Municipality shall not file with the Bank a statement of default until sixty (60) days after notice has been sent by it to the Developer by certified mail, return receipt requested, setting forth its intention to do so. 9. All monies released by the Bank to the Municipality pursuant to paragraph 6 shall be used by the Municipality solely for the purpose of performing obligations imposed upon the Developer by that portion of this agreement upon which the Developer is then in default. Any work to be performed by the Municipality pursuant hereto shall be let on a contractual basis, or on a time and material basis, or shall be performed by the Municipality with its own work force and equipment or shall be accomplished in such manner as in the judgment of the Municipality shall accomplish the work most expeditiously and economically. 10. If monies are released by the Bank to the Municipality pursuant to paragraph 6 and it shall later develop that a portion of the released monies are surplus to the Municipality's needs, any such surplus shall be refunded by the Municipality to the Bank to be held and distributed by the Bank pursuant to the terms of this agreement. 11. The Bank will not refuse or delay to make such payments to the Municipality when requested by the Municipality by the appropriate statement, and Developer will not interfere with or• hinder such payments by the Bank to the Municipality. There was extensive site work on the overall Green Tree Park subdivision. The north-west corner of the subdivision which is also the north-west corner of this lot, was built up about 10 feet to prevent drainage to the north-west. This site plan changes that back to the original drainage by draining a portion of the site toward the north-west. The site should drain toward the south-east. 2) Retention basins must have discharge pipes. They serve to hold the storm water and discharge it gradually. 3) The entrance curb shall be depressed concrete type. 5) WHITE ROCK POINT, BELTER'PROPERTY 1. This development will require extensive earth moving. The fill area must be constructed in conformance to State Highway Department specifications including compaction tests. This work and all other road and utility work 'must be supervised by a professional Engineer and certified by this Engineer as to conformance to the plan. 2. Trees and street lights shall be in place before lots are sold not after when the new owner does not want them placed where theAcalls for them. 3. The landscape plan meets the $5,300 landscaping requirement. Intersection Improvements: Mr. Belter agreed to complete four intersection improvements prior to permit for any of these lots. Also, each lot developer must pay $880 per lot at time of building permit for a share of long range improvements to this dangerous intersection. These fees also were agreed to by John Belter and the City. (See letter of September 1, 1987) A sewer allocation of 450 gpd will be needed and will be deducted from John Belter's allocation for the entire subdivision. The $2.50 per gallon fee must be paid prior to permit. 4) KEN DESMOND, GREEN TREE PARK, SHUNPIKE ROAD Mr. Ken Desmond proposes to construct a 14,087 square foot flex building for mixed office/warehouse use. He is proposing a maximum of 3 units depending on the needs of prospective tenants. If the building is designed to house more than one tenant, approval by the Zoning Board for multiple use will be required. Access/Circulation: Access is shown from a 27 foot wide driveway off of Green Tree Drive. Circulation is shown around the entire building. The drive around the south and west side of the building ranges from 19 to 28 feet wide. The drive along the east side of the building ranges from 12 to 30 feet wide. A large 57 foot wide paved area is proposed in the rear of the building (north side) with 3 loading docks. Parking: The proposed uses require 13 spaces assuming 19 employees. The plan shows a 24 space parking -lot. This should be sufficient. The plan also shows an area designated for 10 future spaces in the event more spaces are needed. Zoning regulations require 24 foot wide parking aisles serving double rows of parking. The plan shows only a 22 foot wide parking aisle. Landscaping: The building requires $13,000 in landscaping. As a condition of approval for the final plat application of the Green Tree Park subdivision, the subdivider was required to plant. 