FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, Greentree Park, Inc. site plan application to amend a previously approved site
plan for a 14,087 square foot building for mixed office/warehouse use approved by Planning
Commission on August 17, 1988. The proposed amendment would alter the approved site plan for
the property to reflect the landscaping planted. This accounts for a reduction in the required
landscaping.
On the 21 st of March, 2000, the South Burlington Development Review Board approved the site plan
application of Greentree Park, Inc. under Section 26.10 of the South Burlington Zoning Regulations
based on the following findings:
1. This project consists of amending a site plan for a 14,087 square foot building for mixed
office/warehouse use approved by Planning Commission on August 17, 1988. The proposed
amendment would alter the approved site plan for the property to reflect the landscaping planted.
This accounts for a reduction in the required landscaping. The original site plan approval stipulated
that $15,000 worth of landscaping be installed. Approved plans called for 39 Austrian Pine, 14
Sargent Crabapple, 17 Emerald Lust Norway Maple, 47 Globe Arborvitae, and 8 Seagreen Juniper
($18,205 worth of landscaping). The approved landscaping plan was not implemented. The applicant
has proposed an amended site plan that does not include any new landscaping, but asks the Board to
accept the current value of what was planted and has matured.
2. The owner of record of this particular property is Greentree Park, Inc.
3. Landscaping_ The applicant has calculated the value of the landscaping based on its current or mature
state. Staff has advised the applicant that the value of the landscaping should not be based on its current
value, but its value at the time of planting. The applicant has also listed 33 Austrian Pine trees in the
proposal, but actually there are only 29 Austrian Pine trees on the property. The calculated value of what
exists on the property is $11,506. This is a $3,494 shortfall from what was required as part of the previous
site plan approval (calculation based on value at time of planting). The approved site plan required the
west, north, and east borders of the property to be lined with trees. There are gaps in these borders. This
is especially noticeable in the rows of Austrian Pines along the west and north boundaries. These gaps
allow for adequate room for the planting of additional trees.
Staff recommended that $3,500 of new Austrian Pines be planted along the north, west, and perhaps east
boundaries.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves the site
plan application #SP-00-02 to amend a previously approved plan for a 14,087 sq. ft. building for mixed
office/warehouse use. The amendment consists of altering the site plan to reflect the landscaping planted,
7 Green Tree Drive, as depicted on a plan entitled "Lot 6 Green Tree Park Gregory Drive South
Burlington, VT. Record Drawing," prepared by Trudell Consulting Engineers, Inc, dated 12/20/99, with
the following stipulations:
1.All previous approvals and stipulations, which are not superseded by this approval, shall remain
in effect.
2. Applicant and staff shall agree upon plantings to fill four gaps on the site plan in an amount
not to exceed $3500. The Development Review Board grants the applicant a waiver for the
difference between $3500 and the actual costs to fill the four gaps as agreed upon by staff.
The applicant shall submit a revised plan depicting the agreed upon additional landscaping.
3. Any change to the final plat plan shall require approval by the South Burlington
Development Review Board.