6 Austrian Pine, 34 Rugosa Rose and 2 Marshall's Seedless Ash as shown on the plan on lot #6 (see enclosed minutes). As a condition of site plan approval for this development, $13,000 of Memorandum - Planning July 12, 1988 agenda items July 8, 1988 Page 3 additional landscaping is required (Section 19.104a of the zoning regulations). This site plan does not show any additional landscaping other than that which was required for subdivision approval. Therefore, there is a $13,000 deficit in required landscaping. It should be noted that a permit will not be issued for this development until the landscaping bond as required for subdivision approval is posted. (1/5/88 minutes) City policy requires that a 5 foot minimum buffer strip be provided between paved areas and property lines for snow storage. The plan shows only a 2 foot buffer strip between the proposed parking lot and the south property line. This should be increased to 5 feet. A residential area adjoins the west property line of the proposed development. The plan shows a 3 foot high landscaped berm between this residential area and the proposed loading dock area. I feel a 6 or 7 foot berm would better shield noise from this potential high noise area. Traffic: The proposed development will generate approximately 23 trip ends during the peak hour. Sewer: A sewer allocation of 285 gpd will be needed and will be deducted from the approved allocation for the entire subdivision. The $2.50 per gallon fee must be paid prior to permit. Other: See Bill Szymanski's and Chief Goddette's comments. 5) BELTER, WHITE ROCK POINT, FINAL PLAT John Belter proposes a 36 lot single-family development located at the end of Country Club Drive. The area is zoned R4 and Floodplain. Streets: The 30 foot wide public streets will be constructed within a .60 foot right-of-way. The street begins between the Myette and Hong properties and encircles the property. It ends in a cul de sac adjacent to the Gagnon and Incavo properties. Curbs will be installed with a sidewalk on one side. Density and Lot Size: The 14.68 acres allow a maximum density of 59 units. The proposed density is 36 single-family lots. After removing 15% for streets (2.2 acres), the minimum density is 50 units. Lots have a minimum of 80 feet. of frontage. and 9500 square feet as required in R4. Page 3 Land Use Permit Amendment #4C0149-4 11. The Permittee and all assigns and successors in interest shall install and maintain water conserving plumbing fixtures. The plumbing fixtures shall operate with the following specifica- tions: (1) internal system water pressure of 50 psi maximum, (2) toilets with a maximum of 3.5 gallons per flush, (3) showerheads operating with a maximum of 3 gallons per minute, and (4) faucets on sinks and 1 ays shall operate at a maximum of 3 gallons per minute. An alternative water conservation plan may be presented to the Commission for approval before implementation. The ap- proved alternate shall be implemented and maintained by the Permittee for the duration of the permit. 12. The Permittee shall comply with Exhibits #7 and #8 for erosion control. Hay bale dams and silt fences shall be installed as depicted on the plans prior to commencement of construction. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. From October 15 to April 15 of the calendar year the Permittee shall abide by all erosion control measures outlined in the "Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites. All erosion control devises shall be periodically cleaned, re- placed and maintained until vegetati of n is permanently estab- lished on all slopes and disturbed areas. The Commission re- serves the right to schedule hearings and site inspections to review erosion control and to evaluate and impose additional conditions with respect to erosion control as they deem ne- cessary. 13. Prior to commencement of construction, the Permittee shall have a professional engineer, or other qualified person certify that the erosion control plan contains site specific erosion control mea- sures necessary to provide a level of protection at least equiva- lent to the procedures outline in the "Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites." 14. In addition to conformance with the requirements of condition #12, the Permittee shall not cause, permit or allow the discharge of waste materials into any surface waters. Compliance with the requirements of this condition does not absolve the Permittee from compliance with 10 V.S.A., Chapter 47, Vermont's Water Pollution Control Law. 15. The Permittee and all assigns and successors in interest shall continually maintain the landscaping as approved in Exhibit #17 by replacing any dead or diseased plantings as soon as seasonably possible. The signs as depicted in exhibit #13 shall be of colors which conform to the colors of the building. 18. All heated structures approved herein shall be constructed with insulation with an R Value of at least R-19 in the exterior walls, at least R-38 in the roof or cap and at least R-10 around the foundation or slab to comply with the ASHRAE 90-80 standards. 19. The installation and or use of electric resistance space heating is specifically prohibited without the prior written approval of the District Environmental Commission. 20. All construction on this project must be completed by December 15, 1989. 21. This permit shall expire on October 15, 2019 unless extended by the District Commission. Notwithstanding, this permit shall expire one year from date of issuance if the Permittee have not demonstrated an intention to proceed with the project. All the conditions of Land Use Permit #4CO149 and amendments are in full force and effect, except as amended herein. 2. The project shall be completed, operated and maintained as set forth in accordance with the plans and exhibits stamped "Ap- proved" and on file with the District Evi ronmental Commission, and in accordance with the conditions of this permit. No changes shall be made in the project without the written approval of the District Environmental Commission. 3. The District Environmental Commission maintains continuing juris- diction during the lifetime of the permit and may periodically require that the permit holder file an affidavit certifying that the project is being completed, operated and maintained in accor- dance with the terms of the permit. By acceptance of the conditions of this permit without appeal, the Permi ttee confirms and agrees for himself and all assigns and successors in interest that the conditions of this permit shall run with the land and the land uses herein permitted, and wi 11 be binding upon and enforceable against the Permi ttee and all as- signs and successors in interest. 5. By acceptance of this permit the Permi ttee agrees to allow representatives of the State of Vermont access to the property covered by the permit, at reasonable times, for the purpose of ascertaining compliance with Vermont environmental and health statutes and regulations and with this permit. 6. The project is approved for the following maximum cumulative impacts: 28 vehicle parking spaces; 285 gallons per day of water and wastewater; 57 vehicle trips per day; 9 peak hour vehicle trips; 150 kilowatts of electricity. 7. This permit hereby incorporates all of the conditions of the Water Supply and Wastewater Disposal Permit #WW-4-0048 issued on November 30, 1988 by the Regional Engineer, Division of Pro- tection, Department of Environmental Conservation, Agency of Natural Resources. Conditions #2, #3, #7 and #8 of said permit are as follows: (2) The project shall be completed as shown on the plans Project 86-82 Sheet SP 1 "Site Plan" dated 8-16-88 revised 9-9-88; Sheet SP 3 "Miscellaneous Details" dated 8-17-88 prepared by Trudell Consulting Engineers, Inc. and which have been stamped "approved" by the Division of Protection. The pro- ject shall not deviate from the approved plans without prior written approval from the Division of Protection. (3) All conditions set forth in Subdivision Permit #EC-4-1120 dated August 5, 1987 and EC-4-1120-1 dated April 21, 1988 shall remain in effect except as modified or amended herein. (7) The project is approved for water supply by construction and utilization of the municipal water service depicted on the approved plans. No other means of obtaining potable water shall be allowed without prior review and approval by the Division of Protection. (8) The project is approved for connection to the South Burlington Airport Parkway wastewater treatment facility for a maximum of 285 gallons per day. Page 3 Land Use Permit Amendment #4C0149-4 8. The Permittee shall apply and maintain water and/or calcium chloride on all roadways or disturbed areas within the project during construction and until pavement and/or vegetation is fully established to control dust. 9. The building approved herein is not approved for any manufac- turing use or the on -site disposal of any process wastes. The Permittee shall apply and receive approval for any change in the use of the buildings which involves the storage or handling of any regulated substances or the generation of hazardous wastes. 10. The installation of floor drains is specifically prohibited without the prior written approval of the District Environmental Commission. 11. The Permittee shall apply to the District Environmental Commis- sion for approval for any change in the use of the building and land which would cause noxious or unhealthy emissions into the air or injection of toxic wastes into the soils. 12. The Permittee and all assigns and successors in interest shall install and maintain water conserving plumbing fixtures. The plumbing fixtures shall operate with the following specifica- tions: (1) internal system water pressure of 50 psi maximum, (2) toilets with a maximum of 3.5 gallons per flush, (3) showerheads operating with a maximum of 3 gallons per minute, and (4) faucets on si nks and 1 ays shal 1 operate at a maximum of 3 gal lons per minute. An alternative water conservation plan may be presented to the Commission for approval before implementation. The ap- proved alternate shall be implemented and maintained by the Permittee for the duration of the permit. 13. The Permittee shall comply with Exhibits # 7 and #8 for erosion control. Hay bale dams and silt fences shall be installed as depicted on the plans prior to commencement of construction. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. From October 15 to April 15 of the calendar year the Permittee shall abide by all erosion control measures outlined in the "Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites. All erosion control devises shall be periodically cleaned, re- placed and maintained until vegetati of n is permanently estab- lished on all slopes and disturbed areas. The Commission re- serves the right to schedule hearings and site inspections to review erosion control and to evaluate and impose additional conditions with respect to erosion control as they deem ne- cessary. Page 4 Land Use Permit Amendment #4C0149-4 14. Prior to commencement of construction, the Permittee shall have a professional engineer, or other qualified person certify that the erosion control plan contains site specific erosion control mea- sures necessary to provide a level of protection at least equiva- lent to the procedures outline in the "Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites." 15. In addition to conformance with the requirements of condition #12, the Permittee shall not cause, permit or allow the discharge of waste materials into any surface waters. Compliance with the requirements of this condition does not absolve the Permittee from compliance with 10 V.S.A., Chapter 47, Vermont's Water Pollution Control Law. 16. The Permittee and all assigns and successors in interest shall continually maintain the landscaping as approved in Exhibit #17 by replacing any dead or diseased plantings as soon as seasonably possible. 17. The installation of exterior light fixtures is limited to those approved in Exhibit #17, and shall be mounted no higher than 20 feet above grade level. All exterior lighting shall be in- stalled or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. High pressure sodium lights, or any other lights which shed a yellow -orange illumination are strictly prohibited. 18. The signs as depicted in exhibit #13 shall be of colors which conform to the colors of the building. Any lighting of the sign must be approved by the District Commission. 19. All heated structures approved herein shall be constructed with insulation with an R Value of at least R-19 in the exterior walls, at least R-38 in the roof or cap and at least R-10 around the foundation or slab to comply with the ASHRAE 90-80 standards. 20. The installation and or use of electric resistance space heating is specifically prohibited without the prior written approval of the District Environmental Commission. 21. All construction on this project must be completed by December 15, 1989. 22. This permit shall expire on October 15, 2019 unless extended by the District Commission. Notwithstanding, this permit shall expire one year from date of issuance if the Permittee have not demonstrated an intention to proceed with the project. In any event, substantial construction mint occur within two years of the issuance date. There were also problems with the owner of the adjacent property. A cul de sac was requested but was turned down by the Planning Com- mission. Since that time, problems have been ironed out, and Mr. Gregory is now a co -applicant. Mr. Trudell requested that the stipulation requiring the upgrade of Mr. Gregory's road be removed as this applicant has no control over Mr. Gregory or his road. Ms. Perkins advised the City is trying to have Mr. Gregory put 2" more pavement on the road and post a $15,000, 2-year bond. The City Attorney said it could be as much as a month before this is accomplished. Members agreed they wanted to connect the road to Gregory Drive and that they couldn't hold this developer "hostage" because of the problems with Gregory Drive. Mr. Trudell-briefly reviewed the project. The road will be directly opposite the Digital access. Water and sewer will be from Shunpike Rd. and will connect to water on Gregory Drive. A landscaping berm will be created as a buffer to the residential property. Plantings will also help with this. Mr. McQuide, a resident of Shunpike Rd., asked if there is a chance Gregory Drive will never become a city street and Mr. Gregory will deny use of the road to traffic from this de- velopment. Mr. Trudell said that Gregory is now a co -appli- cant, and the agreement with him is non -revocable. It will be a pre-fab metal building, containing 1100 sq. ft. of office space. There will be an additional access road, 24 ft wide on the north side. 60 feet of fence will be removed for this. There will be 8 parking spaces. Two gates will keep the public off the runway. An engineer is being employed to design the septic system. A pumping station will probably be required to allow joining with the existing system. The building will have 4 overhead doors and will be 22 ft, 6 in. to the peak of the building. Clerk ,Memorandum August 17, August 12, Page 3 - Planning 1988 agenda items 1988 Circulation: Circulation is showy► on three sides of the building. d The 10 parking spaces located at the south end of the near the new addition look like they might interfere with the proposed loading dock. There is only 21 feet between the parking spaces and the dock. I do not think that a tractor trailer could manage in such a tight space. Access to the proposed liquid nitrogen tank is provided via a 17 foot wide access drive between the loading dock and property line. This does not meet the minimum access drive width requirement of 20 feet. Also, in this location, the paved access drive abuts the property line. This does not meet the City's policy that a 5 foot buffer be provided between paved areas and property lines for snow storage. landscaping: The addition would require $600 in landscaping. Mr. Palmer proposes to install two 3 inch caliper maple trees (I suggest Sugar or Red Maple) which would meet the $600 requirement. The proposed location of these trees is not shown on the plan. I suggest that they be located in the green area just south of the driveway where there currently are no trees. Other. The location of the existing building as shown on the plan is inconsistent with the location of the building as shown on the approved plan dated 9/7/78. The south end of the existing building is shown to be 62 feet from the property line on this plan while the 9/7/78 plan shows the building to be 46 feet from the property line. If the correct location of the building is consistent with how it is shown on the approved 9/7/78 plan, the proposed 40' x 50' foot addition will not meet setback requirements. 5) KEN DESMOND, LOT NO. 6, GREEN TREE PARK At the 7/12/88 Planning Commission meeting, it was moved to continue discussion of Ken Desmond's proposal to construct a building for mixed office/warehouse use on lot #6 in Green Tree Park. Mr. Desmond has since revised his plan to address several. issues and concerns raised at the 7/12/88 meeting, including parking, landscaping, aisle widths, and drainage. Parking: Mr. Desmond estimates that a maximum of 30% of the building will be used for office use. The remainder will be used for warehouse use. He also estimates that 10 employees will be working in the warehouse area of the building. Based on these 3 .Memorandum August 17, August 12, page 4 - Planning 1988 agenda items 1988 figures and the City's parking space requirements, the building will require 24 parking spaces. The plan shows 27 spaces plus 5 future spaces if determined to be necessary (32 total spaces). The proposed number of spaces should be sufficient. Landscaping: As discussed at the 7/12/88 meeting, the building requires $13,000 in landscaping. Also, the developer is required to install 6 Austrian Pine, 34 Rugosa Rose and 2 Marshall's Seedless Ash on lot #6 as a condition of subdivision approval. This represents approximately $15,000 worth of landscaping required for the lot and the proposed building. The proposed landscape plan shows Austrian Pine lining the western and northern property lines. Marshall's Seedless Ash are shown lining the eastern property line. Globe Arborvitae and Sargent Crabapple are proposed for the front of the building. The proposed landscape plan meets the $15,000 required landscaping value. Also, the Austrian Pine form a nice buffer between the building and the residential properties to the west and north. Mr.. Desmond has also agreed to raise the berm an additional two feet. Drainage: Mr. Desmond met with Bill Szymanski to discuss the drainage and retention ponds issue. Mr. Desmond has revised the plan to meet Bill's concerns. Other: The aisle width of the parking lot has been increased to 24 feet to meet requirements. Also, a 5 foot buffer is shown between the parking lot and south property line. The minimum width of the access drive surrounding the building is 12 feet. The access drive will be posted for one-way circulation around the building. Ken Desmond and I walked the site on July 13, 1988 and discussed his proposed site plan and landscaping. My opinion to the Planning Commission concerns are summarized below. There is a nice buffer on the western portion of the lot between the residential area to the west and the proposed building and loading dock area. However, the buffer consists of deciduous trees which will lose a significant amount of their visual and noise shielding ability during winter months. It is my opinion that either the height of the berm be adequately increased or a significant number of coniferous trees be planted. Mr. Desmond said he would be willing to build up the berm an additional two feet. I am not sure what effect increasing the height of the berm two feet would have on shielding the building and noise from the residential area. I feel noise from the loading dock area would be adequately reduced, however, the visual impacts would remain. I would recommend that 8 to 10 coniferous trees be planted in addition to raising the berm two feet. I feel this would adequately shield the new building from the residential area. The cost to install this additional buffering would be approximately $2500 (assuming ten 5 foot Colorado Spruce) plus the cost of adding 2 feet to the berm and grading. I do not feel this is unreasonable considering Mr. Desmond is required to install $13,000 in landscaping for this building, not including what is required as a condition of Subdivision Approval. Mr. Trudell spoke for the applicant. He said that the entrance to the park will be across from the eastern entrance to Digital on Shunpike Rd. (the extension of Kimball Ave.). The road will continue until it meets with Gregory Drive and continue out to Williston Road. tie pointed out were water and sewer would come in from Shunpike Road. The lights would be downward pointing luminars. They also would be looking for earth tone buildings in the park. Mr. Jacob asked for clarification of where the water main was coming from. Mr. Trudell pointed the location out on the map. Mrs. Maher asked for clarification of the covenants for the park. Mr. Trudell said that there would be an architectural control committee that had to give approval before the applicant could go to any other board. Mrs. Maher asked Mrs. Lafleur if she was satisfied with the location of all driveways. Mrs. Lafleur said that there was room for all curb cuts. She suggested that there be no curb cuts on Shunpike Road. She also suggested that the curb cuts be designated on the map. Mr. Trudell said that he had a problem with that as he had done that in the past and they often as not end up tearing theca up. Mr. Jacob said that he would be satisfied to just specify that there be no curb cuts off Shunpike Road. Mrs. Hurd noted that there was no truck traffic allowed on Shunpike Road. She felt that this development would relieve some of the traffic that does use Shunpike Road. Mr. Belter agreed. Mr. Jacob suggested that the signs prohibiting trucks should be updated and that the police could be notified to enforce the ordinance. Mrs. Lafleur asked about sidewalks. She said that this area has a great potential for a new bus route and that the commission should consider sidewalks at least on one side of the roads. She pointed out that there is also a 60 foot right of way on the northern side of this development leading to the 4 acres of industrial land owned by Bill Szymanski. Mrs. Fisette from Shunpike Road said that she was very concerned about the traffic from this development. She said that the only trucks that do not use the street are the trucks from Digital. She said that Allied trucks from further down Shunpike Road often used it. She was afraid that there would be more trucks from this development. Mr. Belter felt that this development would relieve some of the traffic. Mrs. Lafleur said that she again would speak to the police chief. A resident of Shunpike Road asked how high the berms would be. Mr. Trudell said that they would vary from 8 to 15 feet. lie also noted that the land was going to be lowered in the development. Mrs. Fisette asked how high these buildings could be. Mrs. Lafleur explained the height restrictions in the zoning ordinance. Mr. Schneider suggested that the land could be rezoned for residential. Mr. Jacob explained that the zoning was in place. Mrs. Fisette asked how this development would effect water drainage in the area. Mr. Trudell explained the drainage plan and said that he felt drainage for the neighbors would be better. Mrs. Lafleur said that the city engineer had recommended a drain pipe on the northern part of the property. Mr. Trudell said that he felt that area could be taken care of with grading. Mrs. Lafleur said that he would have to work it out with Mr. Szymanski. Mr. Trudell explained the landscaping plan with Austrian Pines and other low plantings that had not been decided on yet. The interior street trees would be ash. A neighbor asked if'the commission could do anything about the car traffic this development would generate on Shunpike Road. Mr. Jacob said that they could not stop car traffic from using the road. He noted that • cars would have many more ways to get to Williston Road. Mr. Trudell said that he felt more people heading from Essex to Hinesburg Road would use Gregory Drive. Mrs. Fisette noted that the Williston Road access to Gregory Drive was on a blind hill and she doubted if many people would use it. Mr. Trudell said that the Agency of Transportation had told the developer that he had to put in a new lane on Williston Road going down the hill toward Williston. Mrs. Lafleur said that she felt that the commission had already requested that from Mr. Gregory when he got his approval. Mr. Trudell said that he did not know what Mr. Gregory was asked to do but he would check into what was required of him. A neighbor asked for clarification of the entrance on Shunpike Road. It was explained that Shunpike Road curved and there is some confusion because the road is actually an extension of Kimball Ave. Mrs. Lafleur said that she had spoken to Mr. Szymanski about renaming this section Kimball Ave. Mr. Szymanski said that he was concerned because the road is still named Shunpike when it gets goes over the town line into Williston. A neighbor said he was still concerned about the traffic and he wondered if they could make a law that would prohibit traffic from these companies the way that Digital is now. Mrs. Hurd pointed out that there is no law requiring Digital not to use the road. It is a courtesy agreement from Digital. Mrs. Fisette asked if speed bumps could be installed. Mr. Jacob said that the neighbors could ask the City Council to do that but that the Planning Commission could not require those. A neighbor asked what the time frame was. Mr. Trudell said that he would guess that there would be a five year build out time. Mr. Jacob said that he didn't think that they would get through the permit process and get sewer capacity before next spring. M6. Lafleur pointed out that a pedestrian trail had to be shown on the map. Mrs. Lafleur noted that Act 250 put stipulations on the Gregory Drive development that the level of service at certain intersections had to stay at level of service "c" and she imagined that they would put the same stipulations on this developer. Mr. Trudell asked for clarification on where the sidewalks would be. fie said his understanding is that the sidewalks would only be on his property and not on the Gregory Drive section on Mr. Gregory's land. The commission agreed. PLANNING COMMISSION 12 MAY 1987 PAGE, 4 Mrs. Hurd moved that the South Burlington Planning Commission approve the preliminary plat application of Green Tree Park (formerly Invrest) to subdivide a 29.6 acre parcel at 200 Shun ike Road into 13 Industrial- Cowmercial lots as depicted on a 10 ^page set of plans entitled Green Tree park, Industrial -Commercial subdivision, Gregory Drive, South Burlington, Vermont",prepared by Trudell Consulting Engineers, Inc., page one dated 3-16-87 with the following stipulations: 1. The final plat shall show building envelopes that meet all the required 2. Prior to final plat, the applicant shall submit a revised landscaoin • plan showing a buffer between the austrian pines on the western boundary to provide a consistent landscaping buffer to the R4 District A landscaping bond for $18,500 plus the cost of additional plantings required along the western edge shall be posted prior to construction. 3. Concrete sidewalks shall be required on one side of Gregory Drive, Green Tree Drive, and Shunpike Road (extension) frontage. 4. A 15 foot wide strip of land along the Muddy Brook property line shall be deeded to the City for a pedestrian trail easement. Its location shall be approved by the Natural Resources Committee and shown on the final plat. 5. A sewer allocation of 400 Qallons per day per lot shall be reserved 15200 gpd total.). Each lot will receive an allocation from the total and will be oblinated to pay the $2.50 per gallon fee. No building permits will be issued until capacity is available from the uperaded Airport Parkwav Plant. 6. All legal documents for streets, pedestrian trails, water, and sewer lines should be prepared for the City attorney's review, prior to Final Plat. 7. New mylars for the relocated Gregory Drive extension shall be submitted at final plat and recorded. It shall be this applicant's obligation to pay for and construct the connection to Gregory Drive. 8. No building permits will be issued before the through road is constructed to Gregory Drive. No building permits will be issued until road access is available to each lot. 9. The cul-de-sac paved width shall be 24 feet minimum to allow for parking. 10. In the discussion that followed Mrs. Hurd requested clarification that the sidewalk in stipulation 4 was on the section of Shunpike Road in front of this development (the commercial section) and not the residential section of Shunpike Road. Mrs. Hurd asked where the holding pond in #13 was situated. Mr. Trudell said that it is being built on Mr. Gregory's property. Mr. Trudell asked for clarification of #9. The commission felt that the road on the northern part (Green Tree Drive) did not have to be built before the Gregory Drive lots could be developed. Mr. Burgess said that he wanted no misunderstanding at Final Plat that he wants the entire Gregory Drive accepted by the city before any buildings could be built. Mr. Burgess moved to amend the motion to add the following stipulation #16 Mrs. Maher seconded. 16. This development is contingent on the cities acceptance of Gregory Drive as a city street from Williston Road to the Gregory Drive cul-de-sac. All voted in favor of the amendment.
